MINUTES OF THE PLANNING COMMISSION MEETING, THURSDAY, MAY 200 1954, - 7130 PM

Chairman Longmoor called the regular meeting of the Planning Commission to order.
ROLL CALL:

MINUTESs The minutes of the meeting on April 15, "1954 were approved upon motion
of Com. Hayton, seconded by Com. Lind, and carried.
Referred from City Council for re- investigation and another public VARIANCES:
hearing. The application was approved by the Commission during the
April 15th meeting. The Council made a motion during their April 26th V - #134
meeting to grant the Variance. However, with objections from the floor
the motion was withdrawn and the Variance set over until the next Lane, A. W.
meeting. During an adjourned meeting of April 30th the matter was
ordered referred back to the Planning Commission. The property was Lot 3, Tr. #1026
again posted in two places and the notice of hearing published in the
legal newspaper. Application #134 is as follows: GRANTED
Application of Mr. A. W. Lane for permission to construct a three
story dwelling in an R-2 district with a maxtmun height of 27 feet on
Lot 3, Tract #1026, and located below the bluff at 901 Ocean Blvd. The
top of the building will be 24 feet below the level of Ocean Blvd. and
' access will be from a street below the bluff. A maximum of two stories
is allowed by Section 9103.32 of the City Code.
FINDINGS: The construction of two adequate dwelling units with garages
within the 2 story allowance would not properly develop the property.
If the units are constructed as two separate structures the land
preparation cost would be prohibitive due to the ground contour. The
top of the proposed.building will be well below the level of Ocean Blvd.
and thus will not restrict the view. -Mr. Ted Russell and Mr. Wm. J.
O'Keefe were both present to object on the grounds that they think two
story limit should be enforced.
The hearing was closed upon motion of Com. Copelin, seconded by Com.
Hayton, and carried.
Com. Hayton moved that the application be granted, seconded by Com. Lind,

Application of Evelynne S. Pahl and Dr. Blythe W. Pahl for permission to
subdivide Lots 2, 3, and 4, Block 14, Section 1, Balboa Island into two V - #139
Rr2 parcels with reverse frontage on Park Ave. The property is located
at the northeast corner of Park Ave. and Topaz Ave., Balboa Island. The Pahl, Blythe
said 3 lots have been welded into one R-2 parcel by construction of a &
triplex on the 2nd floor across the rear with four garages and an extra Evelynne S.
guest room on the first floor, which allows a possible four rental units.
The proposed division into two parcels would be as follows: Lots 2,3,4,
PARCEL #L - consisting of the easterly 40 feet of said Lots 29 3, and 4 ^lk. 14,Sec.1
with 40 foot frontege'on.Park Ave. by.90ifeet deep - -along the•all6yand Bal.Island
consisting 6f= 3600•square feet. This pareel' would contain the

PARCEL #2 - consisting of the westerly 45 feet of said Lots 2, 31
and 4 with 4,050 square feet and with 45 foot frontage on Park
Ave. and 90 feet deep along Topaz Ave. This portion is now '
vacant.
The hearing was declared open.
FINDINGS: The property as subdivided hereon creates two parcels
each of greater size than recorded lots in the same subdivision.
A standard recorded size of lots on Balboa Island is 30 feet wide
by 85 feet deep. The subdivision as proposed would allow the owner
to properly develop his property without any detrimental effect on
adjacent property.
CONDITIONS imposed upon Variance #139: Said two reverse frontage
parcels shall each be limited to R-2 district restrictions and
limited to two single family units or a duplex.
The hearing was closed upon motion of Com. Copelin, seconded by

FINDINGS: The proposes subdivided parcels #1 and #2 as described
above are of greater size than the standard 30 ft. by 118 ft.
recorded lot in the same subdivision. Said Parcel #1 contains the
applicants existing house, and the proposed Parcel #2 is to be
available for sale as a building site. This will allow the owner
a better disposition of his property. A petition bearing five
signatures of surrounding property owners stating they had no
objections to the resubdivision, was presented. The hearing was
closed upon motion of Com. Copelin, seconded by Com. Briggs, and
carried.

FINDINGS: The proposed 30 inch overhang described herein is consistent
with previously permitted variances and with existing structures on
adjacent and surrounding property and will not be detrimental to
surrounding properties.

