HomeMy WebLinkAbout03/17/194977 The Newport Beach City Planning Commission held ..a regular meeting on Thursday, March 17, 1949, with Chairman Longmoor presiding. Commissioners present: Copelin, Daniell, Johnson, Longmoor, Pleger, and ROLL CALL ' Wightman. Commissioners absent: Baltz, Ellerbroek, and Rudd. Commissioner Johnson made the motion, seconded by Commissioner Pleger for MINUTES for the approval of the minutes of the meeting of Frebruary 17, 19499 as read. Motion carried and so ordered. Hearing upon the application of Mr. and Mrs. Logan Smith, for a 15 inch PUBLIC HEARINGS setback variance for Lots 5 and 6, Block E. Seashore Colony Tract, for the purpose of building a two car garage, was declared, same having been duly filed and advertised...No protests were received or heard, and Commissioner ohanon reportes as chairman of the committee to check this property, stat g Pcan see no real reason for denying this, particularly as the owners have dedicated 15 feet for an alley ". Commissioner Pleger made the motion for closing the hearing, which was seconded.by Commissioner Johnson, after which Commissioner Johnson made the motion, seconded by Commissioner Wight - man, that the Commission recommend the approval of the granting of this application, which carried by the following roll call vote, AYES: Copelin, Daniell, Johnson, Longmoor, Pleger, Wightman. NOES: None. ABSENT: Baits, Ellerbroek, Rudd:, The matter of the application of the Newport Beach Ebell Club for a condi- tional permit for remodeling and the construction ofan addition to the pres- ent clubhouse on Lots 10, 11, 12, and 139 B10ch 10, Tract East Newport, was brought up for action, some having been tabled from the last meeting, pend- ing further study. Chairman Longmoor advised the Commission that this mat- ter was still under consideration and suggested that same be put on the table until neat meeting. Commissioner Johnson therefore made this motion, which was - seconded by Secretary Copelin and carried. Mrs. Elizabeth Bean, 411 Heliotrope, Corona del Mar, was present requesting information and instructions for the requirements for permission to conduct a Day Nursery School at her residence, stating she had checked with the State Department for approval. Mrs. Bean was instructed to file an appli- cation with the secretary, for a conditional permit, as required by Ordi- nance No. 525, and to accompany this application with a map and plans._ Final hearing upon the matter of a petition of property owners of property on the southwesterly side of Ocean Boulevard, Corona del Mar, comprising one -half of Lot 13 and Lot 14, through Lot 17, of Tract 1026, all of Tract 1297, and the northwesterly 305 feet of Block A, for the elimination of the 10 foot setback requirement for this property, provided the roofs of the houses built thereon be not higher in elevation than the curbing on the ppposite side, or the north side of Ocean Boulevard, was declared. A large group of property owners were present for this matter, and protests were heard from Mrs. Marguerite Greisser, 21r Carnation,,who pleaded vigorously for the denial on the basis that the strip of land heould be saved for a park similiar to that at Long Beach and Santa Monica. Also heard, were W. S. Hoyt, and his son, both Corona del Mar property owners, Mr. Gavers, who stated, Wthought this matter was settled years ago then:the setback was established at 10 feet, ", Mrs. Robert Burton, 233 Poppy, who stressed that the provisions of the petition requiring the roofs be not higher than the curbing on the opposite side of the street, "will save the view ", Mr. Wallace Burton, 1000 Ocean Boulevard, and representing the Corona del Niar Association, in opposing any variance in setback, as "the present set- 78 back is good planning ", and Mont thing this petition and that on the access road can be separated ", to which Mr. A. E. Fitzmorris agreed. Also present were Mr. George Penny, 1405 Ocean Boulevard, who stressed the legal factors involved, as concerning the City's rights., and the possibliity of someone of the property owners involved compelling the final abandonment of the street, so suggested that this entire matter be referred for further study and comprehensive planning to be "worked out for all the property own- ers on the bluff ". Others present were Jeanette Briggs and Mr. Clandenning. Representing the petition and answering dtuestions was Dr. Roberk C. Burt, who stated, "we want to save the view through a strong *ndueement, and the granting of this setback means almost a guarantee, as it will gibe more opportunity to spread out ". Commissioner Wightman expressed the thought that pbrhaps the opposition had not given enough thought to what the overall build- ing plan could do. However, Chairman Longmoor pointed out that "we have been holding kearings on something that we cannot recommend ", inasmuch as the petition calls for 100% variance and "that we cannot recommend ", the Commiss- ion "can only recommend irariances up to 50 %0. Commissioner Wightman made the motion for closing the hearing, which carried, after being seconded by Commissioner Pleger, and after whieg Mr. Penny made the suggestion that the legal factors be checked and "then let the Council ac * ". Commissioner John- son then made the motion, seconded by Commissioner Pleger, that the Commiss- ion recommend that this petition be denied for the following reasons, the application is for a 10 foot setback variance which constitutes s 100% variance and the ordinance does not permit the Planning Commission to recommend a var- iance in excess of 50%, also it is the opinion of the Commission that we can- not grant a variance with conditions such as are contained in this application, also, the Planning Commission recommends that a complete plan of the entire area and project be worked out for the consideration of the Planning_Commis- ' sion instead of individual portions as contemplated in this particular appli- cation, also, it is the suggestion of the Planning Commission that each fae- tion involved in this matter appoint a small committee to work with our Plan- ning Consultant, City Engineer, City.Attorney, a committee from the Planning Commission, and a committee from the City Council, in an effort to develop a complete plan that might be acceptable to the parties on both sides of Ocean Boulevard, Corona del Mar. This motion carried and so ordered on the follow- bug roll call vote, AYES: Copelin, Daniell, Johnson, Longmoor, Pleger, and Wightman. NOES; pone. ABSENT: Balts, Ellerbroek, and Rudd.
