Assistant Community Development Director Hewicker
presented an additional item of correspondence
received in opposition to the request.
Planning Commission discussed the off - street park-
ing requirement and the loss of said parking
through the construction of a public street.
Assistant City Attorney Baade gave the opinion
that since the use permit required maintenance of
a certain number of parking spaces and did not
stipulate the particular location of the parking
lot, that regardless of who usurped the parking
lot at a later date, the conditions of the use
permit would still have to be met by providing
parking at an alternate location.
Planning Commission also discussed occupancy load
and intensification of the use.
Public hearing was opened and Ed Emerick, applican
appeared before the Planning Commission to answer
,

ing for a minimum of 10 off - street parking spaces.
The condition was discussed but failed to pass as
a majority of the Commissioners felt it would be
unfair to require parking for only one business
when other businesses were also affected by the
elimination of the parking when the street was
constructed.
