day, March 21, 1946, at 7:30 p.m., in the Council Chamber, City Hsll,
Newport Beach, with Chairman Allen presiding.
Commissioners present: Allen, Ellerbroek, Isbell, Johnson, Longmoor, ROLL CALL
Nelson, Webb, and White.
Commissioners absent: Baltz.
Commissioner Johnson made the motion, seconded by Commissioner Longmoor MINUTES
that the minutes of the February 21 19462 meeting, be approved as cor-
rected, i.e., legal description of the A. K. Trieten property. Motion
carried, and so ordered.

The second and final hearing on the matter of the application of A. K. PUBLIC HEARINGS
Trieten for rezoning from R-3 to C -1 of theNW 250 of the SE 60+ of the
N 11 of Lot 3, and the NW 251 of the SE 601 of .Lot 4, and the Nw 251 of
the SE 60t of Lot 5, Block 2, Sea Shore colony Tract, Newport Beach was
declared and heard. Secretary Ellerbroek stated same had been duly fil-
ed, advertised, and cards sent to adjoining property owners. A committee
of Commissioners Johnson, Baltz, and Nelson appointed by Chairman Allen
at the meeting of February 21, 1946, to investigate the property, report-
ed, suggesting that the legal description of the property be check, and
Commissioner Johnson made the motion, seconded by Commissioner Ellerbroek
that the matter be tabled to the next meeting for further consideration.
Motion carried and so ordered.
The public hearing upon the matter of the application of H. Robert Adams,
(tabled from last meeting), for a change of rear yard setback from 10+ to
51 for Lot 6, Block 4, Tract 518, was declared and heard. Commissioner
White, chairman of a committee composed of himself and -Commis <doners Nel-
son and Allen, reported having carefully investigated the property, and
the entire block. After much discussioh by the Commission, Commissioner
"White made the motion, seconded by Commissioner Ellerbroek that the Com-
mission recommend to the.City Council the Approval of the application. ROLL CALL VOTE
Ayes: Commissioners Allen, Ellerbroek, Isbell, Johnson, Longmoor, Nel-
son, W.ebbe and White.
Noes-. None. Motion carried, and so ordered.
Inasmuch as this property is in the samb block as that of Mr. Yale, who
applied for a change of rear yard setback from 10t to 51 a couple of
months ago, and was denied his request, the opinion of the Commission was
that Mr. Yale should bs notified by the secretary and advised to apply
for reconsideration, without filing costs.
The public hearing for change of setback bariance from 30, to 25, from
the bulkhead line for pots 1 and 2, Block 338, Canal Section, was declar-
ed and heard, same having been duly filed and advertised. Discussion by
the Commissioners brought the motion by Commissioner Johnson, seconded by
Commissioner Longmoor, that the matter be held over to the next meeting,
and a committee appointed by the chairman to investigate the area and
application. Motion carried, and Chairman Allen ap-ointed Commissioners
Johnson, Baltz, and Nelson.
The second and final hearing upon the matter of a change of zone classi-
fication from R -1 to C -1 for Lots 2, and 3, Block P, Balboa, on applica-
tion of J hn F. Vogel, was heard, despite a letter from'Mr. Vogel request-
ing the withdraw) of his• application, due to the presence of over fifty
residents and property owners, and the receipt of eleven letters of pro-
test, and iaso a petition of protest, bearing the names of sixty -three
property owners. Chairman Allen, upon asking for a show of hands from

