Commissioners Frederickson and Balalis stated.th preference to defer this item until it has been given proper public notification. Alex Bowie appeared before the Pl.anning Commissi on behalf of the applicant, Mr. Manto, to reques that they be allowed to present the application at this time. Commissioner Agee stated that hearing this item at this time would necessitate a duplication of efforts that it would be necessary to repeat aft the public hearing notices are sent. Initiated By: City of Newport Beach *Commissioner Haidinger arrived at 8:30 P.M. The Public Hearing was opened regarding this ite and James Gottier, Daon Corporation, appeared be fore the Planning Commission to offer their inpL regarding this subject. He expressed his feelir that each condominium project should be reviewer on the basis of its own merits, as each is unigL unto itself. He stated his further opposition t excluding a conversion because of factors exterr to the project, and conveyed his feeling that tt vacancy factor discussed in the ordinance is se- vere, and of an arbitrary nature not relating di rectly to the low -cost housing problem. A discussion regarding Section 20.73.06 was undE taken, and Commissioner McLaughlin stated her of position to exempting 4 units or less, as she fE this would exempt a large number of rental unit! Commissioners Cokas and Agee suggested that a ci off was appropriate, and that they felt 4 or fey dwelling units was adequate. Request to establish a take -out facility with on- sale beer and wine in Lido Marina Village where r tail space now exists. Ruby, General Partner, L Angeles The Public Hearing was opened regarding this iten and James Parker, representing the applicant, ap- peared before the Planning Commission to state hi concurrence with the conditions in the Staff Repc and to comment that they had reduced the parking rate in the structure. Mr. Parker then expressed his feeling that there would even then be employees that would choose no to park in a high -rise parking structure. Bob Inch, Director of Operations at Lido Village, appeared before the Planning Commission and state that the parking charges are as follows: a) em- ployees, $1.00 a day b) public, 35¢ an hour c) validation to merchants at 12�t an hour. REMOVED FROM THE C L� ENDW COMMISSIONERS ROIL C City of Newport Beach May 24, 1979 ALL Richard Hogan, Community Development Director, exf lained that the City Council is considering an or- dinance regulating the use of roller skates on pu- blic streets within the City; furthermore, that tf .proposal would not apply to those businesses whic are now in operation, which would be considered as non - conforming. Commissioner Beek asked whether there would be a % in which to include established roller skate estal lishments in any newly adopted policy, to which Hugh Coffin, Assistant City Attorney, stated that amortization provisions may be put into an ordinal to apply retroactively to existing uses, to which Commissioner Beek proposed for consideration that a one year amortization be included in this and tl it.apply to all roller skate rental establishment! The Public Hearing was opened.regarding this item Mr. Kazer, owner of Balboa Skate Company on Balboi Island, appeared before the Planning Commission to state his opposition to banning or restricting ro' ler skate rental establishments in the City. Commissioner Balalis inquired regarding the hours operation of his roller skate rental establishmen to which Mr. Kazer responded that they closed on ter week nights at 6:00 p.m. and 9:00 p.m. on the weekends and during the summer the skates are in 1 10:30 p.m. - 11:00 p.m. and that they have an ove night rental program. Chuck Avery, 129 Via Waziers, appeared before the Planning Commission to state his definite opposit to roller skating as a commercial enterprise in t City of Newport Beach, allowing a business to tak over the public sidewalk, and the added congestio it brings. John Shea, 2214 West Ocean Front, appeared before the Planning Commission to state his support of tl ordinance before the Planning Commission, further expressing his feeling that these roller skate rel tal establishments should require a use permit, a! they parallel the roller skating rinks, including i concerns for: parking, hours of operation, intens, of music, safety and security of the skaters, ef.fi I on surrounding community and methods of advertisii i I Scott Halfer, Ocean Front Bicycles, representing i I of the roller skate rental establishments, appear before the Planning Commission to state his suppoi of some sort of planning as to how the roller ska and roller skate rental establishments should be gulated, suggesting .a skateway or another boardwa' for skaters to minimize danger. Sheri Silver, Silver Skate Company, appeared befo the Planning Commission to state her feeling that. there is some type of ordinance necessary, sugges ing a skate patrol and backpack use with eme »gent; equipment, further stating her opposition to:park requirements, as those frequenting the roller ska rental establishments are coming to Newport Beach anyway, and expressing her concern regarding busi hours control, pointing out that other businesses don't have the degree of controls suggested for r ler skate rental establishments. Commissioner Beek stated his.preference to gettinc the use permit procedure for roller skate rental e tablishments going. Commissioner Frederickson suggested that perhaps tree could be trimmed, so that the additional re- quested height of the signs would not be necessar, Richard Hogan, Community Development Director, ex plained that previously the Site Plan had two con flicting conditions. Commissioner Agee then summarized his understandi of the request as that in which the applicant doe not feel that the signs would be functional if thel+ abide by the staff's recommended conditions. Louise Greeley, 16 Swift Court, appeared before t Planning Commission to state her opposition to tF project, due to the congested traffic and parkinc problems in the area. John Dreyden, 2236 Via Lido, appeared before the Planning Commission to express his concern that t Lido Sailing Club will cease, yet they would be r taining the Harbor Permit for the Sailing Club tc be held by the association members, stating his feeling that this proposed development is in oppc sition to the efforts of the City's Local Coastal Program, and is injurious to property in a minimi way, and in conclusion stated his agreement with two findings for denial, as set forth in the Stai Report. Jerry Rest, Applicant, appeared before the Planni Commission to state his intention to reduce the ( mands of the area by their proposal, and to prodr a project that would be financially equitable for them.
