JUNUTES OF THE PLANNING COMMISSION MEETING, THURSDAY, MAY 15th, 1952 AT
7:30 P.M. IN THE COUNCIL CHAMBERS OF THE NEWPORT BEACH. CITY HALL
ROLL CALL: Commissioners Present: Briggs, Copelin, E1lerbroek, Longmoor, Reed, & Rudd.
Commissioners Absent: Pleger, Smith, and Wightman.

MINUTES: Upon motion of Commissioner Reed, seconded by Commissioner Rudd, the minutes
of the last regular meeting of April 17th were approved as submitted to the
Commission. Motion carried.
USE PERMITS: Application of Earl C. Israelson for abalone processing plant at'512 31st
St, Newport Beach. (Lot 15, Block 430, Lancaster's Addition) Chairman Longmoor
opened the hearing and asked if anyone wished to speak for or against. Mr. Is-
raelson was going to put up building-there. In M-1 zone. City Engineer stated
sewers were adequate there. Woudl operate nine months out of the year. No
canning to be done -- packaging and freezing only.
The question was raised as to whether it was a prohibited use as under Section
9103.73(a) or a permitted use (subject to Use Permit) as under 9103.72(b).
Mr. Israelson is putting up the building and owns the property but is leasing
the building to party named 'Catlin' already operating Abalone Plant at 427 30th,
Newport. The county health dffieer has asked them to get out of there - -is only
two ear garage.
Commissioner Copelin made a motion that the application be granted subject to ,
inclusion of name of lessee. Motion seconded by Reed. Roll call vtoe followed:
AYES: Commissioners: Copelin and Reed.
NOES: Commissioners: Longmoor and Rudd
NO POrE: Commissioners: - Briggs and Ellerbroek
ABSENT: Commissioners: Pleger, Smith, and Wightmsn
Commissioner Copelin sugosted letter be sent to planning consultants requesting .
decision on this before our next regular meeting and made such a motion. Motion
seconded by Commissioner Rudd.
Commissioner Ellerbroek stated that he would be in favor of holding a special
hearing as soon as an answer gets back since they are anxious to start con-
struction of the building as soon as possible. Copelin agreed to amend his motion
that the planning consultants be contacted for opinion and upon word the Commis-
sion held a special meeting. Rudd agreed to the amendment on his second of the
motion. Motion carried.
Application of M. J. Franklin to construct five units on Lot 500, Tract 907,
(Lido Soud at Genoa). R.-3 zone. Copelin explained that it was a large lot
between two 100' lots owned by the City, and read a letter from Mirams of the
Griffith Company stating that it was agreeable with the Griffith Company for Mr.
Franklin to build five units. Mirams stated that plans would be suDject'to the '
approval of the Lido Isle Community Assoc., when the question was raised that
there were no plans or specifications with the application.
Commissioner Rudd made a motion that the application be granted, seconded by
Commissioner Reed subject to approval of the plans and elevations of the Commission
when prepared. Motion carried on the following roll call vote, to -wit:

NOES: None
NO VOTE: Commissioner Ellerbroek
ABSENT: Commissioners: Pleger, Smith,
Longmoor, Reed, and Rudd.

Application of George C. Perkins for a used car sales lot on Lots 4 and
5, Block III Tract 323; Corona del Mar. (805 Coast Hwy, C)Ma). Chairman
opened the hearing and asked if anyone wished to speak for or against. City
Council had delayed action on license subject to Planning Commission's approval.
0-1 zone. Commissioner Reed was on the investigating committee and stated that
the recommendation was favorable..
Commissioner Rudd made a motion that the application be granted, seconded by
Commissioner Copelin and carried by the following roll call vote, to -wit:
AYES: Commissioners: Briggs, Copelin, Ellerbroek, Longmoor, Reed, and Rudd.
NOES: None
ABSENT: Commissioners: Pleger, Smith, and Wightman.
VARIANCES: Application of Levert I. Trask to install six square foot neon sign on
roof of duplex at 717 Fernleaf Ave, Corona del Mar. (Lot 17, Block 732, CDM).
R -2 zone. Chairman declared the hearing open and asked if anyone wished to
speak for oragainst. Commissioner Reed stated that he understood permit is
not allowable in residential area and that this consisted of four small duplex
units built immediately adjoingin C-1 area but outside of C-1 area where such
signs would be permissable. Sign to say, 'FERNLEAF APTS.1
Mr. Trask was present and said that he knew it was against the ordinance and
therefore made application for variance. The Chair explained that a Variance
is to be granted to an 'applicant only if a technicallity of the ordinance works
a hardship on the applicant.
Chairman asked if he handled transient trade - -Mr. Trask stated that they are
run by day, week, or month and probably will go on a monthly basis in September.
Copelin said that he had talked with Mr. Wise on this specific question and he
had said it was not a permissable tffiing and if it were, everyone in Newport
Beach who had a duplex would have a sign on it.
Commissioner Briggs made a motion that the hearing be closed, seconded by Com-
missioner Reed and carried.
Commissioner Reed then made -a motion that application be denied because type of
sign applied for is not a permitted use in this zone. Motion seconded by Com-
missioner Briggs and carried by the following roll call vote, to-wit:
AYES: Commissioners: Briggs, Copelin, Ellerbroek, Longmoor, Reed, & Rudd.
NCES: None
ABSENT: Commissioners: Pleger, Smith, and Wightman.
Application of Earl B. Wittahin for construction of garage (]asst x 201) on
Lot 18, Block 234, Lake Tract. Approx. 309 34th St. Chairman declared the
hearing open — anyone wish to speak for or against. Owns both lots, home on
one lot and desires to put garage on other lot. No garage on home lot- -two
dwellings on lot. It was made clear that if applicant puts garage on lot, he
is creating one building site and will not be able to put any further buildings
up. Applicant said he understood that completely.

