MINUTES OF THE PLANNING COMMISSION MEETING FOR THURSDAY, APRIL 19th, 1951
AT 7:30 P. M. IN THE COUNCIL CHAMBER OF THE NEWORT BEACH CTTY HALL
ROLL CALL:Commissioners Present: Briggs, Copelin, Ellerbroek, Pleger, Reed, Rudd, and ,
Smith.
Commissioners Absent: Longmoor and Wightman
MINUTES: Upon motion of Commissioner Rudd, seconded by Commissioner Reed,ihe minutes
of the meeting of March 15th, 1951 were approved as submitted to the Commis-
sion. Motion carried.
PUBLIC Use Permits: Donald D. Harwood representing group of property owners on Bat -
HEARINGS: boa Island was present and wanted to go on record as opposing the withdrawn
application for Use Permit of Odette & Nelson to install bait tanks at 406 Bay
Front, Balboa Island. Petition against such installation had some 60 signatures
on it.
Use Permit #6 application of E. Morris Smith on Lots 2- 4 -6 -8 -& 10,.Block 436,
CDM. Lots to be used as parking area. After discussion, it was decided to amend
the application so as to include Lots 19 Block 436 in this application also, ree+
moving it from the application to rezone Lots 1 and 3. Block 436, from R -2 to
C -1 -H.
Commissioner Briggs moved the hearing be closed, seconded by Commissioner Pleger
and carried.
Commissioner Ellerbroek made: +:a motion that the application for lots 1- 2- 4- 6- 8 -10,.
Block 436, Corona del Mar, for Use Permit be granted, seconded by Commissiore r
Smith and carried by the following roll call vote, to -wit: ,
AYES: Briggs, Copelin, Ellerbroek, Pleger, Reed, Rudd, and Smith
NOES: None
ABSENT: Longmoor and Wightman
Use Permit #7 application of R. Davidson de Owen to conduct ceramic business at
914 Coast Highway, C. M. M. (Lot 3, Block P, Tract 323). Commissioner Pleger had .4,
investigated this application and recommended that application be granted as ap-
plied for.
Commissioner Pleger moved the hearing be closed, seconded by Commissioner Smith
and carried.
Commissioner Pleger made a motion that the application of R. Davidson de Owen to
conduct ceramic business at 914 Coast Highway, Corona del Mar, be granted, seconded
by Commissioner Rudd and carried by the following roll call vote, to -wit:
AYES: Briggs, Copelin, Ellerbroek, Pleger, Reed, Rudd, and Smith
NOES: None
ABSENT: �ongmoor and Wightman .
Variances: Variance application #6 of C. W. Smith on Lot 37, Block A, Tract 673,
(222 Hazel Dr) so that he may be granted an 18" setback. Commissioner Pleger was
chairman of Committee and he said that he would recommend approval. Commissioner '
Ellerbroek made a motion that the hearing be closed, seconded by Commissioner
Smith and carried.
Commissioner Pleger then made a motion that the variance application of C. W. Smith
for an 18" setback for garage area only be granted, seconded by Commissioner smith
and carried by the £ollowin_r, roll call vote, to -wit:

' Variance application #7 of certain property owners on Lots 3- 4- 9- 10- 11- 13- 14- 15 -16g
17 -18, Block 218, Section B, so that they may be granted a three foot setback on
Bay side of property. (Vilelle Place) Commissioner Ruddvas the Chairman of the com-
mittee. He said that he couldn't see how lots 3 and 4 would be effected by the appli-
cation since they face another street and already have a three foot side yard setback
but recommended the granting of the other lots since Lot 12 had been granted the three
foot setback at the February meeting. Commissioner Pleger moved the hearing be closed,
seconded by Commissioner Rudd and carried.
Commissioner Pleger then made a motion that the application of certain property .
owners for lots 9- 10- 11- 13- 144- 15 -16 -17 & 18, Block 218, Section B be granted the
three foot setback on the bay side of their property. Motion seconded by Commissioner
Rudd and carried by the following roll call vote, to -wit:
AYES: Briggs, Copelin, Ellerbroek, Pleger, Reed, Rudd, and Smith
NOES: None
ABSENT: Longmoor and Wightman
Variance application #8 of F. M. Lankersheim for a 100% variance on Lots 1 and 2,
Block 26, East Side Addition (1701 E. Bay Front, Balboa). Commissioner Briggs was
chairman of this committee and submitted his written report which was read to the
Commission. Made recommendation of not granting the variance on grounds that it was
unnecessary. Commissioner Pleger moved hearing be closed, seconded by Commissioner
Rudd and carried.
Commissioner Pleger then made a motion that the application of F. M..Lankersheim for
a 100% variance on Lots 1 and 2. Block 26, E S A be denied, seconded by Commissioner
Smith and "carried by the following roll call vote, to -wit:
AYES: Briggs, Copelin, Ellerbroek, Pleger,.Reed, Rudd, and Smith
NOES: None
ABSENT: Longmoor and Wightman
Variance application #9 of Walter S. McEachern and Paul 0. Cleland for a re- subdivision
and variance on Lots 3- 4 -5-6, Block 34, Re -sub of Corona del Mar (1106 -1112 Ocean Blvd)
Commissioner Pleger gave a brief history of the application, there was some discussion.
Commissioner Ellerbroek moved the hearing be closed, seconded by Commissioner Pleger
and carried.
Commissioner Pleger then made a motion that the application for a resubdivision and
variance be approved, seconded by Commissioner Ellerbroek and carried by the follow-
ing roll call vote, to -wit:
AYES: Briggs_, Copelin, Ellerbroek, Pleger, Reed, RuddS and Smith
NOES: None
ABSENT: Longmoor and Wightman
' Variance application #10 of Beatirce Killefer for variance on 'ot 2, Block 436, Canal
Section (3603 Finley Ave) to be allowed a 36 foot setback instead of the required 401.
Commissioner Copelin stated that he had looked into this application and it was thought
advisable to withdraw this application and consider a new application including all
lots in the block at the next meeting.

