HomeMy WebLinkAbout04/17/1952Sao MINUTES OF THE PLANNING COMMISSION MEETING, THURSDAY, APRIL 17th,. 1952 AT ROLL CALL: Commissioners Present: Copelin, Ellerbroek, Longmoor, Pleger, Reed, Rudd, Smith and Wightman. Commissioners Absent: Briggs MINUTES: Upon motion of Commissioner Reed, seconded by,Commissioner Rudd, the minutes of the last regular meeting of March 20th were approved as submitted, motion carried. USE PERMITS: Application of South Coast Company for use of P. E. property between 23rd & 26th Streets for storage etc. Chairman Longmoor asked if anyone wished to speak for or against. No one spoke and there were no representa- tives for the South Coast Company present. Chairman said be had discussed this with City Manager, Engineer, Mr. Henderson, Patterson, & Isbell to see how they felt about it and the only 'objection they had was that no off - street parking was provided. In considering further, the Company agreed to provide off - street parking for thirty (30) cars. Also - suggested that if the Commis- sion wished to grant this Use Permit it be limited to use for one year because of the Negotiating Committee with the P. E. Company end if nothing develops on that property, then it can always be renswee. Question brought up on can- cellation clause and discussion followed on the period of time to grant permit. Commissioner Wightman made a motion that the application be granted on a six months basis with stipulation that they aie to provide on the groundoff- street parking for a minimum of thirty cars. Motion seconded by Copelin and carried by the following roll call vote, to-wit: AYES: Commissionera: Copelin, Ellerbroek, Longmoor, Pleger, Reed, Rudd, Smith, and Wightman. NOES: None ABSENT: Commissioner Briggs. Application of Lido Trailer Park for additional four trailer spaces. No one wanted to speak for or against and there was discussion with representa- tive. Commissioner Copelin made a motion t at the application be granted, seconded by Commissioner Rudd and carried by the following roll call vote, to-wit: AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Pleger, Reed, Rudd, Smith, & Wightman. NOES: None ABSENT: Commissioners Briggs. VARIANCES: Application of Harold Cass for front yard Variance in excess of 35 foot maximum as under 9103.25 a , and rear yard less than 20% of lot depth as under 9104.11(b). Lot 61, Tract 1237, Corona del Mar. Chairman declared the hearing open and asked if anyone wished to speak fne or against. Mr. Cass was present and discussion with Commission on blueprints of house to be erected. Mr. Jones: Didn't think the Variance should be granted. Thinks parties in the Tract should abide by the test of the Tract. Commissioner Copelin made a motion that the bearing be closed, seconded by Commissioner Wightman and.carried. Declared the hearing open and asked if anyone wished to speak for or against. Mr. Batchmmn was present. Have garage for parking. Lot 30' x44' Commissioner Pleger mentioned that it was a non - conforming lot now and didn't think there was room for car. Can hardly consider further encroachment into non - conforming. Commissioner Copelin made a motion that the hearing be closed, seconded by Commissioner Reed and carried. Commissioner Pleger then made a motion that the application be.denied, seconded by Commissioner Reed and carried by the following roll call vote.-to-wit. AYES: Commissioners: Copelin, Ellerbroek, Longmoor,..Pleger, Reed, Raid, Smith, & Wightman. NOES: None ABSENT: Commissioner Briggs. NOES: None ABSENT: Commissioner Briggs. Application of E. C. McCauley for 50% Variance in.frontyard setback and relief from Section 9105.2(b) of Zoning Law on Lot 13, Block 10, Tract 626, (1401 W. Bay Ave, Newport Beach). This Variance would allow a six foot fence in front yard. Chairman declared the hearing open and asked if anyone.wished to speak for or against. - -Mrs. Gold, 1405 W. Bay Ave, 6' wall there, obstructs view & objecting to leaving it there. —Mr. Bissell, builder, explained that they had taken down si 15-16 foot fence and 10-12 foot hedge. ' Chairman asked the purpose of such a high wall. Owners live in Pomona, come down weekends, have a fish pond in yard and it's to )peep the children from runnng through. Commissioner Copelin suggested that they leave the wall where it is, but tear it down to three feet for ten feet back from front. As it stands now, there is a bigh automobile accident possibility there because of the blind corner. 