The Newport Beach City Planning Commission held a regular meeting, Thursday,
May 19, 1949, with Chairman Ion�Tmoor presiding.
Commissioners present: Ccpelin, naniell, rllerbroek, Johnson, Longmoor, ROLL CALL
Johnson, Longmoor, Pleger, Rudd and 'siightman.
'Commissioners absent: Baltz.
Commissioner Johnson made the motion, seconded by Commissioner Pleger for the MINUTES
approval of the minutes of the Special Weeting on May 6, 1949, and the re-
gular meeting on April 21, 1949, which carried, and so:'ordered.
Final hearing upon the petition of property owners of Tract 1026 to rezone PUBLIC HEARINGS
those lots on the so,_.therly side of Ocean Boulevard and westerly from.the
extension of Larkspur to the roadway which runs to the beach, from R -1 to '
R= 2,.was declared, with Chairman Longmoor^ explaining that this matter is being
considered by the Joint Committee, composed of members of the Council, Plan-
ning Commission, Corona del 16ar Civic Association, and property owners, and
that action would be tabled until recommendation is received from that commit-
tee. Several property owners were present, in protest, including Mrs. Robert
Lynn, who wanted to go on record as being opposed, as spokesman for the Corene
del Mar Association „ although = "no vote was taken ", and _mx. J. B. Stoddard, 225
Jasmine, who could see "no connection between the 'road matter' and this peti-
tion", adding that he "actually favores this R -2 zoning, ", but felt that the
house tons should not extend above Mean Boulevard. After discussion by the
Commission, Commissioner Copelin made the motion, seconded by Commissioner
Rudd that the hearing be closed, which carried, and after which Commissioner
Johnson made the motion, seconded by Commissioner Copelin that action be tabled
for further consideration, which carried by unanimous roll call vote, all Com-
missioners present, except Comm- ssioner Boltz.
'Hearing upon the ap ^lication of Dorothy Clark Schmid for a 50% setback variance
on the alley side of Lot 7, Block 6, Section 1, Balboa Island, was declared,
same havin;� been duly filed and advertised. Property ov;ner next to the Schmid
property, Mr. Angus Potter, 227 Pearl Avenre, spoke in protest, stating that
P•:rs. Schmid's plans will be injurious to his property,.ane contended that the
roof of the proposed car port, (application stated plans were for one corner to
extend one foot an,' a half from the alley), "will be right under my apartment ".
,,'rs. Schmid explained that two alleys intersect at her lot, and the angle of her
lot is such that it would be very difficult to use the other part of her lot for
the proposed car port. Secretary Copelin stated that he had investigated the
property with Par. Nelson, and felt that I'rs. Schmid has the right to extend to
her property line, through the variance request, so favored recommending the
application. Commissioner Pleger made the motion for closing the hearing,
which carried after being seconded by Commissioner Daniell, after which Commis-
sioner J'ohnsom.made the motion: for the approval of recommending this applica -.
tion, which Commissioner Pleger seconded and carried by unanimous roll call vote
all Commissioners present, except Commissioner Baltz.
Hearing upon the application of Doris A. Granicher for a 2 foot front yard set-
back variance for Lot 8, Block 3, Section 1, Balboa Island, was declared, same
having been duly filed and advertised. After reading the application, Secre-
tary Copelin read letters of protest from Mrs. George Lake and Pairs. Gladys K.
++hite.. Pairs. Granicher was present with'a petition, favoring her application,
bearing the names of seven adjacent property owners, and spoke urging approval
'of her application, stating that the lot south of hers as granted a setback
variance, nnP as a result the house thereon cuts off her view. Commissioner
Johnson stated that "if granted this would amount to 'spot zoning'. PQr. Wise,
Planning consultant, stated that he felt that this -otter should be decided on
the basis of whether there are hardships, or practical difficulties involved.
Commissioner Pleger made the r:oti.on for closing- the hearing, which Commissioner
Daniell seconded, and which carried, and Commissioner Pleger then made the mot-
ion that this application be approved, which Commissioner Daniell seconded, and

S^TX BUSI MSS 'r. J. B. "s'ebb, City Engineer, presented the proposed Sub - Division of
Lots of Tract 1210, City of Neeaport Beach, to the Commission, explain- ,
ir_g.that same is being requested merely for easier handling, of the leases,
(for the owner, The Irvine Company), as now same is by metes and bounds.
After consideration, Co:missioner Copelin, seconded by Commissioner John -
don made the motion for approval of same by the Commission, which carried.
Also presented by Pas. Webb was Tentative P:iap of Tract 1220, for recommend -
ation,to the Orange County Planning Commission, and which Pair. 'Webb ex-
plained as being the tract ji;.st east of Irvine Avenue, between Cliff Drive
and the bluff, which, after consideration, Commi- ssioner Johnson made the
motion, seconded by Commissioner Copelin, for approval. P7otion carried
and so ordered.
Pars. Lynn, of Corona del P;ar, stated that a group of property owners in
B1ock'131, Corona del Ear, had presented a petition to the Council, which
ordered same referred to the Plarnin7 Commission. Secretary Copelin, how-
ever, advised irs. Lynn that this petition ha' not reached the Commission,
but that search would be made so that same can be advertised for hearing
at the next meeting.
Secretory Copelin announced that he was in receipt of a copy -of proposed
Ordinance 11o. 593, an ordinance for defining 9-two-family dwellings ", as
referred by the City Council, and made the motion, seconded by Commission-
er Fiighman, to set Public Hearings for same, the first hearing to be at
the next regular meeting on June 16, 1949. Liotion carried. '
Secretary Copelin also announced that he had received an application from
the Union Oil Cempanp, requesting an.amendsient to ordinance Puo. 525, for
increased storaf'-a for Class "A" and other petroleum products in excess of
the limits imposed by paragraph 2, Section 7, and paragraph 2. Section 8,
and accordingly Commissioner Pleger made the motion, seconded by Commis-
sioner Ell.erbroek, to hold public hearings on this, setting the next re-
guL °.r meeting, June 16, 1949, for the first hearing. Motion carried.
ADJOURNTIENT Secretary Copelin made the motion for adjournment, seconded by Commissioner
Rudd, which carried and the Commission adjourned for informal meeting, to
inspect and consider. charts and maps, prepared by Hr. Wide, Planning Con=
sultant.
