HomeMy WebLinkAbout04/18/1946245 The Newport Beach City Planning Commission held a regglar meeting Thurs- day, April 18, 1946, at 7 :50 p.m., in the Council Chamber, City Ball, ' Newport Beach, with Chairman Allen presiding. Commissioners present: Allen, Baltz, Ellerbroek, Johnson, Longmoor, and ROLL CALL Nelson. Commissioners absent: Isbell, Webb, and White. Commissioner Johnson made the motion, seconded by Commissioner Baltz, MINUTES that the minutes of the meeting of March 21, 1946s be approved as read. Motion carried, and so ordered. Secretary Ellerbroek read a letter from Steve Chorak, San Clemente, re- COt@h?UNICATIONS guesting the views of the Planning Commission relative to change in zoning necessary for the erection of a motion picture building on the northwest corner of Marquarite and Bayside Drive. Commissioner Johnson made the motion, seconded by Commissioner Longmoor, that in view of no formal application being made that the secretary be instructed to inform Mr. Chorak to make proper application, also that he check further on other properties that would not require erzoning. Motion carried and so ordered. The public.hearing upon the matter of the application of A. K. Trieten, PUBLIC HEARINGS held over for final action from the last meeting, for the rezoning of his portions of Lots 5, 4, and 5. Block 2, Seashore Colony Tract, was heard. Chairman Allen announced that since the last meeting that Mr. Trieten had entered a petition, signed by all of the property owners.of Block 2, fan- oring this rezoning, and in view of this the Building Inspector had been instructed to issue a permit to Mr. Trieten for his buildings. Commiss- ioner Johnson, chairman of the committee to inspect the property, report- ed favorably for the change, with the suggestion that all the lots 6 to 6 inclusive, be rezoned to C -1, and then made the motion, seconded by Com- missioner Longmoor, that Lots 5 to 6, Block 2,3eashore Colony, be rezon- ed 1 from R -8. Ayes: Commissioners Allen, Baltz, Ellerbroek, Johnson, Longmoor, and ROLL CALL VOTE Nelson. Noes: None. Motion carried, and so ordered. Public hearing upon the matter of the application of A. S. Redfern, and W. D. Ydrkpateick, for change of setback line to 25 feet from 30 feet from the bulkhead line on Lots 1 and 2, Block 5582 Canal Section, was de- clared and heard. This hearing was set and held March 21, 19461, with no action taken and same tabled to this meeting, pending further investiga- tion by the Committee of Commissioners Johnson, Baltz, and Nelson. Com- missioner Johnson reported that the property and vicinity had been check- ed, and no objections to the change were given, adding that the property "has a very good seawall ". Commissioner Johnson made the motion, second- ed by Commissioner Baltz that the application be approved. Ayes: Commissioners Allen, Baltz, Ellerbroek, Johnson, Longmoor, and ROLL CALL VOTE Nelson. Noes: None. Motion carried, and so ordered. Public hearing upon the matter of the application of J. S. Brown, and E. D. Johes, for setback variance from 8 feet to 4 feet, for Lots 80, and 81, Block 11, Balboa Island, Section, was declared. Present for the hearing were both Mr. Brown and Mr. Jones, who explained the conditions, stating that the present setback is the same as in 19319 and that.only one house in the block is setback the present requirement of 8 feet, and that the granting of this variance would not cut . off any view. They also presented a letter from the property owners of the block agreeing to the variance. After considerable discussion, Chairman Allen stated that he. 246 felt "it would improve the street to have these new homes as proposed." Commissioner Johnson made the motion, seconded by Commissioner Long - moor that the application be approved. ROLL CALL VOTE Ayes; Commissioners Allen, Baltz, Ellerbroak, Johnson, Longmoor, and Nelson. Noes: None. Motion carried, and so ordered. First hearing upon the matter of a petition of the pooperty owners of Block 634, Canal Section, for the rezoning from R-2 to C -1, was de- clared and heard, same having been properly filed and advertised. The petition requested the rezoning on the "contention that the present zoning of Block 684 guarantees no architectural building restrictions and an unsightly condition could develop at the southerly end of the overhead grade crossing, whereas, if Block 654 were rezoned to C -11 buildings then would come under eartain protectiiee architectural re- strictions and it would also complete the general business zone plan of Central Avenue on either side from 32d Street to the southerly end of the overhead crossing." Mr. He He Rogers, one of the petitioners, was present, stating that they were »trying to change the classifica- tions, to bring the specifications and standards up." En- croachment of business into any part of the re'nidential section would trend to increase property values and property taxes. "Fubthot _it would be contrary to the enjoyment of our homes as such." Speaking for the opposition, were John Callahan, and Mrs. Grainagle. Com- missioner Johnson made the motion, seconded by Commissioner Eller - broek, that the hearing be passed to the second and final hearing at the next meeting of the Commission. Motion carried and so ordered. Public hearing upon the matter of the application of F. Me Yale, for a 50% setback variance for Lot 1, Block A, Tract 518, Balboa, was declared and heard. This hearing was in accordance with the action of the Commission at the last meeting of granting the application of He Robert Adams, for Lot 6e in this same block, for a 50% setback.variance Commissioner Nelson made the motion, seconded by Commissioner Johnson that the application be approved. ROLL CALL VOTE Ayes: Commissioners Allen, Baltz, Ellarbroek, Johnson, Longmoor, and Nelson. Noes: None, motion carried, and so ordered. NEW BUSINESS Secretary Ellerbroek read a letter from Art LaShelle, requesting per- mission for a proposed addition to the present patio.of Christians Hut restrauant, 525 Edgewater, Balboa. Also read was a letter from John Harvey, owner of the property, living his approval of the addi- tion. Mr. Long, an employee of Mr. LaShelle, was present to represent the petitioners, explaining the proposed plans. Chairman Allen stated that the business is now operating under a non - conforming permit in an R -3 zone, and that the only way that the Commission could take action would be for Mr. Harvey to make application for rezoning. No action was taken. Chairman Allen brought up foe informal discussion the possibility of the National Research and Manufacturing Company, now located in the old Sturditoys.building, Coast Highway, Corona Del Mar, being moved to Newport, in the E. Me, Smith building, now under construction. The 247 question being one of zoning, as five horsepower motors are required for th®ir business. The commissioners were requested to visit the plant at its present location to view the interesting work being done. Also under new business, was a petition of property owners of Blocks 482 and 552, Canal Section, requesting a rezoning of said blocks from R-2 to R -B. The secretary wa.s. advised to notify the petitioners to file the customary fee for same to be advertised for public hearing. Tentative map of Tract 1011, and accompanying petition of Balboa.Coves, Inc., for annexation to the City of Newport Beach, was presented and con- sidered by the Commission, by reference from the City Council. Jack Mil ler, owner of the tract, and A. R. Bing, of the Harbor Investment Company were present and explained the map and proposed plans. After careful consideration and discussion, Commissioner Longmoor made the motion, sec - onded by Commissioner Nelson, for the recommendation to the City Council of the ap;xoval of the petition and tentative map 10119 as submitted, with the stipulation that sewers be installed to every lot in the propos- ed tract, in accordance with the requirements of the City of Newport Beach Engineering Department. Ayest Commissioners Allen, Beltz, Ellerbroak, Johnson, Longmoor, and ROLL CALL VOTE Nelson. Noes& None. Motion carried, and so ordered.
