HomeMy WebLinkAbout03/17/194397 March 17, 1943 THE NEWPORT BEAOR CITY PLANNING COMMISSION held its regular monthly meeting in the Council Chambers, City Hall, Newport Beach, California, on Wednesday afternoon, Liaroh 17, 1943, at 4 P.M., Chairman Hopkins presiding. ROLL CALL Commissioners present: Hopkins ,Seager,Patterson,:..Pelson, Johnson. " absent: Ninch,rindlay,Campbell and Allen. Chairman Hopkins called for consideration of kiinutes of eeb- MINUTES ruary 17th, 1943. Commissioner Johnson moved that the minutes be approved. Motion seconded by Commissioner Nelson, carried and so ordered. COMMUNICATI Secretary ;eager read a communication from iars. dilliam Lambert, dated Los AngeleS, rebraary 8, 1943, addressed to the City Council and referred by that body to the Planning Commission in which tars. Lambert made application for permission to build an additional small three room unit at jp406 Clubhouse Avenug,City of iiewport Beach, California. Commissioner Pattersom moved that the application, together with other communications, be tabled for further consideration on the conclusion of the two public hearings set for this time. Motion seconded by Secretary Seager, carried and so ordered. Secretary Seager declared the hearing of application of D. W. Elliott for permission to slant drill in West Newport open. He stated that the time and place of such hearing was duly advertised and that he had on file copy of such advertisement together with affidavit of publication. At this juncture, Chairman Hopkins interposed to state that a second hearing had beon'adv.ertised., when as a matter of fact the first hearing had not been closed and, therefore, this was an adjourned first hearing of the application. He in- vited anyone present at this time who was not at the first session to take the floor if they so desired. Mr. W. A. Merrick, property owner, 6900 Ocean Front, Balboa, California, protested the application on the ground that no petition for signatures of property owners had been presented. Mr. Carl J. Stahnke, property owner, 7200 Coast Highway, New- port, California, spoke in support of the application, but ask- ed that action be deferred until completion of the well now being drilled. Adjourned lot Hearing D. W. ear ' Mrs. Carl J. Stahnke spoke in support of her husband's sugges- tion. Mr. James McArdle, 6500 Coast Highway, asked for information as to what Mr. Elliott proposed to do. Chairman Hopkins explained in some detail the purpose of Mr. Elliott's application. He said that our present Ordinance did not permit drilling of any M kind, and that permission to drill would involve amendment of the Ordinance. He stated that the Planning Commission was ' merely hearing the application and at the same time afford- ing Mr. Elliott an opportunity to explain just what he pro- posed to do if his application were granted. Mr. Elliott then took the floor. He stated that since the last hearing he had contacted various property owners - notably, Mr. Frank Riddle, largest property owner in the section involved, who advised him that if the city could work out any kind of a satisfactory deal, he would offer no objections, whatsoever. Mr. Elliott said that Mr. Riddle might not be present at this time, but that he had given him authority to make this statement on his behalf. Mr. S'lliott.also stated that he had taken Mr. DuBarry on a tour of similar projects, and that he thought Mr. DuBarry felt more favorably inclined toward the proposition than heretofore. whereupon, Mr. DaBarry arose and voiced ob- jections similar to those.he had expressed at the first session. Mr. Elliott produced aerial photos and map of drilling area in support of his application, and at the suggestion of Chairman Hopkins filed the same with the Planning Commission for its records. Chairman Hopkins also suggested that Commissioner Patterson have the exhibits marked as to date ' of filing and cause the same to be posted at the City Hall for the information of interested property owners. Chairman Hopkins asked Mr. Elliott if he would be prepay >ed for the second public hearing at the next regular monthly meeting-of the Planning Commission, April 21, 1943, at 4 P.M. Mr. Elliott said he would be.ready at that time. Commissioner Patterson moved that the first hearing be closed. Motion seconded by Commissioner Nelson, carried and so ordered. Commissioner Johnson moved that the second public hearing in the matter of the application of Mr. Elliott be held at the next regular monthly meeting of the Planning Commission, A pril 21, 1943, at 4 P.M., and that the Secretary be instructed to advertise time and place of such second hearing. Motion seconded by Commissioner Nelson, carried and so ordered. 