Senior Planner Talarico appeared before the Commission to comment on meetings and correspond ence between the City and the Orange County Tran District with respect to a shuttle bus service. William Hurrell with Wilbur Smith and Associates appeared before the Commission and reviewed the draft report of the Parking Program Feasibility for the Central Newport Beach Parking Study area He brought the Commission up to date on previous events and reviewed their findings and recommend tio.ns contained in the report which included an 800 -space peripheral parking facility with Shutt bus service; alterations to existing public park operations and increased parking rates; a reside tial parking permit program; the construction of 200 additional parking spaces in the study area 400 additional peripheral parking spaces by 1985 the construction of an additional 700 parking spaces in the study area by 1990; and establish- ment of a Central Newport Beach Parking Authorit; for the purpose of planning, financing, implemen ing and operating the parking program. Followin review, Mr. Hurrell answered questions of the Commission which included feasibility and partic patios of a parking facility, method of financin income and operating costs, involvement of priva industry in the development of parking facilitie feasibility /success of the shuttle bus service, residential permit program, and additional traff generation created by the additional parking. Public hearing was opened in connection with thi: matter. Nuri Nazar, resident of Beverly Hills, appeared before the Commission and advised of his interes to purchase the property on the north side of West Coast Highway at Newport Boulevard presentl; owned by Cal Trans and his willingness to cooper: with the City with respect to its development. MINUTES • INCIM Id ;1 le •ing. ►nd i t- 1 f- 1> >e is r Ite • COMMISSIONERS City of Newport Beach MINUTES m4 April 20, 1978 MOLL CALL Margot Skilling, West Newport, appeared before the Commission to comment on the draft report ani voiced concern and opposition to any development at Coast Highway and Newport Boulevard which wou further impact traffic along Coast Highway, voic concern with the size of a structure which would hold 800 cars and its incompatibility with the village atmosphere of Newport Beach., and voiced concern with the number of people which use the beaches in excess of the mandated beach capacity levels. John Shea, 2214 West Oceanfront appeared before the Commission and voiced concern with the impac on parking and circulation created by any promot of increased activities in the area and question the impact of the proposed parking program on th Specific Area Plans which are being developed fo McFadden Square and Cannery Village areas. . Pat Strang, 351 Catalina Drive, appeared before the Commissiona and voiced concern with the propo parking structure because of the impact of addit al traffic, increased pollution, and additional on- street parking in the area when the structure is full. Milbeth Brey, 3355 Via Lido, appeared before the Commission both as a representative of the Centr Newport Parking Committee and as an individual, comment on the study and felt that any action to on the recommendation was a positive step in the direction to a solution and that no action would only assure failure to solving the problems. Sh recommended the establishment of a parking autho in order to implement each of the steps in a progressive manner without over - committing ourselves. Bob Inch, Manager of the Via Lido Village, appea before the Commission and advised of their coope tion with respect to use of the peripheral parki by their tenants and employees which would free some of the parking in the area. Planning Commission pointed out the following issues which they felt should be considered: 1. Greater r?liance on private development in order to reduce the bond liability which could face the city; 2. What direction the focal point of the area would take, i.e. commercial over residentia should the proposed program be implemented; and 3. Use of the beach facilities by people outsi the city. Request to consider an amendment to Title 20 of Newport Beach Municipal Code establishing regula tions for developments located on or adjacent to bluffs, to include building setbacks from the ed of bluffs, and other development standards. Initiated by: The City of Newport Beach Advance Planning Administrator Dmohowski reviewe the proposed ordinance with the Planning Commiss as well as suggested revisions to the wording as result of general input from the public and dis- cussion with the staff and City Attorney pertain ing to the safety aspects and reference to the P.R.D. Commissioner Balalis felt that the ordinance as written was too open and that specific directive or design criteria should be incorporated into t ordinance such as minimum setbacks. Page 6. TO 7UHr-T5-- d ion a h I • he • COMMISSIONERS � 90���0���9 \ \\ City of Newport Beach MINUTES April 20, 1978 POLL CALL Planning Commission discussed the issues of safety and aesthetics in the development of the ordinance They also reviewed some of the properties which brought the problem of bluff development to