(Item Nos. 1, 2, 3 and 4 were heard concurrenly due to their relationship.) The Public Hearing resumed from the regular Plan- ning Commission meeting of May 10, 1979, and ITom Morrissey, Director of Industrial Relations o!P tl Ford Aerospace and Communications Corporation, al peared before the Planning Commission and indlica ed that they have reviewed the project in Light the previous meeting on the project and they fee' that two issues remain: (1) the possibility of providing rental units on the site; and (2) the density of the proposed development at the corne of Ford Road and Jamboree Road. In light of these two.issues, he then reviewed an alter- . native plan for.development of the site. He in- dicated that presently plans called for 132 c.ond miniums at the corner of Ford Road and Jamborlee Road, and that an alternative to this would be 1 rental units in this location. His rationale fo this suggestion was that: (1) geographically, t area is separated from the remainder of the deve ment and doesn't present a problem from a land u mix standpoint; and (2) the proposed living unit in this location are the smallest in the project and allow themselves for ease of change to apiart ments; and (3) it provides for a reduced densit, this location as discussed by the Planning Coimmi sion; and (4) affords.them the opportunity to re tain the basic housing mix, with a variety.of pr ranges. On the opposing side, he noted that.ap.a ments would drive the cost of the remaining unit higher. He noted that the alternative would all for the development of 578 homes on the site. H then informed the Planning Commission that he an Eagle /Daon Southwest Corp. had submitted a lette to the Planning Commission, expressing the inten tion of the two parties in terms of offering hom and /or apartments to Ford Company employees. He pressed their joint concerns about Department of Real Estate requirements with.regard.to the excl sion of people from the sale of units. -3- MINUTES R ie >f I )0 r ie to se S a s- ic( rt- s ow e d r es . e: u- INDEX COMMISSIONERS MINUTES City of Newport Beach ti+p May 16, 1979 - ROIL CALL Commissioner Agee then questioned the section of the letter which indicated that Ford Company em- ployees would be advised of rental vacancies and how this would be accomplished, to which Mr. Mor- rissey stated that they would be establishing an ongoing relationship with the rental agency and further that his company would keep.an ongoing li of people interested in the apartments. He addi- tionally stated that as each phase of development opens, they would make presentations to interests employees and that this would occur before the units would be opened for sale to the general pub lic. In response to a question by Commissioner Agee, Dennis O'Neil, City Attorney, responded that a co dition of approval could be placed on the project at this time and then could be strengthened at th City Council hearing on the project and that the City Council would then make the final decision e the project. Commissioner Agee suggested that a condition coul be worded to state the concerns of the Planning Commission and the City Attorney could refine it the maxium extent allowed by the law. Commissioner McLaughlin inquired about the effort that would be involved in looking into this conce from a legal standpoint, to which Mr. O'.Neil resp ded that he could structure the condition to ince porate the Planning Commission's concerns. Commissioner Frederickson then asked whether the Ford Company had any other methods of notificatic to their employees, to which Mr. Morrissey states that the company had a monthly newsletter that reaches each of the employees that would also ser as a vehicle to notify employees of the project. Commissioner Haidinger then asked what the rental cost of the units was anticipated to be, to which Michael Ryan, Marketing Manager, replied that the units were anticipated to range from $450 to $55( per month in 1979 dollars. Mr. Morrissey indicated that at these quoted ren- jtal prices, they were presently anticipating that ithe apartments would create a negative cash flow. He also stated that they have no reluctance in we ing with the City Attorney's office to refine the !language of the condition. Commissioner Agee then noted that it would be ;pat of the public record that Ford Company employees iwould be given first notice of each phase of the (proposed project. 'Commissioner Haidinger requested that the $450 t< !$550 rental range in current dollars be placed ov ithe.public record, to which Commissioner Agee stt ied that staff would do so. !Commissioner Beek questioned whether the company 'employees. would be given preferential prices as % • las first notification, to which Mr. Morrissey re! iponded that this would be an obstacle to the Depi iment of Real Estate, and Wally Gaynor , President !Eagle Development Company, added that preferentii ,prices were illegal. Mr. Morrissey indicated that minor inducement sui las upgrades within the homes might be possible, which Commissioner Agee suggested that Ford -Aero• nutronics might consider offering inducement to ployees as part of its employment recruiting to courage people to settle in the area. Commissioner Beek then posed a question, to whic' David Neish, Urban Assist, responded that he was not representing the Irvine Company but rather t he was representing the applicants of this proje In response to a question posed by Commissioner Balalis, Mr..Morrissey answered that they had me with the Association representing the McLain De- velopment and that they were in favor of the pro ject with the exception of the entrance to the p off Ford.Road, due to their concern for the nois that would occur as traffic comes to a stop at t !proposed traffic signal at that point. Don Webb, Department of Public Works' Subdivisioi Engineer, stated that the Public Works Department anticipates using an actuated signal which would