ACCEPTED Initiated by: The City of Newport Beach The Environmental Impact Report was reviewed and discussed by the Planning Commission, as well as the policy governing mobile home parks. Public hearing was opened in connection with this matter and the following persons appeared to comment on the EIR: Mrs. Howard Babb questioned whether or not the EIR should include a phasing or timing element, the effect of urbanization of unzoned areas, and a sec- tion dealing with social and economic impacts. Bill Toner felt the EIR should cover the total population and not just the increase from the present population. There being no others desiring to appear and be heard, the public hearing was closed. Following discussion of potential phasing, its mitigating effects, and the fact that this EIR is a preliminary report and subject to revision after all policies have been established and the General X Plan completed in more detail, motion was made tha X X X X before the final acceptance of the General Plan by X the Planning Commission, an Environmental Impact X X Report be prepared covering the impact of the Page 1. Further motion was made that the Environmental Impact Report in conjunction with the Residential Growth Limits Component of the Newport Beach General Plan be adopted. Request to permit the operation of a boat sales facility.in the C -1 -H District. Location: Lots 61, 62 and 63, Tract 1210, located at 1700 West Coast Highway on the northerly side of West Coast Item A2 USE PERMIT 6 8 APPROVED CONDI- Highway across from the Balboa Bay TTUNTCLY Club. Zone: C -1 -H Applicant: Hobie Newport - William Messenger, .Newport.Beach Owner: Tract 1210 Limited Public hearing was opened in connection with this matter and William Messenger, 1700 West Coast Highway, appeared before the Planning_ Commission. He stated that the condition dealing with land- scaping would be a hards.hip at this time and also discussed the matter of deliveries to the site. There being no others desiring to appear and be heard,.the public hearing was closed. That a minimum of six off - street parking spaces shall. be provided on site for the use of employees and customers. Said spaces shall be marked and provided with wheel stops in. accordance with City standards. Access to said spaces shall be maintained during busines hours. 2. That at least 50% of the lot frontage on West Coast Highway shall be landscaped with 5 foot wide planters. Said area shall be landscaped, irrigated and maintained in accordance with a plan submitted to and approved by the Director of Parks; Beaches and Recreation. 4. All trash shall be shielded from view within an area enclosed by a fence or wall not less than six feet in height. 5. This, approval shall be for a two year period from the effective date of this action, and any request for extension shall be acted upon by the Modifications Committee. Commissioner Beckley arrived at 8:30 P.M. Item A3 Request to construct an automatic car wash with USE gasoline service in the C -1 District. PERMIT 1660 Location: Lots 1, 2, and 3, Block AA, Tract 323; located at 3601 East Coast REFERRED Highway on the southeasterly corner TO CTTIr Orchid Avenue and East Coast High - way in Corona del Mar. Zone: C -1 Applicant: Victor E. Shellenberg, Jr.,. Long Beach Owners: Elta Stowers, Florence Luella Warne, Caryl Alice Shelton, Santa Ana Assistant Community Development Director Hewicker advised of a petition received containing 171 signatures in opposition to the request and a letter from the Corona del Mar Chamber of Commerce and a letter from Walter Charles Boyce,.both in favor of the request. The public hearing was opened and Vic Shellenberg, 117 E. 8th Street, Long Beach, applicant, appeared before the Planning Commission. He presented Page 3. Planning Commission discussed the noise aspect of the project and it was suggested that condition No. 4 of the staff report be amended to cover the fact that a certificate of occupancy would be issued only after the 65 dBA level had been tested. and met by the equipment being in operation. Also that the two openings to the building be as small as possible. Raymond Summers, 320 Orchid Avenue, Corona del Mar, appeared before the Planning Commission in opposi- tion to the request. There being no other desiring to appear and be heard, the public hearing was closed. Vic 5hellenberg again appeared before the Planning Commission and answered questions regarding the water reclamation process. Val Morton, resident on Narcissus, Corona del_Mar, appeared before