Commissioner Martin stepped down from the dais in connection with the following item due to his "certain lack of objectivity" as stated at previous meetings pertaining to the Balboa Peninsula. tem Al A proposal to amend Districting Maps.No.. 9, 10, 11, MENDMENT and 12 to reclassify properties on the Balboa 0. 363 Peninsula, generally lying easterly of McFadden Place and 21st Street, from the C -1, C -1 -Z, R -2, ONT. TO PRIL 12 R -3, and R -4 Districts to the R -1 and R -1.5 Dist- ricts. Further proposal to reclassify publicly - owned lands on the Balboa Peninsula from the R -1 District to the OS (Open Space) District. Initiated by: The City of Newport Beach Community Development Director Hogan reviewed the staff report with the Planning Commission which included an alternative proposal for their consid- eration. Mildred Hervey appeared before the Planning Commis - sion in opposition to the change of zone. Donald Haskin, 108 Montreal, Playa Del Rey, appeared before the Planning Commission representing Eddie Culver, property owner of two lots on Balboa Boulevard west of Adams. He questioned continued use of commercial businesses and requested clarifi- cation of nonconforming uses. Jack Wassall, 409 E. Edgewater, stated opposition to R -1 and R -1.5, agreed that an amended R -2 zone has some merit and that oceanfront property should not be required to have open space. Dick Clucas, 4403 Seashore Drive, appeared before the Planning Commission in favor of the down-zoning • and adoption of the amendment as proposed. Irma Wurt, 406 E.Oceanfront, appeared before the Planning Commission in opposition of the zone change. E. L. Hoyt, 1718 Oceanfront, stated opposition to the open space requirement on oceanfront property and criticized the City's posting procedure. Richard Irwin, 235 Carnation, Corona del Mar, realtor, appeared before the Commission and stated that unless citizens were reimbursed for loss of use of the property and taxes were lowered, the down- zoning was unfair. He also commented on the problem of parking and visitors to Newport Beach. Jean Morris, 301 Cerritos, appeared before the Planning Commission and commented on nine citizens' meetings held in October, November and December, 1972 and quoted from the results of the studies which indicated the citizens' desire for a reduc- tion of the potential population growth, a strong concern to preserve the community character and • limit the size of residential buildings; therefore, the professional planning staff's report should be heeded since it was based on citizen input. A sey, 113 Via Venezia, appeared before the Planning Commission and stated he did not believe that down - zoning would necessarily devalue the property, however, some thought should be given to property adjacent to high density development such as the Caribe. He also commented on rezoning the Marina Park to the OS District and commended the staff and Commission for trying to preserve the City. Coy Hester, 1730 Port Abbey Place, commented on rights of property owners and opposed the down - zoning. Mrs. Howard Babb, 2507 Via Marina, appeared before the Planning Commission and commented on the growth policies and questioned the availability of an Environmental Impact Report. Community Develop- ment Director Hogan advised that the E.I.R..was available at the office. Douglas Lind, 1585 E. Ocean Blvd..appeared before • the Commission on his own behalf as well as a member of the Board of Directors of the Balboa Peninsula Point Association and applauded the staff and Planning Commission efforts in connection with the doV - zoning. Rod CQ.ld.erhead, 710 -712 Iris Avenue, Corona del May, President of the Newport Harbor -Costa Mesa.Board of Realtors appeared in opposition to the change of zone and suggested the city hire a professional group to make a survey of planning, zoning and building. At this paint the public was advised that a consulting firm was employed to do an inventory; testing and analysis. Their report was used in connection with the trend growth element and an up- dating of the report will be made based on final policies approved and adopted by the Commis- sion and the City Council. Jerry Cobb, 2404 Vista Nobleza, appeared before th Commission and commented on ordinances already. enacted, the effects of same and need for parking. . Tom Hyans, President of the Central Newport Beach Community Association, appeared before the Commis- sion and read from the Association's newsletter of March, 1973 what seemed to be a reversal of Page 3. He reported that the Association believes the key to the problem is the R -2 District. Goldie Joseph, 515 Via Lido Soud, appeared before. the Planning Commission and commented on the inequity of R -1 and R -2 zones and can see no reason for any change in the zoning. James Ensign, 