FINDINGS This dwelling is being built in a commercial district and under Section 9105.4 (g), Ord. No. 635, a.201 front yard setback is required. DISCUSSION Submitted to the Commission was a petition signed by 19 persons protesting the encroachment of 4' into the 19' rear yard setback. The petition referred to other matters not under the jurisdiction of the Planning Commission. 7. FINDINGS A report from the Committee set forth that policy already established by the Commission favors encroachments to the minimum 15' rear setbacks in a "B" District. After careful consideration of all the evidence at hand the Commission found and determined that the desired rear yard encroachment would not be detrimental to the general welfare of persons residing in the neighborhood. 8. Applicant contends information was obtained from the Lido Isle Community Association and the Building Dep &rtment re- garding setbacks prior to drawing of plans which apparently were erroneous. To do over plans at this time would result in further delay and considerable expense. 6. DISCUSSION Note findings. 7. FINDINGS Policy already established by the Commission prohibits a fence in excess of 3' on the front' property line. The Committee in their findings stated that other buildings in this area had conformed to required side yard setbacks and since a definite hardship was not established at time of the hearing, a recommendation of denial was made. 8. Inspection of the plans disclosed that the proposed garages for this development would be off Bayside Drive and cars coming out of the garages would back directly onto Bayside Drive. Commissioner Hayton stated he would object to this arrangement as it would create a traffic hazard. He further stated "?ode are objecting to the application as submitted from the viewpoint of crossing property lines in creating this type of development, but because of the topography we feel it is an advantage to grant it. Normally we wouldn't ". 0n suggestion of the Commission the applicant requested that the application be held over until the next regular meeting in order that amended plans could be submitted showing. - a turning basin for cars backing out of the garages before entering Bayside Drive. ;ommissioner Hayton9 Seconded by Comm. DISCUSSION : Note findings. 7. FINDINGS The Committee reported this variance request to be in keeping with policy established for this area in permitting staggered setbacks and in the absence of any protes.ts recommended approval. 8. Encroachment of 21611 into a required rear yard setback of 5' for 2nd floor overhang only. 5. Extremely short lot (781) requires encroachment into rear yard setback with second floor. Very difficult to build a building of this size on this lot. 6. DISCUSSION : Mr. Gerald Sparks represented the applicant and his remarks to the Commission set forth that a definite hardship existed because of the smallness of the lot. He further set forth that encroachments of this type existed in the same block. 7. FINDINGS The Committee in their report to the Commission stated that policy established by the Commission previously permitted encroachments of this type for duplexes only. Although this lot is zoned R -4, only two units can be built as the size of the lot would prohibit additibnal'.units. It was observed that other dwellings in this block had similar overhangs. There were no protests and the Committee recommended approval. 8. On motion of Commissioner Smith, seconded by Comm. Construction of one single family residence on each lot with provision for off - street parking without attached garage or carport. 5. The subject property slopes from Iris Street to a gully and drainage ditch, which renders 16! of the rear of said lots unusable for any purpose. The lots are also bisected by an existing sewer and easement or right of ,ray; as shown on the attached plot plan. No construction may be placed either on the rear 16' or over any portion of the above mentioned sewer easement. The only practical and physically feasible location for garages or carports; would be from the rear of the lots at such time as the alley is established and maintained is dedicated. If applicant is required to erect permanent garage facilities at this time; a substantial portion of both lots will be rendered useless for all future purposes, and will result in abnormal hardship in view of the fact that the exist- ing sewer right of way prevents the constiuction of garages as an integral part of the proposed dwellings, 6. DISCUSSION . Presented to the Commission were four • letters submitted by property- owners in Block 736, Corona del Mir who stated they objected to the variance request for the following reasons:. -- 1. FINDINGS After consideration of all the evidence pre- sented, the Commission found and determined that there did not exist a hardship which would warrant the approval of this application. It was the opinion of the Commission that plans could be drawn without too much added expense which would include garages as required under the existing ordinances. 8. DISCUSSION This application was considered at the last regular meeting of the Commission but was set over in order that the applicant could amend his plans to show accessability to the garage.' The garage is 17' in depth, however the zoning code requires a 20' depth. The applicant was present at this hearing but did not submit plans showing the change in garage depth as requested by the Commission. 6. FINDINGS i Because of the garage being unaccessable the Committee stated it would be poor planning to approve the application as submitted. 7. On motion of Commissioner Copelin, seconded by Comm. Lot 4 Block 11 Tract 234 Zone R -1 3. Posted April $, 1957. 4. The addition of a two bedroom house on a lot which now has a non- conforming dwelling. 