MINUTES OF THE PLANNING COMMISSION MEETING FOR THURSDAY, MAY 18, 1950, at
7,30 P.M: IN THE COUNCIL CHAMBER OF TkE NEWPORT BEACH CITY HALL
' ROIL Commissioners Presents Briggs, Copelin, Ellerbroek, Longmoor, Pleger, Rudd,
CALL: Smith, and Wightman.
Commissioners Absent: Daniell
MINUTES: Commissioner Rudd moved that the minutes of the meeting of April 20, 1950,
be. approved as submitted to the Commission, seconded by Commissioner Ellerbroek
and carried.
PUBLIC Variance° Chairman Longmoor declared the hearing open on the first variance .
HEARINCS:application of Marie Hiebsch for Lots 14, 16, and 18, Block 329, Corona del Mar,
so that she may be:allowed a reduction from fifteen to twelve feet in the set-
back on Acacia Avenue. This application had been set over from :the April meeting
for further study. The Chairman asked if anyone wished to speak for or against
the application. When no one spoke, he asked for the Committee's report. Com-
missioner Copelin gave the repast and said that since the only view is across.
the street, there was no hardship at all and recommended to the Commission that
the application be denied. After further discussion, Commissioner Copelin made
a motion that the hearing be closed, seconded by Commissioner Wightman,and
carried. Commissioner Copelin then moved that the application for variance be
denied, seconded by Commissioner Rudd and carried by the following roll call
vote, to-wits
AYES: Briggs, Copslin,.Ellerbroek, Longmoor, Pleger, Rudd, Smith, & Wightman.
NOES: None
ABSENTS Daniell
' Variance: Application of property owners in Blocks.238 and 239, Canal
Section so that they may be allowed a fifteen foot front yard setback from the
water on each lot. This was discussed.along with the other variance application
of property owners in Blocks 338, 339,.annd 340 of Canal Section for the same
fifteen foot setback.
Chairman Longmoor opened'tbe bearing and asked for comments.
—Marian Graves, 3808 River Avenue, spoke. first and said she had circulated the
petition and everyone seemed to be in favor of the setback. Chairman asked their
reason for filing for the variance. Mrs. Graves said the property owners felt it
was a distinct hardship because they didn't have much floor area left for a satis-
factory house after the setback had been taken into consideration.
Commissioner Copelin said be had talked with the planning consultant, Mr Wise,
and that he thought it would be better planning if the setbacks were twenty feet
instead of fifteen feet, and asked if that would be agreeable with the' property
owners. She said it would be.

Mr. Wise said that he thought the Commission should amend the zoning ordinance
and change the setback on the.maps rather than grant any variances in these blocks.
Chairman Longmoor asked if there were any other property owners wishing to speak.
' - -Jesse R. Packard, 4028 Channel Place. 15 /441/Canal. Wasn't contacted. After
some discussion, found that Mr., Packard wasn't in the blocks under discussion.

- -H. B. Breckwedel, 3806 River Avenue, 4/238 /Canal. The size of the lot doesn't
permit a dwelling to be put up for a permanent residence, so it is necessary to
have the whole fifteen feet as applied for.
-- Mrs.-Earl Hurst, 4017 Channel Place, 8/ 340 /Canal. Has never been consulted '
and wasn't in favor. The Chairman asked if the setback was changed, would it
hurt her lot._ Mrs. Hurst said it certainly would.
—Albert Redden, 4001 Marcus, 1 & 2 /340 /Canal. Stated that they didn't need all
the space between the house and the Bay. Can't see why people aren't allowed to
build a little closer to the Bay than they are at present. Fifteen or twenty
foot setback would give everybody a better change of enlarging their house.
-- Gordon G. Siple, 406 40th Street, 4/439 and 9 /340 /Canal. Can see no reason
why it can't be brought to a head now -- shouldn't linger any longer. Mr. Siple
had contacted the owners of lots 2 in Block 338 and lot .4 in Block 340 by phone
end they were both in favor of the variance. Said that people in objection to
the variance were already in violation of the setback by having parches extending
into the thirty foot setback.
- -Mrs. Graves. Circulated the petition with the thought in mind that within
thirty days you were putting in the master plan and wanted it incorporated into
the master plan.
Chairman Longmoor suggested that they set the hearing over until the next meeting
with the idea of making an amendment to the ordinance and that they explore the
problem for the entire area.
Commissioner Smith made a motion that the hearing be set.over to the next regular
meeting on Julie 15th, seconded by Commissioner Wightman and carried. '
Commissioner Rudd made a motion that they institute an ordinance changing the set-
back in this area, seconded by Commissioner Ellerbroek and carried by the following
roll call vote, to -wit:,
AYES: Briggs, Copelin, Ellerbroek, Longmoor, Heger, Rudd, Smith, and Wightman.
NOES: None
ABSENT: Daniell
Motion to set date for hearing made by Commissioner Copelin, seconded by Commissioner
Wightman and carried by the following roll call vote, to -wit:
AYES: Briggs, Copelin, Ellerbroek, Longmoors Pleger, Rudd, Smith, and Wightman.
LACES: None
ABSENT: Daniell
Conditional permit: Chairman Longmoor declared the hearing open on the appli-
cation of Alex M. Morrison for a conditional permit so that he may operate an auto-
matic laundry at 129 Agate Avenue, Balboa Island, (Lots 17, 189 190 Block 7, Section
One, Balboa Island) and asked for any comments for or against. Mr. Morrison was
present; however, he said that anything he said.would only be an reiteration of
what was said at the last meeting. Informal discussion with the Commissioners,
especially regarding having the actual building turn out like the plans presented
to the Commission. '
Commissioner Pleger made a motion to close the hearing, seconded by Commissioner
Wightman and carried.
Commissibner Copelin moved that the conditional permit be granted subject to final
inspection, approval of plans, specifications, and conditions of Commission including

