Copelin and carried, VARIANCES #f342 1. HAKES, Clifford & certain property owners Beacon Bay 2. Lots 1 thru 22, 62 & 63 Beacon Bay Zone R -1 3. Posted February 11, 1957 Published February 14, 1957 4. The construction of awnings attached to the front of the houses but not extending further than six inches back from the front lines of said lots. 5. The direct rays of the sun damage furniture in the front rooms and seriously restrict the use and enjoyment of said rooms. 6. DISCUSSION This application was held over from the meeting A of February 21, 1957 to permit the applicazit to amend by setting forth the type of materials ' to be used for the awnings. The requested in- formation was submitted and made a part of the file. 7. FINDINGS a The Committee stated that the basic idea was good and recommended approval of the application as amended and subject to the acceptance of the specifications furnished by Commissioner Lind. 8. On motion of Commissioner Keene, seconded by Comm. These variances were provided for in the recorded deed restrictions but not cleared for variance under the Ordinance. Buildings are under constructiono 6. DISCUSSION Note findings. 7. FINDINGS z When this tract was first zoned, the subdivider asked for R -1 zoning but upon request of the Commission agreed to an R -1 -B District. Due to a misunderstanding of required setbacks under an R -1 -B District, the construction of these new dwellings resulted in a violation of rear yard setbacks. The Committee feels an honest mistake was made and recommends approval of this application. 8. On motion of Commissioner Copelin, seconded by Comm. FINDINGS The Committee stated that this variance is one of similar approvals given where an encroachment of 210k into a required rear yard setback of 5' for second floor overhang is requested and recommended approval. In order to receive the most value from the high lot value I must request this variance. I have kept room sizes to a minimum but my lot is 30' x 70' and I have been able to comply with all other setback requirements. The ground floor (garage) sets in 10' from the center of the alley,.e., 5' on my property, but in order to get the second story I feel it is necessary to overhang half this distance. 6. DISCUSSION Note findings. 7. FINDINGS Policy previously established permits en- croachments of this type into rear yard setbacks in certain areas for 2nd floor overhangs. The Committee recommended approval subject to the condition that the building plans be submitted to the Commission for approval prior to securing" a building permit. 8. FINDINGS The Committee in their report stated that the granting of this variance would not be detrimental to the health, safety, peace, morals, com -fort or general welfare of persons residing in the neigh- borhood. It was further set forth that additional off - street parking would be provided. 8, On motion of Commissioner Reed, seconded by Comm. A 3' encroachment into a required 4' side yard setback and a 10' encroachment into a required 15' front yard setback. 5: The contour of the existing site is very steep and the existing structure contains concrete retaining walls that would be im- practical to replace. The existing work was designed for a 2 story structure, similar to the one now being contemplated. 6. DISCUSSION : Note findings. 7. FINDINGS This lot is located in an R -1 zone, along with several others in two blocks which extend from Pacific on the bluff to Bayside below. Most of these lots have been built upon and all structures front on Pacific. Applicant may front on Bayside by observing the necessary 151 setback, However, he is asking for a 10' encroachment. This street is narrow and carried considerable amount of traffic and any deviation from the present setback lines at this time might preclude any future widening of the street, 9 r 1 U Page VARIANCES #351 (con'd from Page 4) The Committee feels that the granting of this variance is unwise from the standpoint of safety and welfare of the public, 8. The alley does not permit use of garage due to grades of adjoing property and City property involved. 6. DISCUSSION . Note findings. 7. FINDINGS . Because the alley and topography of this area does not permit use of the garage the Committee felt there was sufficient hardship shown to recommend approval of the applicant's request. 8. Encroachment of 151 into a required 201 front yard setback. 5. Since the lots are small, being required to set back 201 would not allow adequate building room in keeping with adjacent properties which are 51 front yard setbacks. DISCUSSION Mr. Roy Raftery, representing the applicant, spoke from the floor and stated that it would be impossible to build on these lots if it were necessary to maintain a 20' front yard setback. �-70 FINDINGS The applicant is required to conform to residential requirements under Section 9105.4 (g) since she proposes to build a.dwellinu.:in a commercial district, The adjacent residential properties have a 5' front yard setback and the Committee felt there was sufficient justification to recommend approval. 8, On motion of Commissioner Keene, seconded by Comm. FINDINGS s The encroachment of this stairway into the side yard would be adjacent- to the street and would c eate a fire hazzard. Three lots as are shown on the map are impractical. Two lots out of the three will result in two nice building sites. 