Application of Ted R. Tapfer for permission to construct his lower floor
garage with a 15 foot setback on Shorecliff Road on Lot 47, Tract ,#1116, V - ;`142
commonly known as Shorecliffs Subdivision, and located at the northwest
corner of Shorecliff Road and Driftwood Road. The tract restrictions Tapfer, Ted R.
determine the lot to face Driftwood Road.
Investigation by L. M. Holbrook, after a complaint, showed the facts Lot
to be as follows: Mr. Brownell, Architect, and Mr. Nelson, Building
Inspector, decided that the tract restrictions took precedence over the
City Code and the man was granted a building permit. The job progressed
to the forming stage for foundations. Districting Map #20 shows a 20 foot
setback along Shorecliff and a 30 foot setback along Driftwood Road with
a possible continuance around the corner to the westerly lot line of said
Lot 47 with the 30 foot setback. There is a dividing marker at approxi-
mately this point. The City Code does take precedence over any tract
restrictions and the job was stopped pending a decision by Variance.
Mr. Harwood, attorney, the owner of and resident on Lot 48, adjacent to
the west, called to voice his objections, as did Mr. 0. Z. Robertson,
contractor, who owns Lot #17, located at-206 Driftwood Road.
The hearing was declared open.
The committee recommended that building setback lines from street fron-
tages be established and recorded for this subject Lot #47. No action
taken on this recommandation•.
The hearing was closed upon motion of Com. Copelin, seconded by Com.
Hayton, and carried.

FINDINGS: Second story overhnns as described herein have been
allowed and are now existing on surrounding properties in the various

sections of Balboa Island. Such a restricted overhang is not
detrimental to adjacent or surrounding property.
CONDITIONS: The apartment over the garage is to be joined to the
existing front house to eliminate the center court area setback
requirements between buildings. Said joining to be done b9 bridging
the court area so the apartment will bear on the house rear and
thus join the two by a common wall. The garage is to be clearebut
and a minimum cleared space of 16 ft. by 20 ft. to be maintained for
automobile parking within said double garage.

which property is in an R�3 district. The ground area is 60 feet by
102 feet with 6,120 square feet.
The hearing was declared open.
There were no protests.
CONDITIONS: Two legal parking spaces with a minimum size of 8' x.201
must be maintained on the rear of property and the existing driveway
in the front must be retained and kept open for parking. Three
upstairs bedrooms may be used, but an upstairs room which does not
meet minimum floor area or dimension requirements may not be used for
any rental or sleeping uses under this permit. Use limited to seven
roomers.

east from said lots 1090 and 1091, Tract #907 and which permit in effect Lots 1090 &

Commissioner Keene observed that the parking conjestion due to
parking in the alley could not be used as an argument since there
is an ordinance against parking in an alley and that the parking
conjestion was possibly due in part to the objectors themselves.

DENIED
FINDINGS: The use applied for is a commercial accessory use on
a pier in the bay opposite R-4 zoned property operated as a Cafe
(Christian's Hut). The application does not qualify under Section
9103.42 on page 106 of the zoning law. The application is for a
commercial use other than those specifically listed and therefore
may not be construed as a permitted use under Section 9103.42 (a)•
The Committee does not consider this application to be qualified
for Use Permit under Section 9103.8 or 9103.81. The waters of
Newport Bay and the land under the bay should properly be subject
to the land use regulations of the uplands immediately adjacent
thereto. The committee recommends that the application be
denied. A petition bearing four signatures stating they.had no

A letter was received from the League of Civic Associations, reaffirming re. billboa
its stand regarding the elimination of billboards in the City. On in the city
motion of Com. Briggs, seconded by Com. Hayton, the letter was ordered
filed.
A request from the City Engineering Dept. to change the following
street names, by procedure as set up under Article 13, Sections
65711 to 65715 of the Government Code of the State of California:
- Short St. to Broad St. (thus becoming a continuation of the
existing Broad St.)
- Old County Road to Clay St.. (thus becoming a continuation of
the existing Clay St.)
- Newport Blvd..north of the Arches to North Newport Blvd.
(These changes are necessary to avoid confusion and to prope4y
renumber the area) t
- First alley north of Balboa Blvd. between 18th St. & 19th Ste
to be named Vilelle Place.

Andrews Road, 15th St., and a circular alley which is adjacent to
Lots 31 to 35 inclusive of Tract #1220 and lots #142 to #146 inclusive
