Special Session Wednesday, April 14th, 1937, at
7 :30 P.M. in the Council Chamber at the City
Hall. Chairman Parka presiding.
PRESENT: Parks, Palmer, Lind, Whitson, Schnitker,
F. W. Briggs, L. W. Briggs, and Inspector
Nelson.
ABSENT: Patterson, Thompson and Consultant Tilton.
MINUTES:The minutes of the meeting of March 30th were
approved as written.
The regular order of business was suspended
to hear R. G. Burlingame, who had an 8 o'clock
meeting, on the exception of Lot 49 from the
proposed 50% reduction of front yard re-
quirement on all other lots in Tract 742.
Burlingame Why except Lot 49 from this otherwise
general ruling in the Tract? A ten foot set-
back all around this lot would .take one third
of its area out of use. It has been used as
a City Park for the last four years.
Palmer - Why not take this up at such time as improve-
ments or resubdivision is contemplated?
Burlingame - I have no immediate plans for either.
As the lot faces the rear of the surrounding
lots and there are garages all around it, I
have been unable to sell it. Its area is .
15,180 sq. ft. Its area less 10 -ft, setback
all around is 10,380 sq. ft. I would prefer
not to resubdivide this lot and would like to
have the City purchase it as a park which is
badly needed in this area.
It was stated the lA -ft, front yard require-
ment would not be applicable to all three sides
of this triangular lot, as only one side
might be construed as its front.
The regular order of business was resumed.
Le Roy Wolfe, Room 400, Title Ins. Bldg., Los Angeles,
Mu. 6312, displayed plans for a house on Lot
27, Block 11, Sec. 3, which would require
yard variances. He was . advised of the
necessity for a public hearing and given in-
formation concerning the required procedure.
Costelyou - Mr. Beard, Orange County Superintendent
of Highways, forwarded a letter from Mr.
Costelyou of the State Highway Department
suggesting the wisdom of establishing set-
backs along state and major county highways
50' from the center lines thereof to provide
future 100' rights of way without disturbing
buildings or becoming excessively costly.
MOTION: Com. Palmer moved that Mr. Beard be advised
that the Newport Beach City Planning Commis-
sion is willing to recommend such a setback
line be established subject to examination of
specific rights of way as they are presented.
Seconded by Com. Schnitker and carried.
Joint Meeting with Council: The secretary mentioned
Mr. Tilton srest for a joint closed meet-
ing with the City Council for the purpose of
presenting a first draft of the Traffic Survey.,
April 27th, 1937, at 7:30 P.W. in the Council
Chamber was set as the time and place of said
meeting.
W.H.Fawcett Variance Hearing: The Chairman declared
the hearing open and asked if there were
any persons present desiring to be heard, or
any communications on the subject. There
being none, the hearing was declared closed.
• MOTION:Upon motion by Com. Palmer, seconded by Coma
F. W. Briggs and carried, a side yard variance
from three.feet to one and one -half feet was
granted to W. H. Fawcett on the north side of
Lot 17, Block. 11, Section 4.
PUBLIC HEARING on proposed Blanket Reduction by 50%
of front yard requirement on all of Tract 742
except Lot 49 thereof was declared open.
There being no communications on the subject
nor any person present desiring to be heard,
the hearing was closed.
Considerable discussion ensued, Com. Palmer
stating he was under the impression the vari-
ance was to be applied only to the lots facing
the bay. Com. Palmer moved to grant a 50%
variance Of front yard requirements on Lots
14 to 34 inclusive of Tract 742, conditioned
upon an affirmative opinion by the City
Attorney that the land between the front lot
lines of these lots and the new seawall is
• all public property. Motion lost by lack of
a second.
The Chairman expressed a doubt of the propri-
ety of ruling otherwise than strictly according
to the published notice, and thought we should
not apply the variance to more or less lots
than described in the notice.
The commission was uncertain of the possibility
of bay front lot owners acquiring title to
the land between their lots and the seawall.
MOTION:Com. F. W. Briggs moved this matter be laid on
the table pending consultati ®n with the Council
and Attorney, and that individual hearings on
variances in this tract be held as required in
the meantime. Seconded by Com. Schnitker and
carried.
Mr. Rupp, of. Gordon Findlay's office, asked Infor-
mation regarding an open bridge, obtruding
into a side yard, connecting two buildings
on Lot 33 of Tract 742, which was.supplied to
him by Mr. Nelson.
Mr. Pease: Displayed plans for two houses on Lot 25,
iBlock 4. Section 1. He planned to sell part
of the lot containing only 1612 sq. ft, and
the house proposed to be built on it separately.
The plan showed violations of yard requirements
beyond the 50% limit and substandard lot area.
He was advised of the deficiencies and with-
drew the plan.
Whitson: Com. Whitson stated the Council requests the
Commission to readopt the Districting Map in
Sections in order to avoid the expense of
publishing the entire map when passing amend-
ments. The Secretary was instructed to ask
Mr. Tilton if Sectional publication is possible
under the ordlaance and to advise Attorney
Thompson accordingly. Com. Whitson brought
up the proposition of coordinating the Fire
District Ordinance with Business and Industrial
Districts as set up by the Zoning Ordinance.
MOTION: Com. Palmer moved that the Chairman appoint a
Committee to study and report on applying Fire
Districting to C -1, 0-2 and M -1 zones; second-
ed by F. W. Briggs, and carried. COMMITTEE:
The Chairman appointed Whitson, chairman;
Patterson, Thompson, Nelson and Tilton as such
committee.
On motion the Commission adjourned to April
28th, 1937, a 7:30 P. M.