5. DISCUSSION This dwelling is non - conforming as there exists a 1211 side yard setback and a 3' setback is required. If an additional unit was built, on this lot the present dwelling would become an accessory building requiring a 5' setback from the alley and would be in excess of the permitted.height of 151.. This application was considered at the last regular meeting of the Commission but was set over on recommendation of the Commission in order that additional plans could be submitted • showing attachment of.the proposed new building to the existing unit. 6. FINDINGS The applicant complied with the request of the Commission by furnishing an amended plan to show attachment of the proposed unit to the existing dwelling. A recommendation of approval was made by the Committee subject to the condition that the kitchen unit in the existing building ba removed. 7. On motion of Commissioner Smith, seconded by Comm. DISCUSSION The Commission was advised that the.existing dwelling is 73' back from the front property line and that the zoning code requires a maximum setback of 35'. It was further noted that the existing garage as shown on the plot plan was being used for dwelling purposes. FINDINGS The Committee in their report stated that the existing structure is in such bad condition that it would be poor planning to approve the addition requested. Recommendation of denial was also made on the basis of no provisions being made by the applicant to provide a covered car space. as required by the zoniig ordinance; 7. DISCUSSION Note findings. 6. FINDINGS Investigation of this property by the Committee revealed no provisions for off- street parking. The applicant stated that existing plans did not provide for a garage or carport, therefore the Committee recommended denial. 7. On motion of Commissioner Smith,.seconded by Comm. Rudd, Use Permit application No. 320 was DENIED by the following roll call vote, to wits ALL AYES. Ar. Edwards further set forth that this application should be denied as it would be detrimental to the health and general welfare of persons residing in the neighborhood. (. DISCUSSION : The applicant was present and stated that he had nothing to add to his application but would be glad to answer any questions. Commissioner Longmoor inquired as to how many boats would this "Family Type Yacht Anchorage" accomodate.. Mr. Campbell, President of Featureline Inc. stated "probably a minimum of 25 or a maximum of 35 boats ". Mr. L.L. Holbrook of 623 36th St. asked "Does this include the renting of boats for people_ who come there ". Mr. Cambell stated that there would not be any boat rentals. . Mr. James Edwards, President of the Newport Isle Association, addressed the Commission and in his remarks stated, among other things, that commercial use of waterfrontage in this strictly 100% residential area should be pro- hibited, would result in deterioration and de- preciation of property values, channel is narrow and is heavily congested, people who rent slips from private individuals do not use toile;: facilities provided for them and that children use this channel for swimming. Ar. Edwards further set forth that this application should be denied as it would be detrimental to the health and general welfare of persons residing in the neighborhood. (. No. 635, a Use Permit must be secured for any construction in an "unclassified" zone. In the absence of any protests a recommendation of approval was made by the Committee. 7. DISCUSSION The applicant addressed the Commission and stated that he had previously operated several restaurants, and had always been complimented on having a clean and high type service. He presented to the Commission several letters which testified as to the class of service rendered. Speaking against the granting of this. application were:- Mr. Stewart, 13 Balboa Coves, Mr. Roscoe, 21 Balboa Coves, Mr. Collins, 14 Balboa Caves, Mr. Reed, 8 Balboa Coves. FINDINGS : Schools may be permitted in a residential district subject to first securing a use permit under Section 9105.1 (f). The Committee in their report stated that if this application were approved it would set a precedent and would create a "home" type of business, a condition which the Commission has discouraged in the past. 7. Lind and carried, the Planning Staff was instructed to write to the Orange County Planning Commission in protpgst of this change in zoning for the reason that this is /potential annexation area. and if annexed it would be zoned M -1 -A,. City Clerk - Treasurer with an attached copy of a petition signed by thirty -nine residents of the Newport Heights area requesting, an ordinance to restrict and regulate, through the Planning Cimmission, all advertising signs. On motion of Commissioner Rudd, seconded by Comm. Copelin and carried this matter was referred to the Architectural Committee for preparation of architectural standards and a proposed amendment to the Code covering signs. . . . . . . . . . . . . . . . . On motion of Commissioner Copelinj seconded by Comm. Smith and carried, resolution of Intention No.,613 was adopted to hold public.heaYings during June and July 1957 to delete Sections 9103.62 (d) and Section 910302 (a) of Ordinance No. 635 regarding inflammable materials. Commissioner Longmoor presented to the Commission a lenghiy report regarding a recommendation of the Planning Commission to the City Council on petitions received for annexations in the area known as the •'Last Corridor ". On motion of Commissioner Reed, seconded by Comm. Copelin and carried this report was approved by the Commission and Commissioner Longmoor was instructed to present same to the City Council for their recommendation to the petitioners. . . . . . . . . . . . .