6. DISCUSSION Considerable discussion was held with the applicant regarding ingress and egress to these parcels. On motion of Commissioner Keene, seconded by Comm. Hayton and carried action on this application was held over until the next regular meeting. It was suggested that the applicant furnish the City Engineer with a topographical map showing how he was going to attain uninterrupted access to these two parcels and also submit a plot plan as to how the property was to be developed, #4g 1. The La Jolla Drive frontage is completely divorced from the: Catalina Drive frontage by a 30' cliff and cannot be used in conjunction with existing property at 312 Catalina Drive. This vacant lot will make an attractive building site. Lots will not meet required area for square footage, however a natural topographic subdivision is effected by the 30' cliff. 6. DISCUSSION Note findings. 7. FINDINGS The Commission can under the Subdivision Code waive square footage requirements, however it was set forth by the Committee that these parcels were too small to warrant consideration of the . waiver of square footage requirements and recommended denial. 8. The lot contains approximately 9,950 square feet which makes it very large for the two present allowable dwellings. 6.` DISCUSSION Note findings. 7. FINDINGS . The Committee stated that the parcel to be divided was of such size to warrant two building sites. Recommendation of the approval of the applicant's request was made subject to the condition that square footage requirements and the filing of the final map be waived. 8. The Committee reported that this building had been used for this purpose in past years and that the applicant had operated similar establishments in an excellent manner. 7. DISCUSSION The Commission was advised that the present building violates nearly all required setbacks if used for dwelling purposes. 6. FINDINGS The Committee reported that the building is rather antique and is not suitable for the purpose of a dwelling. It was further noted that no provision had been made for a garage or off - street parking. A recommendation of denial was made by the Committee. 7. On motion of Commissioner Lind, seconded by Comm. Stabler spoke from the floor protesting the addition to an already non - conforming dwelling, and further stated that it would decrease the value of her property. 6. Jones, 1409 Balboa Blvd., spoke from the floor opposing any further development on this site. He stated that the parking problem was acute and no off - street parking had been considered. Commissioner Longmoor stated that since a portion of the church buildings now existing are located on land zoned C -1, the Planning Commission cannot legally force off - street parking. A portion of the proposed new school building will extend into an R -3 zone. The church representatives (applicant) informed the Commission that the proposed school and residence would be in session only on week days. The school would only be for students up through the 8th grade and would not be operating or parking cars at the school. They contemplE.te'.. transporting students to and from the school and will provide off - street parking for any busses • used. 6. On motion of Commissioner Copelin, seconded by Comm. Reed and carried a Resolution of Intention to hold hearings during April and May, 1957 on a proposed amendment to the subdivision ordinance to establish a fee for parks and recreation was adopted. A tentative fee of $x15.00 is included in Resolution of Intention. Representatives of the Parks, Beaches and Recreation Commission were in attendance and this fee for parks and recreation facilities was discussed with them. The representatives of the Parks, Beaches and Recreation Commission recommended that the fee be $p30.00 per lot. Chairman Longmoor advised that the Planning Commission is hesitant to increase the fee from $615.00 to 530.00 until such time as an equitable basis can be estab- lished, or a formula developed on which to base these.fees and 1 be in a firm position to require them of any subdivision. The Commission suggested that the Parks, Beaches and Recreation Commission do some research on this basis, namely, to consider the area bounded by 101 Highway on the South, Irvine Avenue on the !Jest, and the Northern City .boundary on the North, McArthur Boulevard on the East, and make the following determ- inations or estimates in an effort to provide a formula. 1. The land acreage in this area. 2. Projected population potential for completed residential developments. 3. Make an estimate of Parks and Recreation facilities that would be needed to take care of the needs of such a population. Mr. Longmoor further stated that if some reasonable figure on the above can be obtained, it might be possible to determine the parks and recreation fee for residential developments to provide parks and recreation facilities for that area. Hayton and carried, a Resolution of Intention to hold public hearings during April and May 1957 to amend zoning ordinance on swimming pools was adopted. On motion of Commissioner Lind, seconded by Comm. Reed and carried, the time of the regular meetings were changed from 7.30 to 8 :00 P.M. beginning with the month of April 1957.
