The Circulation Element issues as outlined in th staff report were reviewed and discussed by the Planning Commission. He recommended that 1 action be taken on the items already included it the Master Plan of Streets and Highways until ti projected traffic information was available upol completion of the traffic model. Mr. Nolan alsl reviewed the history, problems and projected funding pertaining to each of the items. Public hearing was opened in connection with General Plan Amendment No. 78 -1. Daniel Emory, 2250 Golden.Circle, appeared befoi the Commission to voice concern with phasing of development and traffic and felt that the probli were not being delt with, especially since no schedules have been prepared. • Frank Robinson, 1007 Notingham Road, appeare before the Commission to comment on University Drive Extension and the San Joaquin Hills Corrii and felt that highway funding should be secured simultaneously with development. Bob Hill, 2300 Mesa Drive, appeared before the Commission and voiced concern with the possible reduction in the allowable use of his property located in the Emkay Planned Community. Russ Greengard, 2814 Lighthouse Lane, appeared before the Commission on behalf of Broadmoor Hi Community Association to comment on the inter- sections of San Joaquin with San Miguel and Mac Arthur and felt that the alternatives shoul be given careful consideration before being dismissed because of the importance of the intersections to the area. Jim Gill, applicant, appeared before the Commiss to review the proposed development and presented a petition in favor of the request. He answered questions of the Commission and concurred with t recommendation of the staff. Bunty Justin, 206 Emerald Avenue, appeared befor the Commission in opposition to the request beca of the increased size and density and felt appro of the request would set a precedent for other fractional lots on Balboa Island. Commissioner Hummel felt that the density on Balboa Island was excessive, that the requested square footage was excessive, and that structure should not be permitted to front on alleys alone Motion X therefore, motion was made that Planning Commiss deny Variance No. 1067. Commissioner Balalis felt that the increase in requested square footage was not significant and that each case should be judged on its own merit therefore, he opposed the motion. That the granting of the application is nec sary for the preservation and enjoyment of substantial property rights of the applican in that the permitted floor area on the sit would preclude the construction of an adequ sized single family dwelling and the requir two garage spaces. That the required 5 foot yard setback along both alleys abutting the site shall remain unobstructed of all fences, walls, or land- scape planters that will interfere with vehicular circulation in said alleys or wit vehicular maneuverability into existing garages on adjacent residential properties. 4. That the property owner of the subject pro- perty shall execute and record a covenant a agreement to hold the property in question a single building site. Said covenant and agreement shall be approved by the City Attorney as to form and the Director of Community Development as to content. Commissioner Hummel felt that approval would set a precedent and therefore opposed the motion. Commissioner Balalis reiterated that each case should be reviewed and considered on its own merits. Sight distance shall be provided for a speed of 55 MPH. In addition, adequate sight distance shall be provided for bicycles on the bike trail on the easterly side of Jamboree Road. • 26. That all vehicular access rights to Jamboree Road be released and relinquished to the City except for two private street openings at locations approved by the Public Works Department. 27. That sound attenuation structures be provided along the easterly side of Jamboree Road in accordance with the recommendations of a qualified acoustical engineer. Furthermore, the City shall not be held responsible for any future problems with the subject util- ities. 38. That the property owner shall agree to reclassify approximately 4 acres of land for open space purposes as required by the City Council on March 14, 1977, and as clarified by the City Council on March 28, 1977. The specific location of said acreage shall be designated and reviewed by the Planning Commission at the time the Final Map is presented for approval. 39. In addition to the acreage noted above the applicant shall dedicate to the City a minimum of 3.616 acres to be used for the purposes of providing park and recreational facilities reasonably related to serving the needs of the subdivision. David Neish of Urban Assist appeared before the Commission on behalf of the Irvine Company and concurred with the staff report and recommenda- tions. He briefly commented on the proposed parking, and presented background information with respect to the requirements of the Coastal Commission as well as the City. Mr. Neish requested that with respect to the drive -up teller units, that "a credit of the same number of parking spaces as the stacking spaces requir( be given. • Community Development Director Hogan advised thi this request had not been examined by staff and therefore was not prepared to make a recommenda• tion at this time. He also commented on the problems encountered with drive -up teller windo% and lack of evidence that stacking lanes elimin+ parking needs. Commissioner Balalis commented on the parking problems which exist in other blocks within the Newport Center area and felt that a reduction i parking for Corporate Plaza may be premature at this time and suggested that no changes be.made until some of the development was completed and the parking reviewed to see whether a reduction was actually warranted. Dave Neish appeared before the Commission in response and advised of their desire not to hav any more parking than was necessary and to refine their present design standards for Corporate Plaza. He further commented on the parking problems in other blocks and felt that the problem was one of distribution rather than lack of spaces.