Variance application #11 of Elmer J. Larson fora 100% variance on Lot 13, Block 8,
East Newport (721 W. Balboa Blvd) on back alley line. Commissioner Briggs was
chairman of the investigating committee and submitted his written report recom-
mending denial of the application. After considerable discussion, Commissioner
Pleger made a motion to close the hearing, seconded by Commissioner Briggs and
carried.
Commissioner Ellerbroek then made a motion that the application for 100% variance
be denied, however, that a 50% variance on Lot 13, Block 8,. E. Newport for Elmer
J. Larson be granted on side line and rear yard. Motion seconded by Commissioner
Rudd and carried by the following roll call vote:
AYES: Briggs, Copelin, Ellerbnnbk, Pleger, Reed, Rudd, and Smith
NOES: None
ABSENT: .Longmoor and Wightman
Valiance application #12 of Elliott F. Leech for a three foot variance from re-
quired ten foot setback or a setback of seven feet on Lot 8, Block E, Seashore
Colony Tract (6501 Seashore Dr). After discussion with Mr. Leech, Commissioner
Pleger made a motion that the hearing be closed, seconded by Commissioner Briggs
and carried. '
Commissioner Ellerbroek then made a motion that a three foot variance for Mr. Leech
on Lot 8, Block E, Seashore Colony Tract be granted with the stipulation that ten
foot setback be established on alley side of lot. Motion mconded by Commissioner
Pleger and carried by the following roll call vote:
AYES: Briggs, Copelin, Ellerbroek, Pleger, Reed, Rudd, and Smith.
NOES: None
ABSENT: Longmoor, and Wightman.
Variance application #13of Homer A. Gould for Lot 16, Block 3, Newport Bay Tract
(305 E. Bay Ave, Balboa) to conform with requirements of side yard variance. Com-
missioner Briggs was chairman df the committee and submitted his written report
recommending denial of application. Commissioner Pleger made a motion that the
hearing be closed, seconded by Commissioner Smith and carried.
Commissioner Pleger then made a motion that the application of Homer A. Gould for
variance be denied but a recommendation that a permit be issued by the Building
Department to reconstruct on third floor within minimum distance of three foot side
yard. Motion seconded by.Commissioner Smith and carried by the following roll call
vote, to -wit:
AYES: Briggs, Copelin, Ellerbroek, Pleger, Reed, Rudd, and Smith.
NOES: None
ABSENT: Longmoor and Wightman.
Variance application #14 of J. S. Linderman for a 21" rear yard variance to comp
plate proposed imporvement on Lot 7, Block 2, Section II, Balboa Island (109 Dia-
mond). Commissioner Rudd was chairman, explained the application to the Commission
but did not make any recommendation to the Commission. Commissioner Pleger moved
the hearing be closed, seconded by Commissioner Rudd and carried.
Commissioner Pleger then made a motion that application for 21" rear yard variance
on Lot 7, Block 2, Section 2, Balboa Island be approved, seconded by Commissioner
Smith and passed by the following roll call vote, to -wti:

Variance application #15 of Harlan B. Griswold and Robert H. Ingram for a variance on
Sly 49' of Lot 10, Block 5, Section 5, Balboa Island to allow the construction.of a
two car garage. Mr. Ingram was present and discussed the matter with the Commission.
Commissioner Smith moved the hearing be closed, seconded by Commissioner Pleger and
carried.
Commissioner Ellerbroek made a motion that the application for variance on above
. described property be granted, seconded by Commissioner Rudd and carried by the fol-
lowing roll call vote, to -wit:
AYES: Briggs, Copelin, Ellerbroek, Pleger, Reed, Rudd, and Smith.
NOES: None
ABSENT: Longmoor and Wightman
AMENDMENTS:
Application for amendment #1 was discussed and acted upon with Use Permit application
#6 of E. Morris Smith. It was decided that Lot 11 Blk 436, CDM be deleted from the
application for amendment and added to the Use Permit application. Upon motion of
Commissioner Pleger, seconded by Commissioner Reed and carried, the first hearing was
closed. Commissioner Pleger made a motion to set the matter over to the secondehear-
ing, seconded by Commissioner Briggs and carried.
1st hearing on application for amendment #2 of Lido Isle Community Association to
amend Section 9102.2 of Municipal Code of City of Newport Beach so that Sheet #6 of
the districting map Lots 977 to 982 inc., Tract 907 (Lido Isle) be rezoned from R -1
to R -3 and so that certain yard setbacks be changed on Sheets #6 and#7 of the District-
ing map Tract 907. Commissioner Pleger made a motion to close the first hearing,
seconded by Commissioner Smith, and carried. Commissioner Pleger moved to set over
the matter to the second hearing, seconded by Commissioner Rudd and carried.
1st hearing on anplication for amendment #3 of Gladys Sidler to amend Ordinance #635
so that Lot 1, Block 13, Balboa Tract (901 E. Bay Ave) will fall within'a C -1 Dis-
trict instead of present R -3 zone. Commissioner Briggs was chairman . of this and filed
his written report. Ross Greeley and Max Hurwitz were present representing the Sidler
family.
Commissioner Pleger moved the first hearing be closed, seconded by Commissioner Smith
and carried. Commissioner Pleger made a motion that application be set over to the
second hearing, seconded by Commissioner Smith and carried.
1st hearing upon resolution of intention #443 amending ordinance #635 so that in the
area comprised of certain lots in Tract 907 on Lido Isle, more fully described as lots:
96 to 181 inc., 219 to 282 inc., 364 to 415 inc., 537 to 641 inc., 698 to 753 inc.,
and 994 to 1080 inc.,
structures on said lots shall not be erected nearer.to the 24 foot street frontage
than four feet and not nearer to•the 10 foot walk than 10 feet, and that the .setbacks
be indicated on sheets #7 and #8 of the districting map.'
Commissioner Ellerbroek moved the first hearing be closed, seconded by Commissioner
Rudd and carried. Commissioner Ellebroek then made a motion that the resolution be
set over to the second hearing. .motion seconded by Commissi:-,ner Briggs and carried

1st hearing upon resolution of intention #444 initiated by Planning Commission <to.
amend Section 9102,2 of municipal code of City of Newport Beach as follows:
that certain lands south of highway 101 more particularly known as
the Stanley Tract shown on Sheet #4 of the districting map be re-
zoned from R -3 to C -1 -H district.
Open discussion. Mr. Ned Newcomb representing Mo- Bo-Tel and certain other property
owners in the Balboa Coves objecting to the proposed Commercial zoning. Commissioner
Ellerbroek was appointed committee chairman to look into the matter. Commissioner
Pleger moved the first hearing be elosed, seconded by Commissioner Rudd and Carried.
Commissioner Ellerborke moved that it be set over to the second heating. motion
seconded by Commissioner Rudd andearried.
1st hearing upon resolution of intention #445 initiated by Planning Commission to
amend Section No. 9102.2 of Municipal code of City of Newport Beach as follows:
1, That certain lands north of highway #101 shown on Sheet #7
of the districting map be rezoned from a "U" district to a
C -1 -H district.
2. That the area known as Bay shore Camp be rezoned from "U"
District to R -4 district and C-1 -H district.
3. That Tracts 1014 -1102 -1140 and adjacent areas be rezoned
from "U" dsitret to R -1 district.
4. That other areas adjacent to the Beacon .Bay Subdivision,
now zoned "U" district be precisely zoned as shown on Sheet
#24 of the districting map.
Commissioner Pleger moved the 1st hearing be closed, seconded by Commissioner Reed
and carried. Commissioner Rudd made a motion that the hearing be set over to.the
second hearing, motion seconded by Commissionr Reed and carried.

NEW BUSINESS:
Resolution of Intention on Re- subdivision ordinance.
to adopt the resolution of Intention to hold hearings
seconded by Commissioner Pleger and carried..
COMMUNICATIONS:
Commissioner Reed made a motion;
on the re- subdivision ordinance
Secretary Copelin read the letters from Mr. Wise on awnings, Stanley Tract, and
incinerators.
ADJOURNMENT-.
There being no further'business, Commissioner Briggs made a motion to adjournip seconded
by Commissioner Pleger and carried.
