Proposed amendments to Section 20.08.190 of the AMENDMENT Newport.Beach Municipal Code pertaining to off- 0 street parking requirements. CONTINUED Zoning Administrator Hewicker stated that the amend- N I1� L ment had been revised as suggested by the Commis- APRIL 15 sion at the last meeting after hearing from various community associations,_chambers ; of commerce and private citizens; Mr. Hewicker reviewed these amend- ments with the Commission in detail. Assistant Community.Development Director Wilson stated that the amendment does not necessarily represent recom- mendations of the staff'but is an effort to' combine the comments and recommendations received. Mr. Frances Horvath of the Newport Harbor -Costa Mesa Board of Realtors was present. There were no addi- tional comments to the findings and suggestions sub - mitted at earlier hearings. Mr. Jeff Millett who owns property on Seashore Drive asked questions re- garding th.e size of garages and their placement with respect to grade and etc. The Commission again discussed the proposed amend- ment at length. Commissioner Martin suggested that consideration should be.gven to Provisions that would require the purchase of on street parking per - its where adequate on -site parking is not:available. Page 1. Assistant - Community Development Director Wilson expressed appreciation to the people who have been helpful in this review process, particularly. Mr. Francis Horvath of the Realty Board, the Balboa Island Improvement Association, and the Irvine Company. Item 2. Request for a 2 year extension of a use permit whit EXTENSIC allows the operation of a beer parlor establishment bF within 200 feet of an "R" District. PEST 379 T8 Location: Lot 1, Block 220, Section A, Tract 814 located at 2000 West Balboa Boulevard, DENIED at the northwest corner of West Balboa Boulevard and 20th Street. Zone: C -1 Applicant: Mary Caruso (The Place), Newport Beach Owners: Wayne B. Ireland and George L. Rager, Newport Beach Zoning Administrator Hewicker explained the applica tion to the Commission. It was noted that this per- mit was originally approved in 1963 without off - street parking. However, it has recently come to the attention of the staff and the Modifications Committee that there is adjoining property under the ownership of George L. Rager which should be used to provide on -site parking for "The Place ". It was explained that Mr. Rager in December of 1969 had applied for and received a Use Permit, No. 1460 for "The Beach Ball" bar at 20066 West Ocean Front. Under the terms of this application, an off -site parking agreement was negotiated with the City to permit parking adjoining "The Place ". It was the opinion of the staff that if Mr. Rager has suffi- cient area to provide off -site parking for the "Beach Ball" which is several blocks away, then on- site parking for "The. Place" should also be provided at the same location. Mr. Hewicker noted that a letter had been received from the applicant, Mary Caruso, indicating that she has made an agreement with the Gulf Service Station at 1920 West Balboa Boulevard for 12 off -site parking spaces, however, Page 2. Mr. Bill Sunderland, Mary Caruso's husband, addressed the Commission and stated that it was his understan - ing the Gulf Station was licensed to rent 12 off- street parking.spaces: It was further stated that the agreement Mr..Rager made with the City for 24 off -site parking spaces adjacent t.o "The Place" would only take care of the parking required for the "Beach Ball ". Mr. Sunderland noted further that Mr. Rager.no longer owns the property and that it had just recently been acquired by a Dr. Ackerma . Mary Caruso, the owner and manager of, "The.Place" addressed the Commission and stated that she has had no problems at her place of business. Mr. George Rager who lives at 108 -.22nd Street addressed the.Commission. It was noted that there are two lots adjacent to "The Place" which have never been paved and which could provide the 32 . spaces required for the joint use of the "Beach Ball" and "The Place ". However, it was noted that these two lots have never been owned by the same person. Mr. Rager stated further that approximatel two weeks ago he entered into an agreement to turn over his option on the property to his current land- lord at the "Beach Ball ". He noted further.that "The Place" which has been a bar for 8 years has never been required to supply off - street parking and that under.the previous owners the adjacent lot was not even paved. He stated that the area has no been black topped and that striping and the installa- tion of wheel stops would be completed by tomorrow. It was also explained that the permitted occupancy of the "Beach Ball" had been reduced from 60 to 49 persons due to Building Department regulations, therefore only 17 pa.rking spaces are required rather than the 20 originally specified. Upon being ques- tioned by Assistant Community Director Wilson as to whether "The Place ", under the terms of their lease, had the right to any of these parking spaces, Mr.. Rager replied that-they did