224 20th Street, appeared and stated that the area between 19th Street and 21st Street should be given special consideration and should be excluded at this time from any rezoning until further studies can be made of the area. Barbara Barnard, 1100 W. Bay, appeared before the Planning Commission in favor of the down - zoning. Sue Ficker, 110 - 9th Street, appeared before the Commission on behalf of herself and also her sister Angela White, 1132 W. Bay Avenue. She stated their agreement to the down- zoning but requested that the small comm, rcial areas remain as they are needed. Al SchwJey, 2860 Alta Vista Drive, appeared before the Commission and commented on "bootleg" units an their elimination to reduce population on the peninsula. Mrs. Robert Gormley, 1745 Candlestick Lane, owner of property at 15th and Oceanfront appeared before the Commission in connection with-the use of her property should it be rezoned. Bill Campbell, President of the Peninsula Point Association appeared before the Commission in favor of the down- zoning but requested that any action be delayed at this time until further studies were completed regarding amending the R -2 District. Elaine Lindhoff, 1716 E. Ocean Boulevard, appeared in favor of the change of zone. Allan Beek, 28 Beacon Bay, appeared and commented .on the floor area ratio between R -1 and R -1.5; parking, combining lots for development, and commended the staff and Commission for the fine job they have done. Gilbert Ferguson, 1033 Tiller Way, appeared before the Commission in opposition to the change of zone. William Fundenberg, 808 W. Balboa Boulevard, appeared before the Planning Commission to comment on the inequities of the rezoning and presented a letter for review by the Planning Commission. Community Development Director Hogan advised the public of the City's policy relative to meeting with persons interested in the planning process both in connection with the general plan and on an individual basis. Mrs. Howard Mansur, 308 Fernando, appeared before the Planning Commission in opposition to the down- zoning on her property because of its location to the Caribe. There being no others desiring to appear and be heard, the public hearing was closed. Planning Commission recessed at 9:45 P.M. and reconvened at 10:00 P.M. Planning Commission discussed alternatives in connection with this matter including transition zones between high density development and two - family development. Amending the ordinances regulating multi - family dwellings and parking requirements were also discussed. Motion X Following discussion, Planning Commission adopted RES. RE- NO. 795 Planning Commission discussed. the Lido Peninsula and the application of the Planned Community District to same. It was also noted that Lido Island, Stat Area C, was missing from the report. Public hearing was opened and the following person appeared before the Planning Commission to comment on the matter: Valerie Murley, 1733 Candlestick Lane; commented on Area J and the possibility of acquiring the northernmost part of the undeveloped land for use in connection with the Upper Bay Wildlife Reserve.. Sue Ficker, 110 9th Street, also commented on Area J and acquisition of the land. Robert Brose commented on the property at 18th and Bay Avenue in Area D. Goldie Joseph commented on the park adjacent to Marinapark in Area D. Tom Hyans, 19th & Bay, commented on the yacht club in Area D. There being no others desiring to appear and be heard, the public hearing was closed. Commissioner Martin reiterated that he would abstain from any discussion regarding Stat Area D. The Environmental Impact Report in connection with this matter was briefly reviewed and discussed. Planning Commission recessed at 11:50 P.M. and reconvened at 12:05 A.M. However, provision should be made for private development if public acquisi- tion is not feasible, therefore the property should be zoned to permit residential development at a maximum density of six dwelling units per gross acre. That the water capital improvement acreage fee be paid, and that storage capacity in San Joaquin Hills Reservoir equal to one maximum day's demand be dedicated to the City. 4. That all grading be in accordance with grading plans and reports approved by the Public Works Director and a qualified soils engineer. Upon completion of the grading the civil engineer and the soils engineer shall certify that the grading has been completed according to the • plans and the requirements of the grading ord- inance. The surface of the access roads must be available for use by maintenance vehicles during all weather conditions. 10: That all street parkway trees be planted in accordance with the standards of the Parks, Beaches and Recreation Department and that the standard tree inspection fee be paid. 11.