202 Commissioner Smith moved the bearing be closed, seconded by Commissioner Pleger and carried. Commissioner Ellerbrosk then made a motion that the application be denied, seconded by Commissioner Smith and carried by the following roll call vote, to -wits AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Pleger, Reed, Rudd, Smith, & Wightman. NOES: None ABSENT: Commissioner Briggs. Application of James Van Every for Variance from Section 9103.2 of Zoning Law on Lot 1, Sally F Lot 3, Block 237, (301 Larkspur Ave,) Corona del Mar, to build residence ton front portion of property. Chairman declared the hearing open and asked if anyone wished to speak for .or against. - -Mrs. Van Every, Purchased the 450 lot on that corner. Rouse in rear with guest apartment. Wanted to build home in front. Daughter would have guest apartment and rent out upstairs apartment. Contemplated house is 1400 Sq. ft. Two garages in rear. --W. L. Bakkella: Property owner in same block. Owns 60'. At time we bought this property it was their home and had no idea of putting in income property and expressed same sentiments of surrounding property owners. We are all very much against any change of coning in that property. --Tom Paine, Realtors Spoke in favor of the application being granted because it was a 45' lot and on a corner. When the ert:Jinal owner built the units in back, it was with the understanding that a home could be constructed on front portion of lot later on. Under old ordinance it was permissable to put three ' units on a 45' lot. --R. C. Kirk: Owns adjoining 60' and signed the petition objecting to the ap- plication: There were about 28 signature on the petition protesting. The Chairman explained that a few years ago when this property was built upon, the City Attorney banded down a ruling to the Building Department that if there are three lots and the split one, each owner would be allowed thiree units. The Planning Consultants changed that when they wrote up the new ordinance by using building sites as the yardstick instead.of lots. Further discussion back and forth. Commissioner Copelin looked at it and figured it was a hardship case, provided there were no protests, but in view of the numerous protests, it changed the picture. Commissioner Reed: City in the position of telling property owner that they could do something and now they come back and change their minds. Pleger: Feels the same way, definitely hardship,, but at same time have to consider the feelings of the neghborhood. Commissioner Pleger made a motion that the bearing be closed, seconded by Com- missioner Copelin and carried. Commissioner Rudd then made a motion that the application be denied, seconded by Commissioner Smitha and carried by the following rollcall vote, to-wit: AYES: Commissioners; Copelin, Ellarbreek, Longmoor, Pleger, Rudd, Smith., ' & Wightman. NOES: Sommissioner Reed ABSENT: Commissioner Briggs X03. Application of Arthur A. Goertzen for Variance from Section 910.35 of Zoning Law to allow construction-of third unit.on Lot 25, Block 18, Section"B ", .(1811 W. Balboa Blvd.', Newport Beach). Paul Butler was there representing the owner. R -3 zone. Two units on_lot now. Paved area 251 x 201 in rear of lot could provide ear part entering from the alley. Utilities were stubbed in twelve feet for third unit. Third unit didn►t quite meet equate footage requirements as under the new ordiance._ Commissioner Copelin made a motion that the hearing be closed, seconded by Commissioner Wightmah and carried. Commissioner Copelin then made a motion that the application be approved subject to inclusion of third legal garage. Commis- sioner Wightman seconded the motion and carried by the following roll call vote,:to -wit: AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Pleger,,Reed, Rudd, Smith, & Wightman. NOES: None . ABSENT: Commissioner Briggs. Application of Dr. -Ward Rolland for Variance of 50% on rear yard setback for second story garage apartment on Lot 23, Block 21, Section 3, (114 Amethyst Ave, Balboa Island).. Chairman declared the bearing openand asked if anyone wished to speak for or against. - -Rby Watkins, 810 Coast Highway, representing applicant. Stated that this is a garage apartment requiring 600 Sq. Ft. required by ordinance. Needs 2J foot seconds story overhang on sbcond story. Commissioner Reed stated that the Com- mission had granted one on the adjacent lot about a month ago. ' Commissioner Copelin made a motion that the hearing be closed, seconded by Coa- missioner Redd and harried. Commissioner Rudd then made a motion that the application be granted, seconded by Commissioner Wightman and carried by the following roll call vote, to -wit: AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Pleger, Reed, Rudd, Smith,. &' Wightman. NOES: none ABSENT: Commissioner Briggs. Application of Mrs. L. Nichols for Variance from strict application of Section 9105.5(a) of Zoning Law on Lot 4, Block 335, (402 Heliotrope Ave, Corona del Mar. This provides permission to construct house without garage facilitbes. Property falls off abruptly with no alley access. Applicant agreed to accept' R-1 stipulations and that if alley is put in would