Mr. Harry Merrill represented the developer and Mr. Robert Bein,.engineer; also addressed the Commission. The Commission discussed at length the recom- mendations made by the Parks,.Beaches and Recreation Commission at its meeting on April 15, 1969 regarding the status of the recrea- tional green belt area. The Parks,Beaches and Recreation Commission determined that if the subdivider /developer increased the width of the greenbelt by including six lots (Lots 119, 142, 349, 350, 351 and 352) as part of the open area exclusively for public use, they would recommend that this recreational area be accepted for dedication to the City as a public park. This recommendation was made subject to the developer providing certain • minimum improvements including: 1. That the park be developed at the expense of the Bren Company with; Trees and landscaping Automatic sprinkler systems Tiny Tot play apparatus Hard surface play areas A ten foot wide walkway meander- ing through the greenbelt Lighting and public drinking fountains; 2. That, if restroom facilities are provided as part of any private recreational facilities, they be made open to use by the general public; 3. That all landscaping and recrea- tional improvements be subject to the approval of.the P.B.& R. Commission. The Planning Commission recommended that the • entire park, extending from Ford'Road on the north to the southerly boundaries of the subject tract,.should be in either private ownership or public ownership for its entire length. That the types and locations of required street trees be provided to the specifications of the Parks, Beaches and Recreation Director. 3. That the boundary of the final tract map be checked by the County Surveyor before being submitted to the City, for approval. 4. That Section 19.12.030 of the Sub- division Ordinance regarding map scale be waived provided maps drawn accurately to a scale of 1" = 100' • are furnished the Public Works Depart- ment. 5. That all grading be done in accordance with a grading plan and report approved by the Public Works Director and a qualified Soils Engineer. Upon com- pletion of the grading, the Soils Engineer shall certify that the grading has been completed according to the plan and the Grading Ordinance. A reproducible copy of the grading plan on a standard size sheet shall be furnished to the Public Works Depart- ment. 6. That storage capacity rights in San Joaquin Reservoir of one maximum day's water demand be deeded to the City. 7. That public utility easements,be a minimum of 10 ft. wide. 8. That "Street A" be 44 feet in width between curbs, with a 64 foot right - of -way width. 12. That the half width of future MacArthur Boulevard be dedicated and improved from "Street S" southerly to San Joaquin. Hills Road as soon as develop- ment within the tentative map area proceeds southerly of "Street A". • 13. That a separate 5 year agreement be provided guaranteeing the improvement of the half -width of the remainder of Mac Arthur Boulevard adjacent to the tract, and that the offer of dedica- tion of that portion of MacArthur Boulevard (northerly of "Street S ") be rejected. *Future MacArthur Boulevard adja- cent to the tract will be improved to 1/2 of the ultimate 4 lane divided width. The initial im -. provement.will be 32 feet wide between curbs, thus providing,2- 12 foot travel lanes and an 8 foot parking lane. The separate agreement for Mac Arthur Boulevard northerly of "Street S" will provide for deferred improvement of that section inasmuch as it is not .immediately needed for traffic • purposes. There is a possibility that the State may construct a portion of realigned MacArthur Boulevard in conjunction with the construction of the Corona del Mar Freeway. Page 4. Mr. and Mrs. Schiff were present at the meet - ing and explained that the reason they wanted to purchase the property from the City was • because their house covers their entire lot at present and they need the extra property to provide room for an off - street parking space as it is impossible in the summertime Page. 5. Alpaugh who owns property at 1908 Court Avenue objected to the sale of the prop- erty and stated that the construction of the carport would make it impossible for him to remove his cars from his,property. He does not want to tear up his land in order to park his cars and feels the City is taking his two cars out of circulation in order to provide a carport for Mrs. Schiff. Mr. Roy Van Kolken who owns the property. at 1906 Court Avenue stated that he had previousl wanted to purchase part of the alley for his own use, He objects to the carport on the .subject property and feels it should be kept vacant rather than have a carport on it. Mr. William Roode who has an interest in the property at 1910 Court Avenue objected to the • sewer running under the proposed carport and also stated that a carport is an inappropriate use for that location. Mr. James P. DeChaine, Assistant City Manager, explained that originally, prior to the im- provement of the alley, the parcel to be sold to Mrs. Schiff contained 342 square feet. The alley was improved.through an assessment district and in the opinion of staff, there now exists approximately 564 square feet which the City considers surplus property, now that the alley has been improved, and the present configuration will permit sufficient-ingress and egress for City vehicles. Mrs-.