The regular meeting of the Newport Beach City Planning Commission,
scheduled for Thursday, April 17, 19472 at 7 :50 pm, was not held due
to a lack of quorum, as only Commissioners E'llerbroek, Johnson, '
Longmoor, and Rudd were present, with Commissioners Allen, Baltz,
Copelin, Pleger and White absent. Secretary Ellerbraek, in the
ROLL CALL absence of Chairman Allen, called the meeting, and roll clll, after
which he called a Specila Meeting for Thursday, May 15, 1947, to
take care of the business before the Commission.
After an interval, or at approximately 8:15 pm, (Apri117,1947)Com-
missioner Copelin arrived, and his presence constituted a quorum, so
with Commissioner Longmoor, as Chairman Pro Tempore, a meeting was
held.
MINUPES Commissioner Johnson made themotion, seconded by Commissioner Cope-
lin for the approval of the minutes of the meeting of March 20, 1947,
as read. Motion carried.
COMMUNICATIONS Secretary Ellerbroek read letter from Chairman Allen, as follows:
"Due to increasing duties in my.onw business and other problems be-
yond my control, I find it necessary to present my resignation to the
City Council, effective as of this date. It was only after consider-
able thought in this matter, that I have come to this decision, and
now that I have made up my mind, I feel it best that same become ef-
fective at once. Le me assure you that I have enjoyed working with
all of you curing our association in the past few years and certainly
hope for your continued success as you continue to make plans for our
city:. Thanking you for all your helpfullness and consideration in ,
our past efforts, I remain, Very truly yours, John M. Allen." Com-
missioner Johnson made the motion, second d by Commissioner Rudd that
the.Commission recommend the approval of Mr. Allen's resignation,
with keen regrets, and that the Secretary be instructed to write Mr
Allen the appreciation for his work and cooperation on the Commiss-
ion. Motion carried.
Secretary Ellerbroek also read a letter from Mr. H. H. Harvey re-
questing the views of the Commission for a setback variance of 18
inches for his property on Park Avenue, Balboa Island, for the purpose
of building a 6 foot tile fence. Commissioner Longmoor appointed a
committee of Commissioner Ellerbroek and Building Inspector Nelson
to check the property and requested instructions be given Mr. Harvey
to file a formal application if he desired action.
Secretary Ellerbroek read aletter from Mr. Logan Smith requesting
setback variance at 6510 Ocean Front so as to build a two car garage
as present setback only permits a one car garage. Commissioner Cop -
elin made themotion, seconded by Commissioner Rudd that the Secre-
tary be instructed to inform Mr. Smith that even if 50% (15inches)
were granted that this would not be sufficient to permit a two car
garage, but to make formal application if he so desired. Carried.
PUBLIC HEARINGS Final hearing upon the matter of a proposed amendment to Ordinance '
No. 525, Section 7. C -1 and Section 8 C -2, to "permit Self - Service
Laundries ", said application being made by S. B. M&cP.'Levy, was not
held, due to insufficient votes for action, so Commissioner Copelin
seconded the motion, made by Commissioner Johnson, that the matter
be tabled to the next meeting, as called for May 1, 1947. Carried.
Final hearing upon the matter of the application of L. E. Davis for

rezoning of Lot 4, Block 1@0, River Section from R -S to C -1, was tabled
for the same reason, by motion made by Commissioner Copelin, and second-
ed by Commissioner Ellerbroek. Motion carried. Commissioner Copelin
reported as having checked tbo property and area, and recommended the
approval of the application for rezoning to C -1 for retail business of
citrus fruits.
First hearing upon the application of Al Anderson for permission to in-
stall and maintain a Shooting Gallery at Balboa Fun Zone was also tabled
upon motion made by Commissioner Rudd, and seconded by Commissioner Ell
erbvoek. Motion carried.
First hearing upon the matter.of the application.of C. Co Dunbar and
Clyde Denlinger for rezoning from R -S to 0-1 for the building and main-
taining a Super Service S tation on i of Lot 5, and Lots 4, 6, 6, 7, 8,
90 10, and 11, Block 1, Sea Shore Colony Tract, was also tabled upon
motion of Commissioner Johnson, seconded by Commissioner Copelin, and
carried. Commissioner Longmoor appointed a committee of Commissioners
Copelin and Rudd, and Mr. Nelson to investigate the property for report.
Committee Reportst Commissioner Copelin reported on the E. I. White OLD BUSINESS
property, Lot 20, Block 188, Lake Tract,,, which came up for action by the
Commission of Onctober 17, 1946(at which time the Commission recommended
the denial of Mr. Whitets application for setback variance and further
recommended that Mr. White be instructed to remove the non - conforming
projecting portion of his building), and which was again brought before
the Commission at the meeting on March 20, 1947, for investigation.follow-
' ing the report that Mr. White has not complied with the Commission's in-
structions, when Commissioner Copelin was appointed to investigate the
matter. Commissioner Copelin stated that Mr. White claims that this lot
is a "key, lot" (was so informed by the Building Department), but that the
City Attorney ruled it not a "key lot ". Commissioner Copelin stated
that in his opinion the lot is a "key lot ", so the building should be
permitted to remain. Secretary Ellerbroek stated that at the time the
matter was before the Commission for action (October 179 1946), no men-
tion was made of this lot being a "key lot ", and that he wanted the
building to comply. Commissioner Longmoor agreed, and further stated
that the Commission did deny the application and felt that this action
should stand and "lets take steps to order the building to comply ", and
suggested that the matter be referred to the City Attorney for advise and
interpretation. Commissioner Johnson so moved, and Commissioner Rudd
seconded W motion. Carried, and so ordered.
The matter of the Z. E. Claxton property at 46d Street, a similar situat-
tion, of non - conforming projection,(an enclosed porch), which came up be-
fore the Commission for informal action on October 17, 1946, was also re-
ported on by Commissioner Copelin, who recommended that the said porchbe
ordered removed. Commissioner Johnson made the motion, seconded by Com-
missioner Rudd that this matter be incorporated with the E. 1. White mat-
ter to Lhe City Attorney, and to advise him that the Commission feels that
the Claxton building should be made to comply with the law and to notify .
the proper authorities to take action for such compliance. Motion carried.
Mr. E. E. Beager, 680 CoastHighway, Newport Beach, requested approval forNEW BUSINESS
an auto court at this address. Commissioner Ellerbroek made the motion,
seconded by Commissioner Rudd that this trailer park be approved as sub-
mitted, for Lot F. Tract 919. Motion carried.
Mrs J. F. 4ollins was present and requested information on her property
(legal description not given), and that she,benotified if any applications

be made in her block for setback variances befroe same be granted,
as she anticipates being out of town, and does not want changes
made without notification. Mrs. Collins was instructed to write a
letter to the Commission to this effect, for the record.
Commissioner Copelin made the motion for adjournment, seconded by
Commissioner Ellerbroek, and the motion carried, with adjournment
to the Special Meeting, scheduled for May 1, 1947, at 700 pm.

The Special Meeting called for May 1, 1947, at 7 :50 pm, in the Coun-
cil Chamber, City Hall, Newport Beach, for the City of Newport leach
Planning Commission, was not held, due to the lack of a quorum.
No Commissioners were present.