the Planning Commission in opposi- tion to the request. Ron Yeo, 604 Iris, appeared before the Planning Commission and commented on the landscaping in the plot plan as compared to the slides previously shown. Mike Savage, 1331 Centinella, Corona del Mar, appeared in favor of the request. There being no others desiring to appear and be heard, the public hearing was again closed. Seashore Colony DENIED Tract, located at 7008 West Ocean Front, on the north side of West Ocean Front, between Highland and Grant Streets in West Newport. Zone: R -2 Applicant: David H. Johnson, Newport Beach Owner: Same as applicant Public hearing was opened and David H. Johnson, 7008 W. Ocean Front, applicant, appeared before the Planning Commission to answer questions and presented a petition with 9 signatures of persons having no objection to granting the use permit. There being no others desiring to appear and be heard, the public hearing was closed. Following discussion by the Planning Commission which concluded there was insufficient criteria to warrant approval and the fact that the proposal X would constitute a three story building, motion X X X X X was made that Use Permit Application No. 1661 be X denied. S. Post Office. Zones: C -1 -H, C -2 -H Applicant: Frederic M. Doehring, Balboa Island Owner: State of California, Division of Highways . Assistant Community Development Director Hewicker reviewed the request with the Planning..Commission and clarified the.location of the restaurant in question since there was another restaurant being proposed which would not require .a use permit. Community Development Director Hogan advised that the use would be compatible with other uses in the area. Public hearing was opened in connection with this matter. Fred Doehring, 109 Collins, Balboa Island, applicant, appeared before the Planning Commission to answer questions and stated he agreed with the conditions as recommended in the staff report. Ginger Page, 2412 Cliff Drive, appeared to question. the matter of entertainment on.the premises. There being no others desiring to appear and be heard, the public hearing was closed. X Following discussion, Planning Commission approved Use Permit Application No. 1662 subject to the following conditions: 1. APPROVED Location: Portion of Lots 2, 4, and 6, Block C N� DI-- 333, Corona del Mar, located at TIUN%ITLY 2700 Bayside Drive, on the north - easterly corner of Fernleaf Avenue and Bayside Drive in Corona del Mar. Zone: R -2 Applicant: Raymond W. Haas, Frank S. Smith, Corona del Mar Owner: Same as applicant Assistant Community Development Director Hewicker presented an additional letter received for review by the_Planning Commission. Public Hearing was opened in connection with this matter. Ray W. Haas, 1421 Outrigger, Coro.na del Mar, one of the applicants, appeared before the Planning Commission to answer questions regarding this request. Robert N. Troutman, 413 and 417 Fernleaf, appeared before the Commission in opposition to the request and presented pictures for review. Alice Pomeroy, owner of property on Fernleaf, appeared in opposition to the request. Stewart Woodard, 3709 Ocean Boulevard, Corona del Mar,.appeared before the Commission and stated he felt the request violates the intent of the height ordinance. Elizabeth St.Clair, 409 -411 Fernleaf, appeared before the Planning Commission in opposition to the request and presented an illustration of the height of the building compared to other buildings in the area. All work within the public right -of -way be shown on a detailed plot plan which shall be attached to a standard encroachment permit and approved by the Public Works Department prior to the issuance of a buildi.ng permit.. 2. That construction shall be insubstantial compliance.with the approved plans except for minor modifications which maybe approved by the Department of Community Development. Item A7 AMEND - MET N0. 