adequate off- street parking by the committee of Commissiorers Smith, Pleger,
Ellerbroek and the Building Inspector,. -Mr. Nelson. Motion seconded by Commis-
sioner Smith and carried.
' OLD BDSINESSs New zoning ordinance up for discussion.
- -Allen Stelle, 212 Dahlia, Corona del Mar. Examination of the zoning map shows
that in spite of the protests in the area of Blocks 131, 1322 & 133, it has been
left R -2.
- -Kate MCKann. Wondered if any further definition was given to "family" in the
new ordinance. Chairman read the definition as it was and finally decided to
strike.out the word "housekeeping "iin the definition.
Commission decided that they would hold one more meeting on the map alone and
leave the ordinance as it now stands, and then submit the Master Plan to the City
Council.
The Chairman asked if anyone wished to present anything to the Commission inform-
ally.
- -Fred J, Nannested, 23 /A- 35 /CDM. The State acquired the property surrounding his
lot. Prior to acquisition of this ground by the State, the Planning Commission
had zoned the ground for 180 feet from the concessions as R-3, bringing it up to
the line of his lot. Mr. Hennesy of the State Park Commission informed his that
the ground around there would be used for a parking lot. This makes his property
of little value as R-1 and requests that the Planning Commission recommend to the
City Council that the zoning on his lot and the lots which are below, the bluff and
immediately adjacent to the ground to be used for parking purposes be changed to
an R-2 or R -3 zone. Discussion with the Commission.
The Chairman suggested holding this particular problem in abeyance along with Mr.
Penny's lot as they both are in the same category, and that Mr. Nannestad get
in touch with Mr. Penny and consolidate the entire problem.
--Walter Greening, 309 Narcissus Ave., CDM, owns Nly 160' in Block 0-33, which is
a lot as you go down the stairs to China Cove and zoned R-1. His problem falls
in the same bracket with Mr. Penny's and Mr. Nannestad's and the Chairman advised
him to keep in contact with the other melt.
-- Harvey D. Pease,.'Balboa Island. Petition for rezoning of Lots 22 & 23 in Block
81 Section 1, and Lots 25 &.26, Block 10, Section 1, Balboa Island (Park and Agate).
Wants it changed to C-1 and incorporated in the new Master Plan. Traffic around
that corner would not encourage anyone wanting to build residential property..
Buildings badly need improving. Chairman asked if they were planning to rebuild
the buildings there and Mr..Pease said they were giving it consideration.
Chairman Longmoor suggested that he make formal application for an amendment to
the present ordinance or have it incorporated in the new Master Plan as a C-1 H
district which would require off - street parking on the lot. Mr. Pease said his
lot was 60' x 85' and didn't feel it was big enough to allow for such parking.
-- Brooke Hukill inquired about the parking lot at the Moose Lodge and whether it
was going to be discussed now. This was not on the.agenda and he asked to be
notified when the Commission recieves the subject for consideration. The Chairman
said the Secretary would so notify him at such a time.
Commissioner Briggs said that Monday, May 22, the City Council will take
action on the granting of land to the State as matching property for the purchase
ris
of China Cove. He asked whsther the granting of this would make more difficult.

Commissioner Ellerbroek made a motion that the following letter be sent to the '
City Council, seconded by Commissioner Pleger.and carried:-

City of Newport Beach
Gentlemen:
It has come to our attention that you are seriously considering granting to
the State of California certain portions of the Ocean Front property in Newport
Beach as matching property for the purchase of China Cove.
We request that you give serious study and consideration to this project so
that it will not, in any way, interfere with the Master Plan which is under con-
sideration and development for the City of Newport Beach.
The planning consultants also have under preparation plans for the develop.
ment of the Ocean Front from Newport pier to the jetty as a recreational area.
Hoping that you will not make any move in this direction that will prevent
the functioning of the plan, we are,