put in garage. . . Commissioner Reed made a motion that the bearing be closed,. seconded by Commis - sioner Copelin and carried. Commissioner Copelin then made a motion that the application be granted with stipulation that build one building and when get the opportunity will put in a garage. Notion seconded by Commissioner Pleger and carried by. the following roll call vote, to -wit: ' AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Pleger, Reed, Smith, & Wightman. NOES: 'Commissioner Rudd ABSM: Commissioner Briggs 201A SECOND HEARING SETOVER: Arthur 0. Hovey at al to rezone'Lots 1 - 8, Block 329, Corona del Mar, & portion Block "D °, CDM'from R -1 to R -2. Chairman Longmoor ' declared hearing open on final hearing of application and askedif anyone wished to speak for or against. Commissioner Wightman made a motion that the hearing be closed, seconded by Commissioner Pleger and carried. Commissioner Pleger then made the motion that the application for rezoning on above property from R -1 to R-2 be denied, seconded by Commissioner Smith and carried by the following roll call vote, to-wit: AYES: Commissioners.: Copelin, Ellerbroek, Longmoor, Pleger, Reed, Smith. NOES. Commissioner Wightman ABS8KNT: Commissioner Briggs NO VOrEs Commissioner Rudd SECOND HEARINGS Resolution of Intention of Planning Commission to rezone Blocks 329, 429, and 430, CDM from R -1 to R -2. Chairman declared the hearing open and asked if anyone wished to speak for or against.. - -Dr. Odle, 1I$ Bayside Place, owns lot 1, Block 329, Very large piece of property and is in favor of the rezoning to R -2. No other commsnts,. Commissioner Pleger made a motion that the final hearing be closed, seconded by Commissioner Copelin and carried. Commissioner Pleger than made a motion that the Resolution of Intention of the Planning Commission to rezone from R -1 to R -2 Blocks 329, 429 and 430 of Corona , del Mar be granted and seconded by Commissioner Copelin. Motion carried by the following roll call vote, to -wit: AYESs Commissioners: Copelin, Ellerbroek, Longmoor, Pleger, Rudd, Smith, & Wightman. .NOES: None ABSENT: Commissioner Briggs NO VCTEs Commissioner Reed. SECOND HEARING (Cont 1d) on application of Nelson Stafford et a1 to rezone from R-1 to R =2 Lots 1 to 12 inc., of Block 12 in Tract 27. Chairman declared the hearing open and asked if anyone wished to speak. No.protests. No one to speak. Commissioners Wightman made a motion that the hearing be closed, seconded by Com$i.s- sioner Pleger and carried. Commissioner Rudd then made a motion that the application be granted, seconded by Commissioner Wightman. Roll Call vote, to -wits AYES: Commissioners: Pleger, Reed, Rudd, & Wightman NOESs Commissioners: Copelin, Ellerbroek, Longmoor, & Smith ABSENT: Commissioner Briggs Commissioner Smith then made a motion to reconsider the action of the Planning Com- mission. Motion sec nded by Commissioner Reed. This was not a roll call vote, AYES: Commissioners; Copelin, Ellerbroek, Longmoor, Reed, Rudd, Smith, & Wightman. N(ES: Commissioner Pleger ABSENT: Commissioner Briggs. Commissioner Smith made a motion that upon reconsideration of the application, that It be denied, seconded by Commissioner Reed and carried by the following roll call tote, to-wti: 2,0 5 AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Reed, Rudd, and Smith. NOES: Commissioners: Pleger and Wightman. ABSENT: Commissioner Briggs. ' Commissioner Smith made a motion that the Secretary be instructed to direct a letter to W. Nelson Stafford to advise the property owners in Block 12 to put deed restrictions on the property. For each t wo units, or building on one lot, one unit will be built facing on Old County Road. When they obtain deed restrictions on the property, they are to submit to the Commission a new appli- cation. Commissioner Wightman seconded the motion and it carried. SECOND HEARING OF Griffith Company to change the setbacks on the remaining 401 streets from 41 and 101 to -0- setback to coincide with rest of 4401 streets on Lido Isle. Chairman declared the bearing open and asked if anyone wished to speak for or against. --J. H. Groman, Sales Manager with P. A. Palmer, spoke for Company. Spoke regarding the uniformity of setbacks if changed to -0- on the remaining 401 streets. Commissioner Pleger made a motion to'close the hearing, seconded by Commissioner Ellerbroek an! carried. Commissioner Pleger then made a motion that the appli- cationbe.granted, seconded by Commissioner Ellerbroek and carried by the following roll call vote, to -wit: AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Pleger, reed, Rudd, Smith, & Wightman. NOES: None ABSENT: Commissioner Briggs. COMMUNICATIONS: A letter of thanks was voted to be sent to the City Council for having obtained the large map of the City for the Council Chambers.