light. Public hearing was opened in connection with this matter. Dr. Atherton, 195J 16th Street, felt that the ordinance should deal separately with the issue of property already subdivided and that which is still in large undeveloped parcels. Mike Ericson with the Irvine Company felt that some consideration should be given to the defini- tion of a bluff, that the maps should be more definitive as to the area covered, voiced concern with excessive setbacks which could be landscaped, thus creating stability and other problems,. and suggested that a performance standard rather than • strict criteria be established. Mr. Gibbs, owner of a lot on the bluffs felt that the establishment of specific setbacks could be detrimental to single lots because of their size. Gordon Glass, Architect, commented on the need for a specific definition of a bluff should the ordinance be adopted and questioned whether it was the purpose and intent of the ordinance to use the bluff in a safe feasible was or to keep them empty. He commented on the proposed ordinance and its so- called flexibility and felt it was an unnecessary ordinance to impose on the people in the City of Newport Beach. Motion X Following discussion, motion was made to continue All Ayes this matter to the meeting of June 15, 1978, and directed that the staff prepare a definition of a bluff; make recommendations as to either an angle of repose or specific setbacks; that a list be prepared of all the affected properties and any adverse impacts caused by the ordinance; and that alternative.proposals be prepared which would include separating the undeveloped subdivided lots from large undeveloped parcels. A modifica- tion to the Zoning Code is also requested, since the proposed development also includes the remod eling of the existing dwelling unit on the site that has a nonconforming 2 foot side yard setbac (where the Code requires a 3 foot side yard). Commissioner Haidinger opposed the motion becaus he was familiar ri th the property and the area and advised that parking was not a problem. He also felt that the imposition of additional park ing would be a tremendous burden on the applican Planning Commission reopened the public hearing. Talis Margrave appeared before the Commission an challenged their right to deny this request beca of the provisions of the Subdivision Map Act, specifically, Sections 66473.5, 66474, and 66427 City Attorney Coffin commented on the revised Ma Act, the lack of a City ordinance relative to condominium conversions, and concurred with Mr. Margrave's remarks. Planning Commission voiced concern that they wer being presented with a request in which they had no choice of action. April 20, 1978 ROLL CALL Applicant: John Costa, Corona del Mar Owner: E. Morris Smith, Newport Beach Public hearing was opened in connection with thi matter. John Costa, Applicant, appeared before the Commi sion in connection with this matter and request that the take -out window adjacent to the parking lot remain if the request was approved. He also questioned the recommendation for denial because the request seemed fairly simple and reasonable. He advised of their need to expand the kitchen area and provide more ventilation in very cramp quarters. Staff advised that the reason for recommending denial was based on the increase in number of employees without additional parking in an alrea .congested and inadequate parking facility and.th . expansion of any of the facilities in the shop- ping center which would increase the need for parking would create additional adverse impacts on the adjacent residential neighborhood. There being no others desiring to appear and be heard, the public hearing was closed. Commissioner Agee felt that the serving of beer and wine would not be detrimental, however, he concurred with the recommendation for denial of the expansion because of the effects on the Motion X neighborhood. Therefore, motion was made to approve the request for on -sale beer and wine only for a period of 2 years and that any extens be subject to the approval of the Modifications Committee. Commissioner Cokas opposed the motion as he felt that the applicant's direction of success should be viewed in terms of a possible move. Ayes X X The motion was voted on and failed. The proposed development also includes the construc- tion of a second floor office, and the acceptanc of an offsite parking agreement for the required parking spaces. The proposed commercial complex encroaches to within 5' of the rear property lin (where the Code requires a 10' rear yard when abutting an alley). John Butler, 912 West Balboa Boulevard, appeared before the Commission on behalf of the Central Newport Beach Homeowners Association and requested a 30 day delay for the purpose of forming a committee to survey the property owners in the are as to the preferred direction of the land use because of the ambiguity as to the legislative intent for the characterization of the area and the discrepancies between the Land Use Element and the established zoning. Staff pointed out that the General Plan provided for the commercial businesses to remain until they were discontinued or until the residential • zoning was requested.
