Peninsula, generally lying easterly of McFadden
Place and 21st Street, from the C -1, C -1 -Z, R -2,
CONT. TO
R -3, and R -4 Districts to the R -1 District or the

R -2, R -3, and R -4 Districts, which may be amended,
or to such other districts as may be established
to permit two - family development and to reclassify
certain publicly -owned lands such as, but not
limited to, Marina Park and the oceanfront beaches
from the Unclassified, R -4, and R -1 Districts to
the OS Open Space District.
Initiated by: The City of Newport Beach
Community Development Director Hogan reviewed the
staff report with the Planning Commission which
contained three alternative ordinances. and the
effect of each alternative. Mr. Hogan further
stated that the proposed zoning district is called
Residential- Balboa Peninsula District and would
affect those C -1 properties which are proposed

to be reclassified to residential in addition to
the properties that are presently classified R -2,
R -3, and R -4.
Commissioner Rosener stated that the original in-
tent of the R -B.P. (alternative) was 2,000 sq. ft.
for each unit over two rather than 2,000 sq. ft.
per unit.
Discussion followed on buildable area, parking,
floor area limit, and open space.
Chairman Glass opened the public hearing.
The following appeared before the Planning
Commission:
E. L. Hoyt, 1718 Ocean Front, expressed desire to
have time to study staff report, stated that mini-
mum buildable area rather than maximum should be
established, and spoke in opposition to the change
•
of zone.
George Seeley stated that the Balboa Peninsula
area is a most desirable place to live; that he is
in favor of reducing population; and that he would
like to see architectural controls preventing
structural monstrosities.
Harry N. Kamph, 1320 East Ocean Front, Balboa,
seconded Mr. Seeley's statement and concurred with
staff's attempt to reduce density.
Commissioner Beckley arrived.
Betty Brose stated that Building Division could
control illegal units and spoke in opposition to
rezoning.
Mrs. Howard A. Mansur, 308 Fernando, Balboa, spoke
in opposition to rezoning which would penalize her
as a property owner and she further stated she
lived right next to a 50 foot high building.

Marshall Rhone, owner of property at 104 -15th
Street, lots 12 and 13, on which is built an 8
unit apartment building with more than 8 parking
places in a C -1 zone, expressed concern of re-
placing his structure in case of..loss; ques-
tioned the Commission as to what could be built

in case of loss under proposed rezoning; spoke
in opposition to down - zoning; and stated that
leaving residential property next to commercial
property and then reducing number of units to be
built is an economic injustice to the property
owner.
Goldie Joseph, 515 Via Lido Soud, spoke in opposi-
tion to down - zoning and up- zoning; stated that
General Plan gives no thought to economic effects
or people's rights and courts have ruled that it
is illegal to use zoning to slow or stop residen-
tial growth; and criticized time spent on General
Plan; and further stated zoning should remain as
it is.
J. H. Rutledge, 419 East Balboa Boulevard, stated
he is in opposition to down - zoning and split
zoning and would like to retain C -1 zone on his
property and recommended the proposed C- R.zone
for his area..
Tom Hyans, President, Central Newport Beach Commu-
nity Association, stated that the Association
voted for no change in zoning when the alternative
was R -1.5 zoning for the Peninsula area but if
Council passed the down - zoning, the Association
voted that the down- zoning be no less than R -2
zoning. Speaking as an individual, Mr. Hyans
stated he is in favor of down- zoning with these
modified proposals.
William C. Fundenberg, Jr., an attorney residing
at 808 West Balboa Boulevard, Balboa, requested
clarification of the proposals.
Joe Casala, 812 West Ocean Front, Balboa, stated
he had R -3 property on Balboa Boulevard and is
opposed to two parking spaces per unit as it is
too restrictive in conjunction with the height
limitation. Mr. Casala further stated that to
alleviate parking problem, the City should start
restricting visitors when parking reaches satura-
tion point.
Ralph Secketa, 117 -B North 15th Street, Newport
Beach, stated he is in support of Mr. Hyan's point
that there are three new proposals before the

Commission that haven't been publicized as the
former proposals; that there are not sufficient
copies of agenda and reports availbe to read the
proposals; and that an additional public hearing
be set for a later date when information is availa
ble to the public.

