'ly meeting in the Council Chambers, City Fall, Newport Beach,
California, on Wednesday, May 19, 1943, at 4 P.M..In the absence
of Chairman Hopkins who was obliged to attend a meeting in Sacra-
mento, on motion of Commissioner Patterson, seconded by Secretary
Seeger, Commissioner Johnson was selected as chairman pro tem of
the meeting. Motion carried and so ordered.

Secretary Seeger read the following communications:
Letter dated May 4, 1943, from California. State Planning Board
enclosing brief entitled "Value,.Activity, Method." Chairman
Johnson suggested that this communication and brief be read by
the various members of the Commission and filed. Commissioner
Finch moved that the letter and brief be filed. Motion seconded
by Commissioner Nelson, carried and so ordered.

Letter from the Newport Harbor Chamber of Commerce dated April
24, f943, enclosing list of organizations in the Harbor Area
which might be interested in the activities of _the Planning Com-
mission. Secretary Seager said that he thought the . circumstances
leading up to this communication should be explained to the Com-
mission. He called upon Commissioner Patterson who had attended
a, meeting at which matters concerning post war planning heal been
discussed. Commissioner Patterson said he was present at a. meet-
ing of a. group of local citizens interested in post war planning
for this section and surrounding territory - such as tra,nsporte.tion,
air port service, etc. He said that an effort was being made to
arouse public interest and to get started on some sort of a plan-
ning program. He said Secretary Seeger - who was also present at
this meeting - had explained to the group that the Planning Com-
mission had started on a program of public works for the city to
be undertaken after the war, and had invited members of the Chamber
of Commerce to be present at the next . meeting of the Planning Com-
mission to learn what it had in mind.
Mr. Longmoor, President of the Chamber of Commerce, and Mr. Welch,
Secretary of the Chamber of Commerce, were called upon for remarks.
Mr. Longmoor stated that the reason for the meeting to which Com-
mispioner Patterson had referred.^ bec^uGe th? Chamber of Com-
-erce ha,d been receiving communications from the Rp.tional and State
Chambers of Commerce urging each community to take steps sufficiently
early regarding problems which might arise after the wer. He said

Los Angeles had formed a large orgeniz ation for post war
r1p..nning mhich mould encompass most of California., including
Orange County, but that so far as the Newport Chamber of Commerce
was concerned,.it.wa.s interested only to the extent that these me,t— '
ters be brought to the attention of local organizations, such Re
the Planning Commission. He said many problems would. arise af-
fecting this community in which all organizations should take
interest so as to be.prepa.red to protect the interests of the
Harbor district. Mr. Welch said. he had nothire to add to these
reme.rks.
Chairman Johnson expressed his apprecie.tion to Mr. Longmoor and
Mr. Welch, and thanked. them for being present, saying he would
like to see more local interest in the activities of the Plan-
ning Commission evidenced.
Xr _Louis Briggs, one of a. committee of three, including Mr.
Earl W. Stenley and. Mr. P. A. Palmer, to be present at the meet-
ings of the Planning Commission, expressed his interest in the
work of the Planning Commission.
A general discussion ensued. Mr. Longmoor suggested that in
view of the fact that the Los Angeles organization on post
mar planning had got off to such a, big start, it might be help-
ful if this Commission would get in touch with them so as to be
posted on .what they had in mind. Chairman Johnson said he
thought this was an admirable suggestion, and suggested a motion
to that effect. - Commissioner Finch moved that the Secretary be_ ,
instructed to write for information. Motion seconded by Commis
sioner Nelson, carried and so ordered.
Secretary Seeger read a communication from Senator Hiram W.
Johnson acknowledging receipt of the Commission's letter relat-
ive to H. R. 1898. Also, a. Brief by Richard J. Neutra, on Post
War Planning. Commissioner Finch moved that both Senator John-
son's letter and Mr. Neutra.'s brief be filed. Motion seconded
by Commissioner Nelson, carried and so ordered.
At this juncture , Mr. Eetus, representing Mr. J. S. Barrett,
a.ppeared before the Commission. He asked for a conditional
permit to erect temporary buildings to be used for office,
stock room end shop, and the maintenance of a, general storage
yard, the same to be located on Lot "A" of Tract No. 919. He
explained the,t Mr. Barrett had defense contracts up and down
the coast, and that it was his desire to establish a, central
office in connection with this work.
Chairman Johnson advised Mr. Estus that there would have to be
• public hearing on the matter. Secretary Seeger suggested that
• motion be made instructing the Secretary upon receipt of an
application from Mr. Barrett to immediately advertise a public
hearing end notify the smembers of the Planning Commission as to
the date of such hearing. A motion to that effect was made by I
Commissioner Patterson, seconded by Commissioner Finch, carried
and so ordered.

Hearing opened by Chairman Johnson.
Secretary Seeger read the application of the Ackerman Bost
Company, stating that notice of application and of public
hearing had been duly advertised.
There was no one rresent to represent the Ackerman Boat Com-
pany in support of the application, and no one spoke for or
against the application from the floor.

Considerable discussion took place amongst the members of the
Commission, Commissioner Patterson pointing out that under the
Ordinance foundries were prohibited in the City of Newport Beach.
Chairman Johnson said. that the Commission could not grant P. per -
mit`unless steps were taken to amend.the Ordinance. secfetary
Sea.Per statod that the ^ ^rlic ^tion says nothing about .changing
the Ordinance. He recalled that the some question arose in re-
ference t^ the Pevt ®n Boat Company, when the Commission was ad-
vised by V-1e City Attornev that its contemplated action in grant-
ing a. conditional hermit was ille?al, but that an illegal ordinance
was just as good as a, lerta.l ordinance until it wa.s tested.. Secre-
ta.ry Se.aQ:Pr said that the Commission in this instance took that
chp.nce as it didn't want to be placed in the position of objecting
to an industry engaged in war activity.
Commissioner Finch sAid that since conditional hermits had already
been granted, he didn8t see why a. conditional permit could not be
era.nted in the case of the Ackerman Boat Company, with the under -
et?.nd.ing that the foundry should be removed after the war, and he
made a motion to that effect. Cha.irma.n Johnson inquirbd !whether or
not the Ackerman Boat Company understood. that a, provisional permit
could be granted only for the duration of the wa.r and six months
thereafter. Secretary Sea.ger said he had explained e.11 that to them
before they filed. their application.
Mr. Louis Briegs, who was present during the hearing, remarked that
he did not think that the situation of tIr:e Ackerman Boat Company was
compprnble to that of the Peyton Boat Company; as the Ackerman Boat
Company already owned a, foundry in Costa. Mese., and another foundry
wa.s not P. necessity, but merely a convenience. Under the circumstanc-
es, and in vier of the fact that the Ackerman Boat Company owned a
foundry in Costa Mesa, Commissioner Patterson said he would oppose
the granting of a permit to erect a, foundry in Newport Beach on the
ground that it was not necessary for war purnoses. Thereupon, Com-
missioner Finch withdrew his motion. Commissioner Patterson moved
that the application of the Ackerman Boat Comna.ny be denied. Motion
seconded by Secretary Seeger, unanimously carried. and so ordered .
REPORTS OF
Commissioner Finch, Chairman of the Post War Planning Commitee, E ITTEES
sucg�ested that in the absence of Chairman Hopkins, his report
on Item 3— Harbor Facilities and Expansion — be postponed until

the next regular monthly meeting of the Commission , in which
surrgestion, the Commission concurred.
ADJOURNMENT '
Commissioner Ps.tterson moved that the meeting be p.djourned
subject to the call of the Secretary. Motion seconded by
Secretary Seager, carribd and so ordered.