create green time on Ford Road the majority of tl day, except during p.m. peak hours, and that most of'the stopping after the p.m. peak hour would b( caused by people exiting from the McLain develop. ment. In response to.a question by Commissioner Balali! Mr. Webb further commented that the si nal insta' lation was a condition of development Page 34, Condition No. 20). Robert Carley, Vice President of Robert Bein, Wi' liam Frost & Associates, then discussed the pro- ject's grading aspects. He stated that they pre• sently anticipate grading to occur during the dry season, as it represents a problem to them if it occurs during the rainy season. He also reviewer the temporary and permanent erosion control systf of the project. In response to a. question by Cor missioner Beek, Mr. Carley responded that it was customary not to prepare an erosion and siltation control plan until the project itself was confirr There being no others desiring to appear and be heard, the Public Hearing for these items was closed. Commissioner Agee then stated that he was glad tl they had the opportunity to review a residential option on the site and he stated that he felt th( applicants had developed a well thought out pro - posal and had proceeded to prepare a plan in goo( faith. He expressed his feeling that the alterni tive plan with 578 units and 100 apartments reco( nized the concerns of the Planning Commission an( City Council over the.housing stocks within Newp( Beach. Motion x Motion was made to accept the revised plan of 57E units and 100 apartment units, with the findings and subject to the conditions as stated in the Staff Report, with the exception of the changes Condition Nos. 30 and 38, and an added Condition -6- MINUTES INDEX ie i I (m n- ( iat I • (rt S In • COMMISSIONERS City of Newport Beach May 16, 1979 ROLL CALL that would make reference to the May 16th letter from Daon Corporation /Eagle Development Company, a condition that the Ford employees be given fir notice. i Mr. Hogan then questioned whose option it would to assume the bonds and assure improvements woul be available coincident with traffic volume in- creases. David Neish, Urban Assist, then responded thait their concern lie in the measures over which neither the applicant nor the City of Newport Beach had control; such as, the intersection of Bison Aven MacArthur Boulevard, a State project. In response to a question from Mr. Hogan, Mr. O'Neil responded that bonding up front would gua antee project completion. ': Commissioner Beek proposed to the Rlanning Commi Sion that perhaps the bond could.be applicable t • ward equivalent work to accomplish the same end another way. In response to a question posed by Commissioner McLaughlin, Mr. Hogan stated that the City Counc intent was to stay within 9 lanes at an intersec tion and 6 through lanes and that turn lanes are considered part of the intersection, but not par of the main arterial. Wes Pringle then stated that they were not physi ally widening the street but only reallocating its use. In response to an additional question posed by Commissioner McLaughlin, Mr. Hogan stated that there is a 20% -.25% affordable housing require- ment, but the question as to whether it applies to this particular project is questionable. Commissioner McLaughlin then suggested that 610 dwelling units be allowed with this project, wii a requirement that 20% of the units be rental al artment units (or an additional 22.apartments), be located wherever the applicants wished, iniclt ing the required number of parking spaces for si apartment units. i I -7- MINUTES >t be d ue r- s- o- in it t c- h to d- id INDEX COMMISSIONERS l py T?L City of Newport Beach May 16, 1979 ROIL CALL Motion x Amendment to the Motion was then made to allow dwelling units, 132 of which shall be rental ap- artment units (in Area 1), including 3 parking spaces for each of the apartment units, with the findings and subject to the conditions as stated in the Staff Report, with the exception of the changes to Condition No. 30 to provide for weekly vacuum sweeping rather than daily vacuum sweeping, and Condition No. 38 to in- clude "or guaranteed or bonded ", and an added condition to make reference to the May 16th letter from Daon Corporation /Eagle Development Company, a condition that the Ford employees . be given first notice. Commissioner Agee stated that he would necessar- ily oppose the Amendment to the Motion, as he felt that 100 apartment units would be adeq.uate in this project. Ayes x x K x Amendment to the Motion was then voted on, which Noes x x K MOTION CARRIED. Commissioner Haidinger stated that he would op- pose the motion, as he felt that the density of this project exceeded what he felt was approp- riate on this site. Commissioner Beek then requested that his views I placed on the public record and in the written ri cord, as follows: "This proposal is a significant step forward. Oi area has a serious unbalance between employment and housing. There are no provisions in it to guar- antee the dwellings will be occupied by the To- cal work force, or to encourage occupancy by local workers. Even the so- called preferen- tial treatment for Ford workers has no binding document to support it, and is not an actual monetary preference. They may still be squeezed out by market prices. There is no provision for a neighborhood conven- ience shopping center on -site, so the occupants must travel by automobile to off' -site shopping centers, cnacelling any traffic benefits to be gained by the local housing of some of the work force. The Environmental Statement has been found inade quate by the Water Quality Control Board, De- partment of Fish and Game, and the City's own Environmental Quality Advisory Committee. • The project seems, in sum, to be little moretha a routine attempt to squeeze the maximum number of dollars out of the acreage." Commissioner McLaughlin then stated her under - standing