Sue Ficker, 110 North 9th Street, Balboa, stated
that she is in favor of decreasing density and
that consideration should be given to the fact
that study showed the area to be hazardous by way
of earthquake fault and not just consideration to
economic factor in density.
Mrs'. Mansur again appeared before the Commission
and questioned the Commission relative to setbacks
on her property.
Don C. Thamer, an attorney residing at 1012 West
Ocean Front, spoke in favor of down - zoning and stated
consideration should first be given to people who
live here rather than people who own property and,
looking for greater return on their property.
Earl Spainard, 124 -5 E. Balboa Boulevard, Balboa,
stated he owned property on Balboa Boulevard and
Bay Avenue and that density problem is caused by
visitors; that visitors should be restricted and
controlled; that he is in opposition to down-
zoning; and property owners' investment should be
protected.
Mr. Hoyt again appeared before the Commission and
questioned the Commission relative to Height
Ordinance, subterranean garages, and open space
for visual access; he then requested that in order
to study these proposals that another public
hearing be held.
James Ensign, 224 North 20th Street, Newport Beach
spoke in opposition to down - zoning and stated that
the City should not impose a financial loss on
property owners.
The public hearing was closed.
Commissioner Rosener stated that he felt the pro-
posals should be passed over to Council.
Chairman Glass, Commissioners Heather and Hazewink

stated they felt there should be another public
hearing and time to study proposals.
Commissioner Beckley stated that due to his late

arrival he would be forced to abstain.

alternatives would be available Monday, April 16,
1973, at the telephone desk in the City Hall lobby
and at the Community Development Department offices
for those interested.

meetings with homeowners and property owners of
the area.

Discussion followed on development of property, im-
provement of streets, control of traffic, trans-
portation corridor locations and density.
In response to the Planning Commission, Advance.
Planning Administrator Gunn stated that the speci-
fic recommendation that the Commission adopted in
the Residential Growth Element was two family
development with appropriate development standards
and this proposal was consistent with those recom-
mendations.
Discussion followed on neighborhood shopping centers,
viability of commercial and residential, land
values, street dedication, access from Coast High-
way, parking limitation and prohibition, alleys,
width of streets, one -way streets, and frontage
roads.
In response to the Planning Commission, Advance
Planning Administrator Gunn stated there were
three alternate right -of -way alignments for Pacific

Coast Highway and reviewed the changes to the plan
resulting from these changes.
The public hearing was opened.
Suzanne Rudd, 464 -62nd Street, appeared before the
Commission and stated that the Board of Directors
of Newport Shores unanimously accepted the Specific
Plan for the West Newport commercial strip in its
entirety and recommend adoption. In response to
Chairman Glass, Ms. Rudd answered that any amend-
ments to the plan would have to be presented to
the Board.
Richard Meyer, 50th Street, West Newport, appeared
before the Planning Commission and stated that R -2
properties in the area are difficult to rent and
would prefer more commercial.
Discussion followed on renting problems and vacancy
rate.

Stephen C. Auld, 472 N. 62nd St., Newport Beach,
addressed the Planning Commission relative to the
parking problem on Orange Street and recommended
a short commercial strip on one side of Orange and
inclusion of architectural controls on highway side
of Newport Shores to identify community.
John Shea of Newport Shores addressed the Planning
Commission and stated they had discussed commercial
versus residential with a consultant who said land
values were too high for commercial use and that
they had spent a great deal of time discussing what
constitutes a viable commercial area and that the
plan reflected their conclusions. In addition,
Mr. Shea stated that the additional signaliza,tion
at Prospect Street would make the beach more
accessible to the Newport Shores residents.
Dana H. Smith, Newport Beach, addressed the
Planning Commission and spoke in favor of residen-
tial uses stating he supported the recommendations
presented and recommended approval of plan in its
entirety with the changes discussed by the
Commission.
Discussion followed on required four parking spaces
on ground and subterranean garages.
Margot Skilling, 6610 West Ocean Front, Newport
Beach, appeared before the Planning Commission and
expressed need for some commercial in the area.

Richard Meyer again addressed the Planning Commis-
sion in favor of more commercial..
William Hall, 7 Canal Circle, Newport Shores,
addressed the Planning Commission and stated he
was in agreement with staff's proposal although he
would like parking on Orange on one side to be
allowed and /or a loading zone.
The public hearing was closed.

The Planning Commission moved that Resolution No.
802 be adopted recommending that the City Council
hold public hearings toward the adoption of
Specific Area Plan No. 4, Amendment No. 371,.with
the following modifications:
1. That the "Not A Thru Street" sign on Fern
Street be deleted;
2. That Fern Street not have "No.Parkin.g" posted;

3. That there be a continuous frontage road be-
tween Lugonia and Walnut Streets;

4. That dead end alleys extend one -half b4 aele pas
their dead ends;
5. No parking restrictions in front of residential
frontage;
6. Inasmuch as Fern Street remains a through street
onto the highway that the "No Left Turn" sign
be added;
7. That off Fern Street, Lot No. 7 be residential.

The Planning Commission amended the motion to in-
clude:
That a single parking space on either side of
Orange Street at the Coast Highway be red -
curbed to permit the ability to make right
turns into the property.
Following discussion, amendment was withdrawn.

