THE NEWPORT BEACH CITY PLANNING COMMISSION met
in regular session Wednesday, May 15, 19400 7:30
•P. M. in the Council Chambers, City Hall;
Chairman Hopkins presiding.
Meeting called to order by the Chairman.
ROLL CALL -
Commiss oners present: Hopkins, Se er, Briggs,
istus, Findlay, Patterson, len.
Commissioners absent: Williams, Hodgkinson.
Building Insp. Nelson attended.
MINUTES -
Com. Estus moved that the minutes of the last
regular meeting held April 17th and the adjourned
meeting held May let be approved as written.
Seconded by Com. Patterson.
Motion carried and so ordered.
HEARINGS -
SECOND HEARINGON REZONING LOT 8, Blk 133,
COR NA--DZL MAR.
Chairman Hopkins called for the second hearing
on the rezoning of Lot 8, Blk 133, Corona del Briar
from R -1 to R -2 and declared the hearing open for
discussion. He inquired if anyone present wished
to speak on this matter. No response.
He explained that the rezoning of Lot 8 is being
considered in order to complete the R -2 zoning of
Blk 133, since rezoning of Lots 2, 4 and 6 to R -2
was recommended at the last meeting.
Secretary read 2 communications from M.
Thesnah Smith, owner of Lot 8, in which she request-
ad rezoning to R -2. He then read a letter dust
received in which she stated that she had changed he
mind and wished to keep her lot in the R -1 zone.
It was the opinion of the commission that they
had acted favorably upon the matter of rezoning Lots
20 4 and 6 on the basis of including Lot 8 in the
rezoning so as to include the entire block and
that therefore they must also recommend the re-
zoning of Lot 8.
Com. Patterson moved the adoption of Resolution
No. 170 recommending that Lot 8, Blk 133, Corona
del Mar be rezoned from R -1 to R -2 and that the
same be transmitted to the City Council by the
Secretary as the recommendation of this commission
and a copy filed as part of the minutes of this
meeting..

Secretary read a letter addressed to the City
Council and the Planning Commission signed by
Myrta E. Cook contending that protestants in the
matter of the application of Glee Gray and Mary
Gard Jameson for rezoning of Lots 2, 4 and 6 had
been deprived of their rights before. the Planning
Commission in that their petition of protest was
refused because the signatures were not acknow-
ledged.
Chairman Hopkins stayed that the question of
acknowledgement of the signatures was not raised
at any time. His questions concerning the signers
had been to determine whether or not they were pro-
perty owners in the neighborhood.
The sufficiency of the petition so far as it went
was not questioned.
Secretary stated that the petitions of protest
had beeu'transmitted to the City Council as part of
.the material accompanying the recommendation for
rezoning.
SECOND HEARING ON APPLICATION OF MARGUERITE
MACCULLOCH FOR REZONING
,Chairman called for the second hearing on the
matter of the application of Marguerite MacCulloch
for rezoning of Lot 15, Blk 26, Balboa Eastside
Addition from R -1 to R -2.
Secretary stated that Miss MacCulloch had
verbally requested that her application be with-
drawn.
Com. Estus moved that the application of
Marguerite MacCulloch for rezoning of Lot 15, Blk 26,
Balboa Eastside Addition from R -1 to R -2 be with -
drawn upon request of the applicant.
Seconded by Com. Findlay.
Motion carried and so ordered by the Chairman.
PETITION'S, APPLICATIONS
Application of R. G. ,Blake for husiness license
• to conduct Museum.
Secretary read the application of R. G. Blake,
for a business license to conduct an exhibit of a
collection of relies of the Old West at 617 Heliotr-
ope Ave., Corona del Mar. This application, was re-
ferred to the Commission by the City Council for
recommendation.
After discussion it was the opinion of the
commission that this matter was not within the
•jurisdiction of the planning commission, since there
are no plans for proposed buildings to house the
exhibit involved.
Com. Briggs moved that the application of
R. G. Blake for a license to conduct the business of•
exhibiting relies of the Old Vest be returned to
the City Council calling their attention to the
fact that this is a matter upon which the commission'
has no authority to pass.
Seconded by Com. Estus.
Motion carried and so ordered by the Chairman.