1st Heari I 2g Chairman Hopkins declared the first hearing in the matter of, oposed BeW the proposed new zoning ordinance open. He stated that while Zoning Ord. it was the duty of the Planning Commission to carefully study the proposed new zoning ordinance, the purpose of the hearing was to listen to those who wished to speak for.or against the proposed new zoning ordinance, not to attempt to sway opinions one way or another, but to handle the hearing as expeditiously I as possible. 99 Mr. John S. Harris asked for a copy of the. proposed new zon- ing ordinance. Commissioner Patterson furnished him with bhe same. 'There being nothing farther from the floor, Chairman Hopkins declared for the parpose of the record that there were no protests made at this hearing either from the floor or in writing. Commissioner Nelson moved that the first hearing in the mat- ter of the proposed now zoning ordinance be closed. Motion seconded by Commissioner Johnson, carried and so ordered. . Commissioner Patterson moved that the second hearing on the proposed new zoning ordinance be set for the nest regular monthly meeting of the Planning Commission April 21, 1943, at 4 P.M., and that the Secretary be instructed to advertise the time and place of such hearing. Motion seconded by Commissimer Johnson, carried and so ordered. Commissioner Nelson moved that the letter written by Mrs. COMMUBICATIOnS Lambert be lifted from the table for consideration. Motion RESUMED seconded by Secretary Seager, carried and so ordered. After some discussion, Chairman Hopkins suggested a notifica- tion be sent to Mrs. Lambert by the Secretary to the effect that the Planning Commission had denied her application, but 'should she wish to appeal from the decision she would be ac- corded an opportunity to do so at the nest regular monthly meeting of the Planning Commission April 21, 1943, at 4 P.M., when the second hearing on the proposed new zoning ordinance was scheduled to be heard in the Council Chambers, City Hall, Newport Beach, California. Commissioner Pattersoh moved that Mrs. Lambert's request for permit to <baild as outlined by her be denied as it condlioted with the present zoning ordinance; that the Secretary be in- structed to so advise her, notifying her that if she wished to appeal from this decision she would have an opportunity to do so at the nest regular monthly meeting of the Planning Commission April 21, 1943, at 4 P.M., in the Council Chambers, City Hall, Newport Beach, California, when the second hearing on the proposed new zoning ordinance would be held. Motion seconded by Commissioner Johnson, carried and so ordered. The Secretary read letters of appreciation for the dinner given by chairman Hopkins March 1st from Mr. W. M. Longmoor, President of the Newport Harbor Chamber of Commerce, and Mr. Walter S. Spicer, Chairman of Orange County Harbor Commission. The Secretary stated that various members of the Planning Commission had received invitations from Bullock's to attend 'a discussion on city planning by Mr. Richard J. Neutra, member of the California State Planning Board, entitled "The City We Are Fighting For." A memorandum from former Congressman Alfred F. Briter regard- ing Bill No. H.R. 1898, entitled "First Post -War Planning Act 100 of 1943" was read. Also, a news release from the Urban Land Institute giving Senator Pepper's views on rebuilding of cities as a vital phase of postwar planning. A timely editorial "Fact and Comment "by Charles C. Cohan was also read. , Commissioner Johnson moved that the Secretary be instructed to write a letter on behalf of the Planning Commission to Re- presentative Robt. L. Donghton, Chairman of the House Committee on Ways and Means, endorsing Bill NO. H.R. 1898; also, a similar letter to congressman John Phillips and Senator Hiram W. John- son. Motion seconded by Commissioner Patterson, carried and so ordered. Commissioner Patterson urged the installation of a library of reference for the use and benefit of members of the Planning Commission on matters pertaining to planning. Chairman Hopkins suggested that Commissioner Patterson and Secretary Seeger be appointed as a committee to investigate the feasibility of this proposal. Commissioner Nelson moved that Commissioner Patterson and Secre- tary Seager be appointed as a committee to act in the matter of the establishment of a reference library on matters pertain- ing to planning. Motion seconded by commissioner Johnson, car- ried and so ordered. ADJOt1RNM$NT Commissioner Nelson moved that the meeting be adjourned.