not. Mr.. Rager noted further that the property actually. is owned by Mr. Wayne B. Ireland and that he, • Mr. Rager, had transferred his 25 year lease with the option.to buy at a specified price, to Dr. Ackerman.. Dr. Ackerman asked that Mr. Rages repre- sent him at the Planning Commission meeting. Page 3. Since that time however, the property has had many names and has changed han s many times. It was noted that there have been numerous problems at this location in the past although.the problems in the past.year and a half have not been as bad. Commissioner Martin stated further . that had he been a Planning Commissioner. in 1963 he would not have voted for this Use Permit x as it stands and,.therefore, moved.that the exten- sion of Use Permit No. 918 be denied. x x x x Item 3. x Request to amend a portion of Districting.Map No. AMENDMEN 14 from a C -1 District-to an R -2 District. Location: Lot 6, B1ock.9,.Section 1 4, Balboa Island Tract., located at 510 So. APPROVED Bayfront.on the northwest corner of South Bayfront and Opal Avenue. Zone: C -1 Applicant: Roger Cook, Balboa Island. Owner:. Same as applicant.. Zoning Administrator Hewicker presented the applica tion to the Commission and explained that this reclassification would allow the construction of a proposed duplex under residential code requirements as opposed to commercial regulations. It was.noted that Use Permit No. 1505 had been approved by the Commission on February 4, 1971 permitting the con-. struction of a duplex on this C -1 lot. Mr. Roger Cook, the applicant was present and state he concurred with the recommendations of the staff. Mr. Roland Vallely of 508 S: Bayfront inquired as to whether this zone change would interfere with th business he operates on adjacent property. It.Was explained that it would affect onlythe one lot'in question owned by Mr. Roger Cook. Page 4. Zone: P -C Applicant: Big Canyon Country Club, Newport Beach Owner: The Irvine Company, Newport Beach Zoning Administrator Hewicker explained the applica- tion to the Commission. Mr. Peter Vogel, Marketing Director for Big Canyon Country Club was present at'the meeting and answere questions of.the!Commissi.on. x x After a discussion, the application was approved, subject to the following conditions: 1. The ,permit shall extend for a period of time not to exceed one year from final determination of this application: 2. Development shall be in accordance with submitted plans. 3. One hydrant with a minimum flow of 1000 gallons per,minute shall be installed at a location suitable to the Fire Marshall. Item 5. . COMMISSIONERS CITY OF NEWPORT BEACH v O N v LA &L CALL �� '^ April 1, 1971 MINUTES INDEX Zone: M -1 Applicant: Unger Pacific Inc., Newport Beach Owner: Same as applicant Zoning Administrator Hewicker presented the applica tion to the Commission pointing out that the staff would like to support this application but cannot d so at this time due to several problems, namely; occupancy, the widening of Lafayette Avenue and.in- adequate off - street parking. Mr. Craig Combs, architect for the project, was pre!- ent and,explained the proposal to the Commission.. It was noted that the restaurant would have a maximum occupancy of 250 persons and that come accessory use s were contemplated. It was acknowledged that there are some problems to resolve, especially with regard to parking. The Commission felt the proposed use was a good one but-that present parking standards must be supporte and tandem parking is not workable. Upon being questioned as to whether they would like the Commission to take action on this matter, Mr. Combs stated they would like to have the intended use approved subject to City requirements. The Com- mission indicated that they could not take any defi - ite action at this time and that the applicant should work with the staff on a more definitive request. The Commission did indicate by "straw vote" that they felt this was a good use for the property. Mr. Bill Butts who operates an antique shop on Vill Way and is a member of the Cannery Village Association addressed the Commission. As a property owner in tI,e area for over 10 years he urged the Commission to look at the area and give the property owners some indic - tion of the desired use. With respect to the widen- ing of Lafayette Avenue, it was indicated that this is important to them and if it is to take place, they would like an indication as to time. Mr. Butts sai he would like to improve his property but is hesita t because of the question of whether high rise buildi g's will be.permitted in the area or whether there will be retail businesses. He noted further that he would like to see the Cannery Restaurant develop and hope that the area would not be developed as a manufactur- ing district. Upon being questioned as to the type of.use he considered most desirable, he replied, small retail craftmanship uses. However, he noted that the rear yards in over fifty percent of the cases do not conform to the fifteen foot rear yard.requirements_ specified in the Big Canyon Planned Community Regulations, This