Recuest of E. C. Chaplin for Rezoning
Secretsry read the application of E. C. Chaplin
'for rezoning of Lot 2, Blk 34, Corona del Mar from
R -1 to R -2 referred to the Planning Commission by
the City Council for consideration and recommendatio

was ineompente �i tiat i was not accompanied y the
necessary advertising fee.
Com. Patterson moved that the Secretary be
directed to advise this party that the Planning
• Commission cannot act upon this application without
receiving the necessary advertising fee and that,
since it,would be spot zoning, it is inadvisable
to hold hearings upon this matter unless all the
property owners in the block loin in the application
for rezoning.
Seconded by Com. Estus.
Motion carried and so ordered by the Chairman.
Petition for Rezoning
A petition for rezoning Blk 634, Canal Section
from R -2 to C -1 signed by 7 property owners, re-
presenting 9 lots in the block, referred to the
Planning Commission by the City Council for con-
sideration and recommendation was read by the
Secretary. The application was completed upon
presentation of the $10 advertising fee by Cdr.
Richard Rogers, one of the applicants.
Com. Patterson moved that this matter by sent
to hearing, first hearing to be held May 29, 1940.
Seconded by Com. Estus.
• Motion carried and so ordered by the Chairman.
AMENDMENT TO 0 IN CE # ti B Illboarda
Secretary read a communication from the City,
Council referring the revised amendment to Ordin-
ance 440 prohibiting advertising structures in
R -1, R -2, R -3, C -1 and C -2 districts back to the
Planning Commission for reconsideration and re-
commendation.
Secretary 'read the revised amendment in which
•the size of signs advertising a particular business
is restricted to a surface area of 25 94. ft*.
Mr. Marston of the California Gas and Oil'
Association stated that this restriction would pro-
hibit any new gas station erecting the regulation`
trade mark signs now used by the large companies
all over the country. He suggested that the surface
area be increased from 25 sq. ft. to 42 so- ft.
which would permit the stations to use the regular
trade mark signs.
Mr. Hyer suggested that the Chairman appoint
a committee to meet with the City Attorney and
other interested parties to work out suggested
bhangea before the first hearing on this matter.
He suggested Com. Allen and Patterson to 'serve on
this committee.
Com. Briggs moved that the matter of the
amendment to Ordinance 440 prohibiting advertising
structures in R -1, R -2, R -3, C -1 and 0 -2 districts
be sent to hearing,first hearing to be held May 29,
1940.
• Seconded by Com. Findlay.
Motion carried and so ordered by the Chains.
Com. Estus moved that the Chairman appoint
a committee to meet with:the City Attorney and
interested parties to work on the sign ordinance
and formulate suggested changes before the nest,
meeting.
Seconded by Com. Allen.
Motion carried and so ordered by the Chairman.
COMMITTEE REPORTS -
Report on Joint Meeting of Orange County
Planning Commissions
Secretary reported on the point meeting of the
Planning Commissions of Orange County held April 17.
He stated that all Planning Commissions in the Count
were represented. The main topics of discussion
were:-
Legal aspects of planning and Beach erosion
and its relation to beach planning.
.A conference of the planning commissions from the
beach cities of Huntington Beach, Seal Beach,
Newport Beach and Laguna Beach for beach planning
was discussed and the Orange County Planning Come. -
mission gave its approval to a tentative plan which
the beach cities might agree upon having to do with
beach planning. Com: Seager said that it seems
advisable at this time to proceed with some sort of
a tentative plan to submit to them, although we have
no jurisdiction over unincorporated areas in this
vicinity. If we do not go ahead, the State Planning
Board is going to step in and do our planning for "
us_ There is -to be another joint meeting in Anaheim
in the near future of which this commission will be
notified.
District Map Committee
Com. °Patterson said the committee had no further'
report to make other than that given at last meeEting
He has completed the survey of the Little Island
and 'hopes to complete Balboa Island before next
meeting.
Mr. Hyer asked that the Planning Commission
set for hearing the matter of changing the front
yard setbacks on Channel Island from 10 to 5 ft.
He suggested that the commission also include Balboa
Island in the advertisement so that, if the committee
is ready by that time, the commission can proceed
with establishing setbacks on the entire Island.
Com. Estus moved that the matter of establish-
ing a 5 ft. front yard setback on Channel Island and
Balboa Island be sent to hearing, ,first hearing '
to be held May 29, 1940.
Seconded by Com. Findlay.
Motion carried and so ordered by the Chairman.