that there is a shopping center planned in the North -Ford Development at the Bison Ave- nue /MacArthur Boulevard intersection, across the street from the Ford- Aeronutronics project. Commissioner Agee then spoke in .response. to Com- missioner Beek's statements regarding his views, as follows: "I really feel, Allan, since you're putting some thing in the public record and have asked that i be in the written record, that it at least ought to be balanced in fairness to what reality is, and I would ask in response that this be pointed out - and I am not saying that you don't have legitimate concerns - but I believe you've over- stated the case substantially that you are try- ing to make. In fact in my opinion, it's just a matter of opinion that you're stating, and I am just concerned that they be accepted as facts and it's only opinion that. you're offering; that there is adequate protectic on all the points you've raised in there; so I would differ on that, with the exception of .the market condition. The only point that I will give you in that state ment that is, in fact, true is that I would total agree with the fact that there is going to be no subsidization of these units by the Ford Company, or anybody else, as far as I know, and I am per- fectly aware of that and until there is a system worked out or until the City, with some agency, works out a plan that is workable as far as sub - sidizing housing, I am going to oppose it, becaus every one of them that I've seen has .turned into a lottery in some sort of a carnival atmosphere." Commissioner Balalis then stated that he felt tha their intent has been to provide alternate housir for people who cannot afford to buy homes, as Mr. Beek suggested. He further expressed his feelinc however, that he did not believe that the develoF ers or the Ford Motor Company had a requirement t subsidize its employees or require them to purche homes in the area or give them any other kind of. monitary benefits, unless they chose to do so. i concluded by stating his further feeling that by providing those apartments, many individuals who cannot afford to buy a home for $150,000 to $200,000, could certainly- afford to rent, even ii the rent on those apartments got to be $700 to $800 a month. That the Draft Environmental Impact Report is complete and prepared in compliance with the California Environmental Quality Act, that it: contents have been considered in the decision: on this project. 2. That based on the information contained in the Draft EIR, the project incorporates sufficien- mitigation measures to reduce potentially -sig, nificant environmental effects, and that the project will not result in significant enviroi mental impacts. and approve Amendment No. 532, revising the Planne Community Development Plan and Development Standar, for the Ford - Aeronutronic P -C District, subject to the following change on Pages 9 and 12: "Fences, Hedges and Walls Fences shall be limited to a maximum height of seven (7) feet, except within the front • yard setback where fences, hedges and walls shall be limited to five (5) feet. Wing walls, where an extension of a residential or accessory structure is to be constructed may be eight (8) feet in height. That the map meets the requirements of Title 19 of the Newport Beach Municipal Code, all ordinances of the City, all applicable gener- al or specific plans, and the Planning Commis sion is satisfied with the plan of subdivi- i sion. 2. That Jamboree Road be widened on the easter side of the existing Ford entrance to provi for a westerly parkway width of ten feet, a southbound traveled way of forth -eight feet curb -to- curb, double left -turn lanes, and a right -turn lane; that existing median im- provements disturbed be replaced; and that traffic signal be modified as necessary. 5. That all vehicular access rights to MacArth Boulevard be released and relinquished to t City. 6. The location of all accesses to Bison Avenu Jamboree Road and Ford Road shall meet the approval of the City Traffic Engineer. 7. That the remaining improvements along Bison and easterly side of Jamboree Rd. be comple including ten -foot sidewalk bike trail. 8. That the northerly side of Ford Road be wid ened and improved to primary arterial stan- dards. 9. That a full width connection of Bison Avenu to MacArthur Boulevard be constructed. 10. That Water Capital Improvement acreage fees be paid for all new development, including the construction of new facilities on Parcel 4. For existing Aeronutronic Division faci- lities on Parcel 4, the applicability of Wat Capital Improvement acreage fees shall be suss ject to further investigation. 18. A landscape and irrigation plan for all comm areas of the residential portion of the prof and for the industrial expansion portion of project shall be prepared by a licensed lan d- scape architect. The landscape plan shall i tegrate the installation of landscaping wit h the proposed construction schedule. (Prior the occupancy of any new industrial buildin or dwelling unit, the licensed landscape ar tect shall certify to the Department of Com- munity Development that the landscaping has been installed in accordance with the prepa plan.) 19. The landscape plan shall be subject to the review of the Parks, Beaches and Recreation Department and approval of the Community De- velopment Department. 20. The landscape plan shall include a maintena program which controls the use of fertilize and pesticides. 21. The landscape plan shall place heavy emphasi on the use of drought- resistant native vege tion. 22. That erosion control measures be done on any exposed slopes as soon as possible to reduce erosion potential. 23. That erosion control measures shall be done any exposed slopes within thirty days after grading or as approved by the Grading Engine 24. Development of the site will be subject to a grading permit to be approved by the Depart- ment of Community Development.