Committee and P.B. &R. Commission and that the
staff has no input on this plan.
Chairman Glass stated that 18 letters have been
received from residents of Balboa Island in opposi-
tion to the map including Balboa Island for one
or more proposed trails and 9 of the letters men-
tioned the Bay Front sidewalk as being a problem
area and 2 mentioned pedestrians; and, in addition,
1 letter in opposition from Balboa Island Improve-
ment Association contained approximately 63
signatures.

P. B. & R. Director Stewart reviewed the Plan of
Bicycle Routes and stated the plan was developed
by the Bicycle Trails Committee with a member of
the P.B. &R. staff, Police Department, and Public
Works Department in an advisory and technical
assistance capacity. Mr. Stewart further stated
that plan was then approved by P.B. &R. Commission,
forwarded to City Countil who, in turn, forwarded
it to Planning Commission for public hearing.
Discussion follwed on location of trails, fenced
.and open conditions, trespassing signs on oil
field property, width of sidewalks, cantilevered
bridge crossing highway, existing right -of- ways,
developed bicycle trails, deterrent of textured.
concrete strips, painted separate bicycle trails,
congestion of pedestrian /bicycle trails, and
Balboa Island walkways.
At the request of Chairman Glass, Allan Beek,
Chairman of the Bicycle Trails Committee addressed
the Commission on the plan. Mr. Beek stated that
.
the primary purpose of the plan was to make it
possible to apply for matching County, State, and
Federal funds which are only available where you
have designated trails.on master plan and that is
why the map indicates every conceivable trail pos-
sible.to keep options open and large dots indi-
cating trails on map were purposely big so trails
could not be pinpointed. He further stated that
it would take 2 to 3 years of study to locate
trails as funds become available to acquire rights -
of -way where necessary to do construction and that
this plan is preliminary and is not intended to
delineate any specific routes. In addition,
Mr. Beek stated that bicycle trails on Balboa
Island are controversial but would like to see
them included for the matching funds.
Community Development Director Hogan stated that a
text should be developed encompassing the views
expressed by Mr. Beek.
Commissioner Heather stated that she sits on a
County committee for S.B. 365 and County has set
aside $200,000 to be used by cities for matching
funds if they have an adopted bicycle plan and

will probably go back into general fund by June
30th.

Discussion followed on public hearings for each
specific trail, County's proposed master plan of
bicycle trails, recommendations of Bicycle Trails
Committee to County, deadline.dates, and meetings
with Costa Mesa on bicycle trails.
Advance Planning Administrator Gunn stated that the
County Master Plan of Bicycle Trails presently in-
dicates the adopted trail system within the City.

system, they should suggest an amendment to the
County. .
Chairman Glass opened the public hearing.
The following appeared before the Planning
Commission:
Tom Hyans, President of the Newport Beach Home-
owners Association, stated their concern with Ocean
Front walk for pedestrians and bicycles and lack.

addition, he stated there were a number of casual-
ties (not all of record) and the Association would
like the Ocean Front route deleted. In response
to the Commission, Mr. Hyans answered that Central
Newport area is concerned with easement in front
of their homes and against widening of sidewalk.
Ernest L. Scanlon, 1206 South Bay Front, Balboa
Island, spoke in opposition to bike trail on Island
mentioning the width of sidewalks, alleys, and
environmental impact of traffic.
Don C. Thamer, an attorney residing at 1012 West
Ocean Front, questioned the Commission as to the
City's liability by putting bicycles on sidewalks
for pedestrians and consideration of separating
pedestrians, bicycles, and vehicles.
Maryian Scanlon, 1206 South Bay Front, Balboa
Island, spoke in opposition to bike trails on
Island mentioning number of accidents between
bicycles and pedestrians and bicyclists' ignoring
the "No Bicycle" signs posted.
Ralph Secketa, 117 -B North 15th Street, Newport
Beach, stated he supported Mr. Hyan's statements

mentioning the high speed of bicyclists but that h
did not think it wise to delete the possibility of
a bicycle trail on the Ocean Front from the Master

trails would be desirable there and the area is
suited to a wider trail for bicyclists.
Barbara White, 1104 South Bay Front, Balboa Island,
spoke in opposition to bicycles along the Bay
Front.
Colonel Franklin, 324 Grand Canal, Balboa Island,
stated he has been working with the Citizens Ad-
visory Committee of Bicycle Trails since October
and is a Director of the Board of the Balboa Islan
Improvement Association. Col. Franklin further
stated his opposition to a bicycle trail on Balboa
Island.
John W. Werlie, 126 Onyx, Balboa Island, requested
that bicycle trail on Balboa Island be deleted.
Colleen Quiggle, 308 South Bay Front, spoke in
favor of bicycle trails on Balboa Island.
Lorraine Kelson, 207 North Bay Front, Balboa Island,
spoke in opposition to bicycle trails on Balboa
Island and Ocean Front and stated that if money was
available for bike trails, we should get it.
Chairman Glass closed the public hearing.