367 Request to amend a portion of Districting.Map No. 13 to establish 16 -foot side yard setbacks on.the east side of Lots 9, 14 and 19 and on the west side of Lots 10 ..and 15 in Beacon Bay. .APPROVED Initiated by: The City of Newport Beach . Also that. consideration be given to reclassifying certain publicly -owned lands such as, but not limited to, the Corona del Mar Elementary School and the Corona del Mar State Beach from the R -1, R -2 and Unclassified Districts to the OS -Open. Space Dist- rict. Initiated by: The City of Newport Beach Community Development Director Hogan commented on the General Plan Policies of the City, the purpose of the public hearing and reviewed the staff report in detail which included alternate proposalE. Additional items of correspondence were distribute to the Planning Commission for review which had been received. Public hearing was opened and the timing instrumen was used allotting three minutes to each speaker. Jerry Hill, 404 Iris, appeared before the Planning Commission and commented on the procedures for posting and mailing of public notices. He present (d a petition with 52 signatures of persons who were presently opposed to the R -1.5 District, is willin to spearhead a homeowners association in order to bring the community together to form rules accept- able to the people in Corona del Mar and commented on the matter of enforcement. Blackie Gadarian, 610 Begonia, appeared before the Planning Commission and stated he felt there were no problems in Corona del Mar and the proposed zone change has done nothing but cause fighting . among neighbors. Elsie Smith, 301 Carnation, commented on the over- building and crowded conditions in the R -3 District. Richard Irwin, 235 Carnation appeared in favor of leaving the zoning as is, but establishing standards to better the community as far as type of construe Page 9. Carl_Quant, property owner at 2501 Ocean Boulevard advised the Planning Commission that it would be unfair to down -zone his particular piece of pro - perty due to the fact that all of the surrounding properties have been built to R -3 standards. Paul Hubbell, 416 Heliotrope, presented photos for review by the Planning Commission indicating the type of structures being built in Corona del Mar and stated that some down - zoning is needed to keep from destroying the character of the community. Leonard Morgan, 415 Heliotrope, appeared in favor of the down - zoning and commented on the illegal "room- kickers" now present and enforcement to remove same. Stewart Woodard, 3709 Ocean Boulevard, stated that R -3 should be maintained in order to provide a • variety.of housing types as stated in the Policy Plan and on large areas of R -3 perhaps an overlay zone . could be established whereby the City could control the type of development and density to some degree. He did not believe R -1.5 was the answer and that the City should work on the.touris problem rather than the elimination of a relativel few residents. He suggested that restricted parki g would help to eliminate some of the tourists. Dick Mower, realtor and builder, commented on esthetics of building. Joe.Ironhill of 602 and 432 Avacado, appeared in opposition to any change in the zone. Val Morton, resident on Narcissus, appeared.in favor of the down - zoning. Alan Blackler, 301 Iris, felt that if R -2 and R -3 zones were changed, the R -1 zone should also be changed because of the permitted floor area ratio allowed. Dick Nichols, 519 Iris, felt that.the R -1.5 zone. • would restrict the type of families and that the character of the area would be changed more by the surrounding commercial area. Brown, 2661 Basswood Street appeared in opposition to the zone change and requested that the people be left alon.e.. Sam Barnes, representing Mr. and Mrs. Ross of 311 Carnation stated there was no evidence that down- zoning produced better homes. Carlene Blackler, 301 Iris, questioned the present zoning in Corona del Mar. Ron Yeo, 604 Iris, stated R -1.5 may reduce density and type of construction but it does not accomplish maintaining the character of the community which consists of landscaping, trees, patios, etc. Mel Hoeffliger, 435 Goldenrod felt there was no need to down -zone at this time. Richard Palaferri, 427 Heliotrope, commented on parking and enforcement and suggested that red curbs be painted on one side of every street in • old Corona del Mar which would force people to use their garages and eliminate the congested streets. John Hoag, 4815 Dorchester, suggested that front setbacks be decreased in order to allow more space between the house and garage. . Stewart Woodard again appeared before the.Cbmmissi n and stated that the City should take the alternative suggestion in the staff report and start all over, with a new proposal for Corona.del Mar. Jerry Hill also appeared again before the Planning Commission and questioned how much time would be available to formulate some concrete recommendations for submittal to the staff. Richard Palaferri appeared and questioned the. policies of garages on zero property lines in. order to obtain more off - street parking.
