HomeMy WebLinkAbout05/15/1947281 The Newport Beach City Planning Commission held a. regular ROLL CALL meeting, Thursday, May 159 1947 with Secretary Ellerbroek calling the meeting to order, and the roll call. ' Commmissioners present: Baltz, Copelin, Ellerbroek, John- son, Pleger, and Budd. Commissioners absent: Longmoor. (White resigned). Commissioner Baltz made the motion to appoint Comnissioner Johnson temporary chairman, which was seconded by Commiss- ioner Rudd, however Commissioner Johnson declined, and made the motion, seconded by Commissioner Pleger for Commissioner Copelin as temporary chairman.. Motion carried, and so or- dered. Secretary Ellerbroek read two communications from the City Council, for the appointment of Mr. John Daniell, to repl- ace Commissioner John Allen, resigned, and for C. W. Wight - man to replace Commissioner Vauz White, resigned. Commiss- ioner Johnson made the motion seconded by Commissioner Rudd that the appointment of Mr. Daniell be approved. Motion carried, after which Commissioner Daniell was duly sworn in by Chairman Copelin. Commissioner Johnson then made the motion, seconded by Commissioner Pleger for the approval of the appointment of Mr. Wiightman. Motion carried, and Mr. Wightmen was sworn in by Chairman Copelin. (1) The final hearing upon the matter of the application PUBLIC HEARINGS of S. B. MacA'Levy for a proposed amendment to Ordinance 525, Section 7. C -1 and Section 8. C -2 ', to "permit Self - Service Laundries" was heard. Mr. MacA'Levy was present and again appealed for approval, pointing out that Self - Service Laundries are so permitted in New York City, Santa Ana, Laguna, etc., however, the Commissioners upheld the Interpretation of the City Attorney that "Laundries are laundries ", and distinctions as to types of machinery to be used can not be made or set and that such a change in the ordinance would be too far reaching. Also present to approve the change was.Mrs. Bowls (Mr. MacA'Levy's mother, who is interested in the business). Mr. Louis Briggs, re- altor, agreed with the views of the Commissioners and sugg- ested that the application whould have been nade for a special variance for a definite piece of property. Com- missioner Copelin said the Commission was not opposed to Self- Service Laundries of the type suggested, but opposed the proposed change of the ordinance, also adding that there is M -1 property available. Commissioner Ellerbroek and Baltz agreed' Commissioner Daniell agreed, but added that he would approve a special variance. Commissioner Baltz. made the motion, seconded by Commissioner Johnson that the application be denied. Roll call vote. Ayes: Baltz, Copelin, D�iniell, Ellerbroek, Johnson, Pleg- ROLL CALL VOTE er, Rudd, Wightman. Noes: None. Motion carried, and so ordered. '(2) Final hearing upon the application of L. E. Davis, for rezoning of Lot 4, Block 160, River Section, from R -3 to C -1, for the building end maintaining of a retail citrus ,business, was heard. Coumissloner'Copelin, as a committee, reported his approval of the matter, having checked the.pro- pertg; that Lot 4 is the remaining lot in Block 160 not now zoned C -1. Commissioner Johnson made the motion, seconded 282 by Commissioner Pleger for the cation for said rezoning. ROLL CALL VOTE Ayes: Baltz, Copelin, Daniell, Pleger, Rudd, Wig htman. Noes: None. Motion carried. approval of the appli- Ellerbroek, Johnson, (3) Secretary Ellerbroek read the application of Al Anderson for permission to install and maintain a Shooting Gallery at the Balboa Fun Zone. Letters from G. A. Padfield, of the Blue Room, Hazel and Roy Kenne, and a card from Frank J. Knight, all adjacent property owners, were read, with all approving the application and voicing no opposition. Also read, as received, was a letter from Chief of Police Hodgkinson, which ' stated "this department has no objection to the grant - ing of this license." Mr. Anderson was present, and gave his plans for a modern shooting gallery, with the newest safety features and equipment; same to be installed at the Fun Zone, in the middle of the bl- ock. Mr. E. H. Allen of the Balboa Inn, however, spoke loudly in opposition of the granting of such a permit, stating thet Balboa had a shooting gallery f years ago, and "there Wes never a greater nuisance