the audience, was not given one in favor of granting the application,
and Commissioner White made the motion, seconded by Commissioner John -
ROLL CALL VOTE son that the application be denied, and the property be not rezoned C -1.
Ayes: Commissioners Allen, Ellerbroek, Isbell,.Johnsono Longmoor,
Nelson, Webby and White.
Noes: None. Motion carried, and so ordered.
The first public hearing upon the application of R. S. Griffin, for a
change of zone classification from R-3 to C -1 for Lots 14, and 15,
Block 634m banal Section, was declared, but discussion revealed that
Mr. Griffin is lessee of the property and not the owner, and as such .
can not apply for the rezoning, hs"this: must be done by the property
owner, Neff Morrison. Commissioner Johnson, made the motion, seconded
by Commissioner Longmoor, that in view of hr. Griffin's not being the
property owner, that the matter be set for the next meeting, provided
the proper petition be presented. Motion carried.
NEW BUSINESS Secretary Ellerbrosk read a petition of property owners of Block 6342
Canal Section, for the rezoning of said block from R -2 to C -1, explain -
ing that"the present classification of R-2 gives no architectural res-
trictions, and no assurance of completing the general business zone
plan for Central Avenue on both sides of 32d Street to the southerly
and of the overhead grade crossing." Chairman Allen suggested that
the matter be advertised for public hearing for the next regular meet-
ing.
A petition signed by Clifford R. Joye and Bernard L. Bell, and under-
signed by owners and lessees of property in the vicinity of lots in
the petition was read. The petition requested permission to construct
and operate a miniature golf course on Lots 9, end 10, Balboa Tract.
The petition did not request a rezoning, which in accordance with Ord-
inane 525 would have to be made C -2. After careful consideration and
discussion,.Commissioner Longmoor made the motion, seconded by Commiss-
ioner Johnson that Mr. Joys and Mr. Bell be notified that business of
a miniature golf course at that location would not be conforming, and
ROLL CALL VOTE that the request be denied.
Ayes: Commissioners Allen, Ellerbroek, Isbell, Johnson, Longmoor, Nel-
son, Webb, and White.
Poses None. Motion carried, and so ordered.
An application presented by Mr. Phipps, accompanied by a map, for a
change of lot lines for Lots 1, 2, and 3. Block 143, Corona Del Mar,
was carefully considered by the Commission, after which Commissioner
Longmoor made the motion, seconded by Commissioner Ellerbroek that the
Commission recommend to the City Council the proposed division of said
ROLL CALL VOTE lots (change of lot lines), as per the attached map.
Ayes- Commissioners Allen, Ellerbroek, Isbell, Johnson, Longmoor, Nel-
son, Webb, and White.
Noes: None. Motion carried, and so ordered.
Map of Tract 11169 now a part of the City of Newport Beach, and a pro-
posed subdivision by the Raymond A. torn Company, was presented and
considered. Some discussion ensued over the proposed streets at 3019
which the Commission had recommended be 361 from curb to curb, when the
tract came before the body previous to annexation to the City. This
recommendation was made to the Orange County Planning Commission, but
apparently that body did not pass it on to the Dorn Company engineers.
Commissioner Webb made the motion, seconded bg Commissioner Nelson that
the Commission recommend to the City Council the acceptance of the map

Infromal discussion, with no action, was given Mr. Paul Pemberthy, for
Lot.20 Bloch 2, Section 4, Balboa Island, for a proposed residence.
Three maps, forwarded by the Orange County Planning Commission were
warefully considered. Tentative map 1162, for which Commissioner Nel-
son made the motion, seconded by Commissioner Ellerbroek, that same be
approved by the City Planning Commission, and that the County Planning
Commission be so advised.

Secretary Ellerbroek presented a statement from the Ameriean.Society of
Planning:.Officials.£or the coming year, for which Commissioner Isbell
made the motion, seconded by Commissioner Lbngmoor for recommendation
that the City Councilrapprove same, and the renewal of membership in the
Society. motion carried.
Hub Powers, property owner of Balboa Island, presented the matter of
"home occupation" and stated that there should be an Amendment to the
Zoning Ordinance denying licenses for "home occupation" as only solu-
tion to the problem. After discussion, Commissioner Johnson made the
motion, seconded by Commissioner Longmoor that the Commission recommend
to the City Council the slimiration from Ordinance No. 525, Section 4,
R -1, Paragraph 6, and also the definition of "home occupation"p page 29

Commissioner fohnson brought up the matter of numerous boats being
built in various location of the city, not zoned for this, as some are
being built by the owners, which presented the other matter by Chairman
Allen of the unsightly use of the lot aevose the alley and in back of
the Taxi Company at 15th Street and Central Avenue; same being used as
a junk yard. Chairman Allen directed Commissioner Nelson, Building In-
spector to notify the owners that they are in violation of Ordinance No.
525, and that the lot must be. cleaned up.
