MINUTES: Minutes of the meeting of April 21, 1955 were approved on motion of Cam. Reed, seconded by Cam. Rudd, and carried. Set over from April 21, 1955 hearing. Application of Constance Burnham to allow a rectangular corner parcel with a 40 foot frontage on Balboa Blvd, and a 100 foot depth along "F" Street subdivided by metes and bounds by a previous owner to be recognised and used as a legal building site. City Code section 9103.35 requires a mi*;sts" width of 50 feet and an area of 5,000 square feet.for corner lots in the Balboa Peninsula area. The property is located on the southwest corner of Balboa Blvd. and "F" Street at 1327 East Balboa Blvd, FINDINGSs The property is larger then adjacent and aurrounding'lots and the building on the 55 foot wide parcel to the vest will have a side setback of 21 8" from the common lot line allowing circulation around the building on its own parcel. No objections were received. The parcel, if recognized, would be lose of a- problem with a dwelling on it then as vacant property. CONDITIONSs Building site to be as per Survey Map by Jack Raub, License No. 2312, Job No. 4105 dated April 30, 1955 The hearing was closed on motion of Cam. Copalin, seconded by Cam. Rudd, and carried. Gam. Lind moved that the application be granted, seconded by Cam. Copelin, and carried by the following -roll call vote, to -wit: ALL AYES Application of Terry C. Bennett to allow a parcel consisting of the westerly 30 feet of Lots 1 and 2. Block 5 of East Newport Tract and with 30 foot frontage on Bay Ave. and a 60 foot depth along an alley and illegally subdivided in 1947 to be recognized and used as a legal building site. FINDINGS: The property containing 1500 square feet was divided and Lots 1 and 2, sold by metes and bounds in 1947 and beams a non - conforming building Blk. 5, E.Npt.Tr. site. Due to increase in property values it has reached a sale price too high-to restore the lots to their original condition. Lots 1 and 2 Granted are in an R-2 District. R•cobd lot sizes in this area are 30 feet by 70 feet. The Planning Commission has initiated a resolution of intention to change soning on the property to R..3, which will limit the number of unite to one for- each.1000 squaib feet of ground area. (See Planning Commission Resolution No. 594) The hearing was closed on motion of Com. Copelin, seconded by Cam. Hayton and carried. Casa. Hayton, and carried by the following roll call vote, to -writ: ALL AYES Application of the Irvine Co. and Macao Corp. for a rear yard setback of five feet six inches for a detached garage, on Lot 79, Tract No. 1700 V - #228 and located at 601 Patolita Drive on the NW corner of Patolita Drive and Dolphin Terrace. Irvine Co. FINDINGS: The 5' 6" rearyard setback will not be detrimental since there & is no prospect of any future alley development in the block, and a larger Macco Corp. patio will be possible for the applicant. The hearing was closed on motion of Com. Copelin, seconded by Com. Lind, Tr. and carried. Con. Lind moved that the application be granted, seconded by Com..Hayton, and carried by the following roll call vote, to -wits ALL AYES #1700 Granted 150 (shown as Parcel 1 on the application) Application of Courtney C. Platt to resubdivide Lots L9�nd 49 Resubdivision Tract No. 1133 by attaching a portion of Lot 49 ^to Lot 39 so as to #9 provide access to Ocean View for Lot 39. Parcel 1 contains about 900 squaf'e feet and the remaining portion of Lot 49 contains about Platt, Bourtney8500 square feet. The property is located .between Ocean View Ave. and Riverside Ave. above the Credit Bureau behind the All American Lots 39 & 49 Market. Tr. #1133 FINDINGS: The purpose of this subdivision is to give Lot 39 access to Ocean View Ave. for ingress and eggress of automobiles. The Granted building site area of Lot 39 is closer to the level of Ocean View Ave. than its frontage street Riverside Ave. The divided Lot 49 will have a greater area after the out than that required by any City Ordinance. The hearing was closed.on motion of Con. Copelin, seconded by Com. Ragton, and carried. Con. Gopelin moved that the application be granted, seconded by Cam. Nayton, and carried by the following roll call vote, to -wits ALL AYES USE PERMITS Application of Paul C. Jones to permit a real estate blackboard advertising sign 12 feet wide by 5 feet 10 inches high to be placed U.P. - #173 on an adjacent property. The sign is proposed to be located on Lot 120 Block 224; Section A. Newport Beach Tract in a C -1 District and is to Jones, Paul C. advertise the Real Estate office located nest door on Lot 11 at 2624 Newport Blvd. Lot 12, Blk. 224,FINDINGS: A letter was received from Mary Snttora, owner of the Section A property whereon the sign is to be placed, stating that Mr. Jones Npt. Beach Tract is renting the property 8rom her and has her permission to place the sign at the front property line. The property is all in a C-1 District. Granted CONDITIONS:, the Use Permit shall be limited to a one year period and shall terminate on June 3, 1956. The hearing was closed on motion of Cam. Copelin, seconded by Com. Rudd, and carried. Com. Keene moved -that the application be granted in accordance with the conditions, seconded by Cam. Reed, and carried by the following roll call vote, to -wit: ALL AYES Application of Joseph Decker to remodel an existing non- oonforning U. P. - #175 single family dwelling with a five foot front yard setback and a three foot separation between dwelling and accessory building in an Decker, Joseph R^2 District on property described as Lot 3, Block 13, Section 3, Balboa Island, and located at.304 Ruby Avenue. District Map No. 14 Lot 3, Blk. 13,requires a ten foot front setback, Code Section 9105.4 (f) requires Section 3 six feet setback between buildings. Code Section 9105.7 (g) requires Balboa Island a Use Permit for structural alterations to a non - conforming building. FINDINGS: The