and we don't want it back, this would be a backward step, all over the U. S. shooting galleries have be- en put in M -1 and M -2 Zones." Mr. Louis Briggs stated his friendship for Mr. Anderson, but agreed with Mr. Allen's views, as did Commissioner Johnson. Commissioner Baltz made the motion, seconded by Com- missioner Pleger, that the matter be set to the neat meeting. Carried, and Chairman Copelin appoint- ed a committee of Baltz and Daniell to check on same. (4) First hearing upon the matter of the application of Co C. Dunbar and Clyde Denlinger for rezoning from R -3 to C -1 of * of Lot 3, & Lots 4,5,6,7,8,9,10 &11, Block 1, Seashore Colony Tract, for the purpose of a super service station, Wes heard, same having been duly filed, and advertised. After a check of the pro- perty, Commissioner Johnson made the motion, seconded by Commissioner Pleger that the Secretary notify the applicants that only 105 feet of the property on the Highway, or J of Lot 3, & Lots 4,5, & 6 could be con- sidered for rezoning, & to reapply if they so desir- ed. Motion carried. (5) Public Hearing upon the matter of the applica- tion of Harold Harvey for a 50% setback (side yard) variance for the easterly 25J' and the westerly 21J, of Lot 6 Block 2, Section.4, Balboa Island, was he- ard, and carefully considered after which Commiss ioner Ellerbroek made the motion, seconded by Com- missioner Pleger that the application be granted for the westerly (descrobed as northerly by Commissioner Pleger) 21:' be granted, and the easterly (southerly) 25J' be denied. ROLL CALL VOTE Ayes' Baltz, Copelin, Daniell, Ellerbroek, Pleger, Rudd and Wightmen. Noes: None. Johnson, no vote. Motion carried, and so ordered. 0 283 (6) Public Hearing upon the application:of Ross Wright for a 50% side yard variance (Park Avenue) for Lot 16, Block 3, Section 2, Balboa Island, was heard, but after consider- ation, Commissioner Johnson made the motion, seconded by ' Commissioner Ellerbroek that the matter 'be tabled to the next meeting for further study, and a committee appointed to check on same. Motion carried, and Chairman Copelln named Ellerbroek and Nelson. (7) First hearing upon the application of Mrs. Cecile Con- over for rezoning from R -3 to C -1 of Lot 4, Block 159, and Lot 17, Block 160., Seashore Colony, was declared. Commiss- ioner Baltz made the motion, seconded by Commissioner Dan- iell that the matter be set to the next meeting for final action. Motion carried. (8) First hearing upon the petition of property owners of Lots 13, 14, 150 16, 179 l8_191 20, 211 22, and 2:, inclus- ive of Block 1, East Newport Tract from Het to C -1. Com- missioner Baltz made the motion, seconded by Commissioner Johnson that the matter be set to the next meeting for final action, end that the Commission be .a committee as a whole to check the property. Motion carried. Mr. John Vogel, present, objected to the application, stating that he felt that "we have enough business area already ". (9) First hearing upon the matter of the application of the Newport Harbor Corporation for a conditional building permit to remodel a non - conforming structure on Lot 1, Tr- ' act 1080 (325 Edgewater, Balboa) was declared, same having been duly filed. Secretary Ellerbroek stated that this pro- perty (Christian's Hut) is now owned by Art LaShelle, and being the contractor for the proposed remodeling, requested the Commissioner'a permission to "step out of the group" to present the plans. Mr. Ellerbroek in doing this explained the said plans, stating that they would present no change in the character of Christiana Hut. Building Inspector Nelson interrupted to remark that the plans show "an add- ition, not a remodeling ". Commissioner Johnson stated that his interpretation of the plans would make much more room in both the kitchen and dining room, and doesn't feel that we should permit.1t. If we would permit this, then the canneries`or 447 ' business would be Eble to make any changes they might'wi5h." "Commissioner Copelin stated that he and Commissioner Rudd and Building Inspector Nelson checked the property and stated that "the only way we could grant this would be thro.gfi an amendment for rezoning." that he didn't question the "betterment for the" but "whether the Commiss- ion could grant a permit for