Item #11 An amendment to the Land Use Element to designate GENERAL the "Old Newport Boulevard Area" for a Specific PLAN Area Plan by adding a Specific Area Plan boundary AMENDMENT designation on the Land Use Plan (map). NO. 22 (Initiated by the City of Newport Beach.) RECOM- Staff reviewed the origin of the request and the MENDED proposed boundaries recommended for inclusion in ADOPTION the Specific Area Plan designation. Public hearing was opened in connection with this matter and there being no one desiring to appear and be heard, the public hearing was closed. He was deemed absent and Commis- sioner Heather chaired this matter. Item #15 Request for an Off -Site Parking Agreement in conjunction with the expansion of a retail build - ing located on the corner of Via Lido and Via Oporto (3400 Via Lido), in the Lido Shops area. OFF -SITE PARKING GREEMENT CONT. TO Location: Lot 2, Tract 1235 (Port O'Call - APR. 17 Pasadena), Lot 1, Tract 1235 and a portion of Lot 2, Tract 1117 (Lido Village Parking Structure). Zone: C -1 -11 Applicant: Warmington Development, Inc. Owner: Warmington Development, Inc. (Retail Building) Don Koll Company, Inc. (Parking Structure) Staff reviewed their recommendation not to allow further expansion of nonconforming uses which rely on the parking structure until such time as the uses which have been approved are in full operation. Staff distributed excerpts regarding parking on previously approved use permits which require spaces in the parking structure and reviewed the entire parking situation in the Page 8. Tim Strader, representing Don Koll Company, appeared before the Commission and voiced concern over the fact that recommendations were being made which control the Koll development on a request in which they were not the applicant. He commented on the parking situation and their desire to help others where possible but not at the expense of their own development. He requested that the matter be continued in order that they could further analyze the staff report as the Koll Company is considering other uses which will require additional parking and they do not wish to jeopardize their rights by any action which maybe taken on this request. The applicant was not present for comment at this time. Motion X Motion was made to continue this matter to the s X X X X meeting of April 17, 1975. s X Absent X Later in the evening staff advised that the applicant and his client were present in connec- tion with the above matter and wished to be heard. Planning Commission discussed the request to be heard and although the matter had been continued, Motion X motion was made to grant the applicant the Ayes X X X courtesy of making a five.minute presentation Noes X with the understanding that the previous action Absent X remained in effect as other interested persons were no longer present. Mr. Warmington appeared before the Commission to comment on the request and the availability of parking in the structure. He also commented on the proposed remodeling and an agreement between the Lido Shops and the Koll Company to provide parking in the structure which replaced the parking lost due to construction of the parking structure. ' Mr. Johns; owner of the Port O'Call - Pasadena, appeared before the Commission and commented on the proposed alteration which would add to the aesthetics of the building and provide the security needed for the shop. Commissioner Hazewinkel returned to the dais. Page 9. (Discussion) _10F UN CONSTRUC- P1a.nning Commission discussed the staff report TION and the fact that the City must be in the process of studying a contemplated zoning proposal before NOT a moratorium on construction can be justified. RECOM- EFf N EE D Discussion was opened to the public. Alice Morgridge, 1 Bay Island, appeared before the Commission in favor of the moratorium. Jean Watt, 4 Harbor Island, appeared before the Commission in favor of the moratorium. She distributed a report relative to reasons for the moratorium and commented on a hearing held by the Water Resources Board. Planning Commission discussed the possibility of placing a moratorium on construction based on studies being made by other agencies such as the Regional Water Quality Control Board. They also discussed pollution and public health as a basis for the moratorium. Bill Vosburg, Vice President of Quincy -Cass Assoc. and resident in the Bluffs, appeared before the Commission in.favor of the moratorium. Alice Morgridge, 1 Bay Island, appeared before the Commission to comment on the pollution in the bay and reviewed a petition on a previous request for a moratorium on construction due to pollution. Sue Hitchman, 43 Beacon Bay, appeared before the Commission in favor of the moratorium and pre- sented a copy of her statement for the record. Bob Millard, 116 Crystal Avenue, Balboa Island, appeared before the Commission to comment on drainage into the bay and the need for a program to prevent further pollution. Motion was made that the Planning Commission recommend to the City Council that the proposed moratorium not be imposed, with the understanding that this recommendation does not imply lack of concern for the water quality problem and that the Planning Commission strongly supports, and will be closely monitoring, those actions which are being Page 10. The Planning Commission also recommends that the City Council give strong, consideration to the budgeting of funds for the purpose of taking an active part to clean up the bay. Discussion of the motion included the possibility of obtaining matching funds for the reconstruction of the Upper Bay; the active part now being taken by the City regarding cleanup of the.bay; the need for add.itional studies on the water, quality of the bay to determine the nature of the pollutants and their origin; and the alternate of retaining the option of imposing a moratorium should it be deemed necessary. Ayes X X X X Following discussion,.the motion was voted on and Noes X X X carried. • Item #17 Request of Pete Siracusa for a proposed restau- APPROVAL rant on the southerly side of the Pacific Coast IN Highway west of American Marine, on.Mariner'.s. CONCEPT Mile. Staff reviewed the request with the .Commission advising that the proposal was an allowable use with sufficient parking under the present zoning code. However, since the area was being consider- ed for a Specific Area Plan and the parking standards were being considered for revision, it was requested that Planning Commission review the project. Pete Siracusa, owner of the Ancient Mariner and Rusty. Pelican, appeared before the Commission in connection with this request. He presented a rendering and plot plans for review which included view corridors, walkways and public access; construction of bulkheads and permits for same; square footage of the restaurant and allocation for public use, storage, kitchen, office,lockers, etc.; and number of employees required to operate the restaurant. • Planning Commission discussed employee parking, zoning requirements as they presently exist, City policy regarding issuance of permits and approval in.concept. Item #18 Recommendation to City Council regarding the COMMUNITY establishment and composition of a Community Development Citizen's Advisory Committee. D€ 07- CITIZENS Discussion ADVISORY Planning Commission discussed the matter of voting COMMITTEE rights by liaison members of the City Council and Planning Commission at the committee level and its.effect on voting rights at the public hearing level. They also discussed the benefits of allow- ing equal rights to all members of the committee thereby creating more interest and active partici- pation. Val Murley, Citizens Environmental Committee, appeared before the Commission to comment on their Committee's experience in connection with voting rights and recommended that all members be allowed to vote in order to create interest and encourage active participation. Planning Commission discussed the basis for creating the committee, funding, objectives and responsibilities. X Following discussion, motion was made recommending to the City Council the adoption of a resolution to establish the Community Development Citizens Advisory Committee as outlined in the draft resolution with the following additions: 1. That the Community Development Citizens Advisory Committee shall only study and recommend action on activities relating to and connected with the Community Development Act of 1974. 2. That a member of the Parks, Beaches and Recreation Commission be appointed to the Committee as a liaison member. Page 12.