Commissioner Rudd made a motion that the hearing be closed, seconded by Commis-
sioner Ellerbroek and carried. Commissioner Ellerbroek then made a motion that
the application be granted, seconded by Commissioner Copelin and carried by the
following roll call vote, to -witz '

ABSENT: Commissioners: Pleger, Smith, and Wightman.
Application of George M. Holstein for a change in front yarcl setback from
10t to It at 234 Hazel Dr, Corona del Mar.. (Lot 40, Block A. Tract 673) Declared
hearing open and asked if anyone wished to speak for or against. Holstein is
contractor and Hinshaw the property owner -- commission thought Hinshaw should
have made application. Ellerbroek said it was the policy of the Commission to
grant like applications along Hazel Drive.
Commissioner Briggs made a motion that the hearing be closed, seconded by Com-
missioner Reed and carried. Commissioner Briggs then made a motion that the
Variance be recommended to the City Council for approval provided that the appli-
cation is properly signed by the property owner in the meantime. Commissioner
Reed seconded the motion and it was carried by the following roll call vote]
to -wit:
AYES: Commissioners: Briggs, Copelin, Ellerbroak, Longmoor, Reed, and Rudd.
NOES: None
ABSENT: Commissioners:. Pleger, Smith, and Wightman.
AMENDMENTS: Re- referral by City Council of application of Nelson Stafford to rezone '
Lots 1 to 12, Block TP, Tract 27 from RI to R-2.
Chairman Longmoor declared the hearing open and asked if anyone wished to speak
for or against.
- -Mrs. G; T. Brown, 413 Old County Rd: Objecting the change of property from
R -1 to R -2. Woudl devaluate property values. Against duplexes. Was asked if
they'd have any objection if one was built facing Old County Road and one facing.
Santa Ana Ave. If that were done, would not have any objection to two detached
dwellings.
-- Nelson Stafford: Due to the contour and length of the lots, doesn't make
sense that anyone would want to build duplex on Santa Ana and leave back end
bare -- certainly no one is going to build a duplex on Old County Rd. Don't believe
you're protecting the surrounding property owners but hurting them. With R-1
only look at back yards, with R-2 possibility of having houses down there. 'Pre-
sented a letter to Commission with signatures favoring the R-2 along there.
-Mr._ Blackwell, ,401 Santa Ana Ave. Owns lob 12. 243' on South. Lost two oppor-
tunities of selling lower end because it wasn't rezoned. Seems to me that a
group of homes along there would increase value of homes on the other side.
Has 12,000 sq. ft, in lot.
- -Mr. Rudd, 427 Santa Ana Ave. Owns lots 6 and 7. .Built single residene there. ,
House stradles two lota and leaves piece 100' x 160' on Old County Rd either for
building site or back yard. Woudl build facing Old County Rd.
There are no sewers there -- strictly cesspool and septic tank situation.

Mr. Briggs made the suggestion that the property be resubdivided. Blake two
lots out of each single one now and leave the zoning.R -1. However,.several
of the lots in the center would fall short of the required area for a building
site, but it was thought that the Commission could grant variances on these.
The Council could over -ride the Planning Commission on the Variances though,
so this was not thought so safe.
After a great deal more discussion, it was decided that deed restrictions
put on the property by the owners and presented to the City Would be the,
easiest way to handle the matter.
Commissioner Copelin made a motion that the hearing be closed, seconded by
Commissioner Ellerbroek and carried.
Commissioner Briggs then made a motion to recommend the amendment to the
Ordinance #635 by rezoning Lots 1 to 12 inc., Block 12, Tract #27 from R-1'
to R-2 provided that Deed.Restrictions be imposed upon each of.said lots to
the effect that two detached single dwellings may be.built upon each lot
provided that not more than one dwelling is built facing Santa Ana Avenue
or Old County Road.
Motion seconded by Commissioner Ellerbroek and carried by the following roll
call *ote, to -wit:
AYES: Commissioners: Briggs, Copelin, Ellerbroek, Longmoor, Reed, & Rudd.
NOES: None
ABSENT: Commissioners: Pleger, Smith, and Wightman.
There being no further business to come before the Commission, motion for
adjournment was made by Commissioner Copelin, seconded by Commissioner Reed
and carried.