an addition to a non-conform- ing building. After much discussion along this.line Com- missioner Pleger mace the motion, seconded by Commissioner Johnson that the Secretary be instructed to get the inter- pretation and definition of the word remodel, with refer- ence to non - conforming buildings, from the City.Attorney. ' Motion carried, after which Commissioner Baltz made the mo- tion seconded by Commissioner Pleger that the application be tabled to the next meeting, Motion carried. (10) Public hearing was declared upon the matter of the application of Wayne Bellinger for 50% front yard setback variance for Lot 1, and southwesterly 15' of Lot 3, Block 234, Corona Del Mar, same having been duly filed, but due 184 to the Commissioner's unfamiliarity with the property, Commissioner Johnson made the motion, seconded by Com- missioner Pleger, ti4at same be tabled to the next meet- ing. Cerried, and Chairman Copelin appointed Commiss- ioner's Baltz.and Pleger as a committee to check. (11) Public hearing upon the application of Reverend , Wo Don Brown, for 5096 setback variance from the south- easterly boundaries of Lots 9, and 10, Block 136, River Section was heard, with Reverend Brown present to ex- plain his plans. Commissioner Daniell made the motion, seconded by Commissioner Baltz that the application be granted. ROLL CALL VOTE Ayes: Baltz, Copelin, Daniell, Ellerbroek, Johnson, Pleger, Rudd and Wightman. Noes: None. Lotion carried. MINUTES Commissioner Baltz made the motion, seconded by Com- missioner Pleger for the approval of the minutes of April 17, 1947, and May 1, 1947. Motion carried. COMMUNICATIONS Secretary Ellerbroek read a letter, signed by Al Anderson, Frank Linnell, and J.B. McNally regarding the establishment of a well defined amusement zone, and suggesting that same be confined to the area be- tween Main St. and Palm Avenue., north of Bay Av- enue and also that area occupied by the Pavilion building. Next read was petition of property owners and merch- ants on the same matter, requesting that the proper - ties facing on Main Street from the Pavilion to the ' Ocean Front, be included in any contemplated zoning for amusement, now or in the future. Louis Briggs requested information as to whether "we have any specified zone for amusement ", John Vogel stated that "don't believe Balboa needs any change ", Mr. MecElroy, one of the petitioners, agreed. Mayor Reed was pre- sent and stated in explanation, that every summer brings new requests for permits for new games, and "it is up to the Council to decide, and this matter was brought up in the hope that a solution might be given, as there is no ordinance on this. The idea of the Council in referring this petition to the Commission being only for a recommend<tion." Mr. Roland vallely wantea to go on record as opposed to the application of the petition, unless his property be included. Mr. Vogel brought up the point that those having non - conforming tenants would have to keep them or lose the zoning to which Copelin, and O.B. Reed agreed. Mr. i:ac Elroy said," that Mr. Allen, present esrlier this even`_ng, is definitely opposed to the petition." Mir. Briggs stated that "we are not discussing a change in zoning, just a re- commend to tl:e council. Balboa is a central business district, with some amusement, probalby always will be." Commissioner Ellerbroek made the motion, secon- ' ded by Commissioner Baltz, that the communication be filed. Secretary Ellerbroek read a letter from R. R. Gearing, representing Pleasure Island Associates, requesting the views of the Commission regarding a permit for a dancing school at Pleasure Island, and also the possi- bility of same for a yacht club.for the Voyagers Yacht Club. Commissioner Johnson stated that it would be very unwise to put a yacht club in this location due to the parking problem, and a dancing school wlnould be in 6A ' R -3 zone; and accordingly made the motion, seconded by Commissioner Baltz that the Commission go on record as opposed to a yacht club at this location, due to the parking problem. Motion carried. Also read and filed were letters from Mr. Kenneth Starege and Dr. C. F. Collins requesting that they be notified of any applications regarding setbacks in their block,. the 1600 block, Balboa .Avenue, Balboa Island.
