Item 1. APPEAL Request to permit a fence 8'2" in height.to FR -M remain in place. DENIAL OF MODIFICA- Location: Portion of Lot 4, Block 1, Tract 27, located at 455 Catalina TION NO. T45 Avenue, west side of Catalina Avenue between Broad Street and Clay Street. Zone: R -1 Applicant: Marvin Oberndorfer, Newport Beach Owner: Same as applicant. Mr. Oberndorfer was present at the meeting. This application had been continued from the meeting of March 5, 1970 in order that the Assistant City.Attorney could render an opinion as to whether or not the nonconformity could be continued until such time as the vacant property to the northwest is developed. USE PERMII had been transmitted to the Commission and, after discussion, Modification No. 145 was approved for a period of four years. Request to permit yacht and ship brokerage. Zone: C -1 -H Applicant: J. H. Richardson Co., Inc. Balboa Island Owner: The Irvine Company, Newport Beach Mr. Jack Richardson was present at the meeting . and answered questions of the Commission. The Commission questioned Mr. James E. Taylor of the Irvine Company as to the amount of park- ing available and he stated that they have more than the required number of spaces. After further discussion, the application was Motion x approved, subject to the following conditions: Second x All Ayes 1. Remodeling of the applicant's perman- ent office space shall be completed in a period not to exceed 90 days, and the relocatable building shall thereupon immediately be removed from the premises. 2.. A revised plot plan showing proposed parking lot landscaping shall be submitted to the Planning Director and shall be subject to his approval. 3. An enclosed trash area shall be pro- vided. i Page 2. USE PERMI1 Request amendment to Use Permit 1458 to allow a 16' x 20' building not shown on original use permit to remain as presently located. NO. 1471 APPROVED Location: Lots 17, 18, 19 & 20, Tract 1210, located at 600 -630 West Coast Highway, on the north side of Wes Coast Highway opposite the Bayshore community. Zone: C -1 -H Applicant: Dick and Clyde Johnson, Costa Mesa Owner: Same as applicant Mr. Dick Johnson was present at the meeting and answered questions of the Commission. He . explained that the building in question will be used by the Morgan Yacht Company and not by the Whistle Stop Restaurant. There was a discussion regarding the require- ment of a sidewalk at the time Use Permit 1426 was granted to the Bristol Yacht Company and which is now being activated by the Morgan Yacht Company. That two additional parking spaces be provided by Morgan Yacht Company for use by employees of the Whistle Stop Restaurant. 2. A masonry wall or proper screening be provided around the trash collec- tion area. 3. A general clean -up of the building and exterior painting will be per- . formed. 4. AMENDMENT Appeal from denial by the Planning Commission of amendment to extend the closing hours of TO USE PER- the White Horse Inn from 12:00 Midnight to M TS 2 :00 A.M., and to allow continued use of am- plification in conjunction with live enter - tainment. Location: Located at 3295 Newport Boulevard on the westerly side of Newport , 12-7 and 1419 APPROVED Boulevard, between 32nd Street and Finley Avenue. Zone: C -1 Applicant: Dan - Britannia, Inc., (White Horse Inn) Owner: Richard Ervin, Newport Beach The Planning Commission action of February 19., • 1970 regarding these applications had been appealed to the City Council and at the Council meeting on March 9, 1970, was referred back to the Planning Commission based on substantial new evidence presented by the applicant. Chairman Jakosky inquired whether or not the Commission wished to reopen the public hearing and consider this new evidence. On motion of Commissioner Adkinson, seconded by Commissioner Glass, and carried, the public hearing was reopened. Mr. John Ryder of the White Horse Inn was present at the meeting and submitted, in addi- tion to the previous petition submitted to the City Council bearing 76 signatures of residents in the area, a letter from Mrs. Joy Grenz of 400 Clubhouse Drive, the closest house to the subject property. Mrs. Grenz stated in her letter that since the Council meeting condition have improved 100% and whoever is responsible for changing these matters is to be commended. Mr. Ryder also presented a statement showing that extensive work had been done to the exhaust • blower on the roof. Mr. Ryder stated further that now that they the are aware of problems, they expect to satisfy the neighbors. Mr. Ryder also stated that they now have parking attend- ants on Wednesday through Saturday who, althoug Page 4. Mr. Foley reported that the Dewey can has been moved to the side of the building, a "loading only" sign has been painted at the rear of the building, the White Horse Inn parking lot has been restriped, the exhaust fan has been turne to face away from the residential area to the rear of the property, and a parking attendant has been on duty in the parking lot. The following persons spoke in opposition to the application: Mrs. Eva Kowal.eski and Mr. Victor Kowaleski of 402 Clubhouse Avenue. The following persons spoke in favor of the application: Mr. Ted Thomas who has been a tenant at 3212 Marcus Street for 12 years; Mr. John Callahan who owns property at 408 and 410 Clubhouse and one of the original signers of the petition against the application; • Mr. Terry Baldwin, a tenant at 3300 Marcus Ave. After further discussion, the application was Motion x approved, subject to the following conditions: Second x All Aye �1. That the amendment to Use Permits 1244, 1272 and 1419 to extend the closing hour from 12:00 Midnight to 2:00 A.M. and the use of amplifi- cation devices be approved for a period of one year; any request for extension to be considered by the Planning Commission. Also, staff is to report quarterly as to whether the applicant is complying with all conditions. 2. Applicant to provide adequate light- ing in the alley and adjacent parking area. 3. No delivery trucks to be allowed to unload while stopping in the alley; all unloading to be restricted to' the White Horse Inn parking lot. • 4. The Dewey's rubbish can will be kept on the parking lot'side of the res- taurant and will be kept clean at all times. Page 5. CITY OF NEWPORT BEACH a March 19. 1970 COMMISSIONERS y too NN 01 f y l 5. The Dewey's rubbish can will be emptied after 9:00 A.M. and no trash shall be placed into said rubbish can after 9:00 P.M. 6. The City Center Block parking lot on Finley Street will be closed and chained on Friday and Saturday nights at 7;00 P.M. The White Horse Inn will be responsible for seeing that this is done. 7. The White Horse Inn will pick up and clean the area around the Pride Gas Station on Saturday and Sunday mornings. 8. The White Horse Inn will turn around the fan on the roof of the Inn so that it faces Newport Boulevard, and will turn off said fan at 11:15 P.M. every night. A quiet motor and exhaust • unit shall be placed on said fan. 9. The White Horse Inn will provide uniformed parking attendants on Wed- nesday through Saturday from 9:00 P.M. to 2:00 A.M. Said attendants will patrol the area around the restaurant and direct patrons to available and lawful parking spaces. 10. The rear door of the White Horse Inn will be closed and locked every night at 9:00 P.M., except as may be required by the Fire Marshall. Mr. Nuzum asked the Commission and the Assistant City Attorney for an interpretation regarding the expiration of the 1k year time limit for variances and use permits; whether this is from the date of approval or from the 15 day waiting period after the approval date, inasmuch as the department has an extension request that has passed the 11 year time limit but is withi the 15 day waiting period time. • It was the consensus of opinion that the 1'h year time limit should start after the 15 day waiting period and that the extension request should be accepted and placed on the next agenda.