building is non- conforming due to the front yard Granted setbaok being less than the required ten feet, a separation of.only 3 feet exists between house and garage where 10 feet is required and a portion of the front part of the house which extends into the 3 foot north side setback, also an illegal extension of the garage roof and a masonry barbecue. The neighbor on the north objected to any violation of this north setback. CONDITIONS: All existing portions of any buildings or structures on the property shall be out back to the 3 foot side setback line except that saves can overhang one foot into said setback and the existing fireplace in the dwelling can remain as is. The barbecue in the rear north side setback shall be moved out of any setback areas. The hearing was closed on motion of Com. Copelin, seconded by Com. Reed, and carried. Celt. Reed moved that the application be granted.in accordance with the conditions, motion seconded by Com. Beene, and carried by the ' following roll call vote, to -wits ALL AYES Application of J. S. Barrett to operate an outdoor trailer sales estab- lishment and trailer show space with an area of 500 feet by 400 feet on a portiom=of Lot A in Tract No. 919 and.located at 2200 West Coast Highway in a C1 -H District. FINDINGS: A sufficient area for off street parking exists in the 407 foot by 500 foot area to be used. A trailer sales will net be detri- mental to any surrounding business area. The residential district to the rear has a much higher elevation than the commercial district and overlooks it. The hearing was closed on motion of Cam. Copelin, seconded by Com. Rudd, and carried. Com. Rudd, moved that the application be granted, "cohded'by Com. Lind, and carried by the following roll call vote, to -wit: ALL AYES 151 U.P. - #176 ,Barrett, J.S. Lot A. Tract #919 Granted Application of F. Robert Vaughn to operate an outdoor sales display U.P. #177 of pleasure craft (boats) in a C 1 -H District on Lot 57, Tract 1210 and located at 1600 W. Coast Highway. The applicant has a five year Vaughn, F. lease on an office to transact business in the office building on an Robert adjacent lot to the West. Section 9103..52 requires a Use Permit. Lot 57, Tr. 1210 FINDINGS: A plan has been submitted showing a display area 32 feet ' wide by 20 feet deep at'the front with a driveway on each side, one for in- traffic and one for out- traffic for a Central Parking area 4.1 Granted feet deep by the 55 foot width of the property with 6 parking spaces across the inside width and a display area 55 feet wide by 40 feet deep on the rear portion of the lot. CONDITIONS: 1. Accessable and useable off - street parking for 6 cars shall be maintained as shown on the plan attached to the application and described above under findings. 2. This Use Permit shall be limited to a period of five years to coincide with a lease of the herein described property by the applicant with the Irvine Co. and shall terminate at any time said lease shall be broken or terminate in any way previous to the five year termination date of the Use Permit. The hearing wav closed on motion of Com. Rudd, seconded by Com. Lind, and carried. Com. Rudd moved that the application be granted, in accordance with the conditions, seconded by Com. Rayton, and carried by the following roll call vote, to -wit: ALL AYES Letter from Dr. David I. Nielsen, M.D. for an extension of time for an Request for additional six months for Variance No. 177 for a 5 foot frontyard extension of setback. The Variance will expire by automatic termination May 220 1955. time on Additional time is needed to complete financing and make small design Variance #177' changes. Construction is expected to begin in about two weeks. An extension of time for an additional six months for Variance #177 was granted on motion of Gom. Reed, seconded by Com. Rudd, and carried. 152 Resolution #593 Amendment #12 discussion It is desired by the Building Dept. to have regulation on the projection of chimneys and fireplaces into side yard setbacks, and regulation on roof overhang into the rear yard setback. FINDINGS: Section 9105.4 (a) of the City Code regulates the projection of architectural features such as eaves, cornices, and canopies and limits their extension to 2* feet for "any eave overhang into a rear yard setback. For a mmber of years the Build- ing Department has allowed fireplaces and their chimneys to project 13 inches into a three foot side setback provided the other side setback was kept clear. This allowance is actually illegal under the present side setback provisions of Ord. #635. the allowance has continued for so long that it has become an accepted fact and a large percentage of houses have their fireplaces so located, and the general impression is that the condition is legal.'. ' On motion of Com. Lind, seconded by Com. Rudd, and carried,a motion was made to hold hearings on Proposed Resolutioi #593 to amend Section 9105.4 (a) to read: "Architectural features such is cornices, eaves, and canopies may extend not exceeding two and one half (2J) feet into any required front or rearyard setback." and Section 9105.4 (b) to read: "None of the above mentioned architectural features may encrouch within two (2) feet of any side lot line. Fireplaces and chimneys not to exceed nine (9) feet in width, con- structed of incombustible material may encroueh to a distance of two feet from the side lot line providing the.other sideyard setback in the same property is kept clear as a passageway." Request of Bob Dalton regarding off - street parking for his restaurant Parking area located on Lot 1, Tract #1235. for Com. Lind made the following motion, seconded by Com. Keene, and carried: Bob Dalton's "in view of the fact that applicant "has made arrangements for parking restaurant area across the street by means of a lease, the requirements of the Ordinance be waived in regard to off - street parking."