situation is created in most cases where the lot lines are drawn to coincide with the top of the slope and, therefore, exclude the common slope areas between the property line and the adjoining street rights -of -way which, in some cases are sub- stantial both in vertical and horizontal. distance. Upon completion of the grading, the Civil Engineer and the Soils Engineer shall certify that the grading has been completed according to the plans and the requirements of the grading ordi- nance. Permanent reproducible copies of the plans on standard size sheets shall be furnished to the Public Works Depart- ment. 5. That.lot lines be located at the top of slopes, unless a specific exception is_ approved. ' 10. That lot drainage facilities and.related private easements be provided to the satisfaction of the Community Development and Public Works Departments. 11. That the Subdivision Ordinance require- ments for local street width of sixty feet of right -of -way and forty feet of paved surface be waived, and street widths of thirty -nine feet of right -of -way with thirty -two feet of paved surface and thirty-. five feet of right -of -way with twenty -eight feet of paved surface be approved, in accordance with the adopted private street standards: 12. That a.landscaping plan for the subdivision shall be submitted and shall . be subject to approval by the Director.of Parks, Beaches and Recreation. Lots A, B. C, D and E shall be landscaped and improved in compliance with said plan; the required landscaping and improvements, including a watering system, shall be in- stalled, or an agreement shall be entered into, and financial security guaranteeing the installation of the landscaping and im- provements shall be posted, prior to the recordation of any portion of the final map. Species and.spacing of street trees, or other lanscaping within or immediately adja- cent to private streets, shall be subject • to approval by the.Director of Parks, Beaches and Recreation. Due to the realignment of Newport Hi115,Drive West,.the final map contains seventy -five residential lots where eighty -four were proposed on the tentative map. Mr. Robert Bein was present at the` meeting and answered questions of the Commission. After a dis- x cussion, approval was recommended to the City Counc 1 subject to completion of the remaining applicable conditions of approval. as established for Tentative Map Tract 6938 and the completion of the 8" x 12" A.C.P. water main in Newport Hills Drive West from the northerly boundary of Tract 7032 to the souther y boundary of Tract 7029 (the portion through future Final Tract No. 6938). Proposed amendments to Sections 20.02.136,20.20.030 AMENDMENT 20.22.030, 20.24.030, 20.26,040, 20.30.040 and NU_.T f- 20.32.040 of the Newport.Beach Municipal Code per- taining to "Drive -in Facilities" APPROVED Zoning Administrator Hewicker explained this pro- posed-amendment to the Commission pointing.out that concern.has been expressed.over traffic and circula tion problems which can occur with certain typ.es of "drive -in facilities" which transact all or part of their business directly with customers within a vehicle. Without adequate space and proper design, such facilities can cause excessive congestion with n off - street parking areas and, at worst; can cause waiting vehicles to back up onto public streets.. Mr. Hewicker noted further that the field of drive - in services has been.expanding rapidly in recent ye rs and can provide valuable convenience to the custome However, such facilities must be designed and located to forestall dangerous or undesirable conse quences. x After a discussion, Amendment No. 282 was recommend d x to the City Council for approval. Item 10. Proposed amendments to Section 20.08.191 of the AMENDMENT Newport Beach Municipal Code pertaining to building !W07-2137— changed to a use requiring a greater number of park- ing spaces. Zoning Administrator Hewicker explained that this proposed amendment would require a use permit for all night clubs, restaurants and other establish- ments which provide live entertainment.and/or.util- ize audio - amplification which can be heard outside of the structure, irrespective of their location. Presently a use permit is required only when such establishments are within two hundred feet of a residential district: • Commissioner Martin voiced strong objection to this proposed amendment stating he felt it would be better to have a definite standard stated in the Municipal Code. Applicants within a distance of two hundred feet from a residential zone would know that the burden of proof and performance is upon them, to show that an establishment offering live entertain- ment will not adversely affect the interests of nearby residents. Applicants also would know that they have the alternative of locating elsewhere in the City where such regulations would not apply. A lengthy discussion ensured during which some of the Commissioners expressed the opinion that this should not be in the planning portion of the ordi - _ nance but rather under the police or licensing section..