-Schiff is the only property owner whose property is con- tiguous to the subject parcel. Inasmuch as they are only leasing the property, he 'feels it would be discriminatory to require the'installation of a sidewalk. Mr. Benjamin B. Nolan,-City Engineer, stated that even assuming that the freeway is con- structed under present plans, it would not affect the frontage of this property and the City is attempting to fill in the gaps where sidewalks do not presently exist.. Block 55 Irvine's Subdivision Zone Unclassified Applicants request approval of the construc- tion of a golf driving range with accompany- ing facilities including,a refreshment stand and.on -sale beer. Mr. Edward Ward and Mr. Robert Bein, engineer, were present at the meeting. There was considerable discussion regarding th serving of food, refreshments and beer, as well as the hours of operation. Drainage and grading facilities shall be provided to the specifications of the Public Works Department in order to minimize silting problems on Jamboree Road and in the downstream drainage course. 2. Completion of all street improvements along the Jamboree Road frontage of subject property shall be guaranteed by the owner of the property, through an agreement providing for construction within five years, unless an extension is approved. These street improvements shall include pavement widening, curb, sidewalk and street lighting; 6. A resubdivision request and parcel map shall be filed for approval by the City: 7. All golf driving range lighting shall be.directed away from adjacent prop- erties and any illumination facilities affecting traffic on Jamboree Road shall be subject to the approval of the City Traffic Engineer., 8. Mr. Lawrence was present at the meeting and stated that the request for dancing could be dropped from his request. Peggy Griffith, who owns the hotel above the restaurant, addressed the Commission regarding the amplification and asked that the extension be approved for only a.one year period. That live entertainment be limited, to three entertainers.. 3. That alcoholic beverages be- permitted only in connection with a bonafide. eating place. AMENDMENT The Commission considered a request from Harry Babbitt, General Manager of the Newport Beach TT — UP -1233 Tennis Club, 2601 Eastbluff Drive-,-that Use Permit No. 1233 be amended to include patron dancing and live entertainment; al'so•that the use permit be extended for—an—indefinite perio after the date of expiration (October 20, 19691. Mr. Babbitt was present and answered questions of the Commission regarding the •operation of the Tennis Club. Mr. Bernard Pegg of 2633 Bamboo Street address d the Commission in opposition to the request • for live entertainment. AMENDMENT The Commission considered a request from Richard R. Flinn, President, The Newporter Inn 1P -1355 that Use Permit No. 1355 be amended to permit proposed additions (5572 sq.ft.) to existing, kitchen and dining room areas. • Mr. Wm. Muir represented the applicant. After a discussion, the Commission approved Motion x the request subject to the requirements for Second x parking being met for the entire development, All Ayes including the proposed addition of 5572 sq.ft. ADDITION PL BUSINESS The Commission reviewed the "Findings.of Fact" in connection with Amendment No. 255 filed by The Irvine Company to amend certain property from a C -1 -H District to an R -1 District, denied by a 4 to 2 vote of the'Planning Commis- sion on April 3, 1969. Commissioner Watson was absent at the meeting on April 3, 1969 and Chairman Curtis, who was present at that meeting, was absent during the discussion on April.17, 1969. The Commissioners present on April 17, 1969 agreed that the following "Findings of Fact" fairly state the conclusions of the Commissio majority: • 1. The subject property remaining as entirely C -1 would best serve the public by providing maximum public access to the public waters of Newport Harbor. 3. Driveway curb cuts necessary for an R -1 development would be excessive and constitute a hazard to travel on such a busy thoroughfare as Bayside Drive. 2. The Planning Director informed the Commission that a letter dated April 11, 1969 has been received from the State Division of Highways indicating that freeway route location studies are beginning for a portion of State Highway Route.57 from Route 1 (Pacific Coast Freeway) to Route 22, (Garden Grove Freeway). This is the last unadopted portion of Route 57, and. extends southerly in the vicinity.of the . Santa Ana River from the interchange where the Santa Ana. and Garden Grove freeways cross. Staff will keep the Commission informed as. studies proceed. On motion of Commissioner Copelin, seconded by Commissioner Watson, and carried, the meeting was adjourned.
