THE NEWPORT BEACH CITY PLANNING COMMISSION met In
adjo urw d regular session Wednesday, May 29, 1940;
7 :30 p.m. in the Council Chambers, City Hall; Chair-
man Hopkins presiding.
Meeting- called to order by the Chairman.
R6LL CALL -
Commissioners present: Hopkins, Seager,'Allen,
Briggs, Estus, Patterson, Williams.
Commissioners absent: Findlay, Hodgkinson.
MINUTES -
This being an adjourned meeting, the minutes
of the previous meeting were not considered.
HEARINGS
First Hearing- On Rezoning Blk 634, Canal
Section, from R -2 to C -1.
Secretary read the legal notice of public
hearing as published. He stated that this matter
came before the commission in the form of a petition -
signed by 7 property owners in the block and was
referred to the Planning Commission by the City
Council.
Chairman declared the hearing open for dis-
cussion.
Mr. Rogers, one of the petitioners, stated that
the reason they are asking this rezoning is so that
those residents in the block who are engaged in
business will be able to have a sign on their propel
ty advertising their business. There are several
such signs in existence at the present time illegal-
ly. The desire for rezoning 1s unanimous in the
block, although not all of the property owners
have signed the peLttion.
Per. Paul Palmer, representing the Griffith Co.
stated that the Griffith Company is trying to develop
this section as a high class business district of
which the Lido Theatre is an example. If a building .
restriction can be placed on this property so that
the development will be comparable to the develop-
ment already done and contemplated by the Griffith
Company, they will have no objection to the rezoning;
of thie,property; however, if there is no restrict -
ion as to the type of business structures to be al-
lowed they do object. This street is apt to become
the most prominent street in town and anything
that opens the door to other.than substantial and

Sightly development in this section should be avoid
ed.
Mr. Rogers stated that there is 70 feet between:
this property and the boulevard and he considered
it impractical for any business buildings to go
in 70 feet back from the Highway.
Com. Estus moved that the rezoning of Block
634, Canal Section from R -2 to C -1 be passed to
second hearing June 19, 1940.
Seconded by Com. Briggs.
Motion carried and so ordered by the Chairman.
First Hearing - On Billboard Ordinance
Secretary read the legal notice of hearing
as published.
Chairman declared the first hearing on the
amendment to Ordinance 440 having to do with the
regulation, erection and maintenance of billboards
open for discussion. He called for a report of the
committee appointed to meet with the City Attorney ;
and interested parties to look into this matter.
Secretary Seager stated that the Chairman's
letter appointed a committee arrived subsequent to
the scheduled meeting and that and that Coms. Pat-
terson and Allen and the Secretary had met with the
.City Attorney and representatives of billboard
concerns. He reported that it had been decided at
that meeting that a simpler method of regulation
could be devised by amending Sections 2 and 17 of
the Ordinance. Secretary read the substitute amend -`
ment as prepared by Attorney Thompson.
It was brought out in discussion that this
amendment would not effect the present billboards
in any way unless the text of the sign is changed;;
at this time it must be approved by Planning Com-
mission or their representative.
It was Chairman Hopkins' opinion that it
would be necessary to amend R -1, R -2 and R -3 to
include billboards as uses not permitted in these`
zones.
Secretary said it was the City Attorney's
opinion that this ordinance would stand a court test:
while the amendment as previously written was
doubtful.
Representatives of Foster and Klieser and the
California Gas and O11 Association were present
and both stated that they wished to discuss this
new amendment with their company attorneys and has
no statement to make at this time.
Com. Patterson moved that the amendment to
Ordinance 440 regulating billboards, pass to second
hearing June 19, 1940.
Seconded by Com. Allen.
Motion carried and so ordered by the Chairman.
First Hearing - On Amendment to Ordinance 440
RE: Front Yard setbacks on Balboa and
Channel Islands.
Secretary read the legal notice of hearing as
published.
Chairman declared the first hearing on amend-
ment to Ordinance 440 establishing a °5 ft. front
yard setback in lieu of the present 10 ft, setback
on Balboa Island and Channel Island open for die -
cussion.
Com. Patterson presented for examination by
the Commission & district map of the Island upon
which setbacks on all existing buildings were
shown.
It was Secretary Seager's- opinion that to pass
this amendment establishing a 51t. setback on all
lots on the Island would be a grave injustice to
property owners who have setback 10 ft. The com-
mission by this act would be doing more to depreciate
property values than anyone else.
Com. Estus concurred with Secretary Seager.
He suggested that the Island should be considered.'
block by block and an average setback line establish -'
ed for each block. This work could be done by the
City Engineer, establishing an average setback.
The question of the legality of this procedure
was discussed.
Com. Estus moved that Come. Patterson and Allen
be appointed as a committee of two to contact the
City Attorney and determine whether or not this
proceeding would be legal.
Seconded by Com. Williams.
Motion carried and so ordered by the Chairman.
Com. Estus moved that the amendment to Ordin-
ance 440 establishing a 5 ft. setback of all lots'
on Balboa and Channel Islands be sent to second
hearing June 19, 1940.
Seconded by Com. Briggs.
Potion carried and so ordered by the Chairman.
COMMITTEE REPORTS -
Subdivision Ordinance Committee
Com. Patterson, Chairman of the Subdivision ;
Ordinance Committee reported that he had distributed;
copies of the tentative draft of the ordinance to
members of the commission for study and suggestions.-
Thus far, he had not received reports or suggestions;
from any of the commission.
Com. Briggs said that he had studied the
ordinance carefully and had no changes or suggestion$:
to make.
Com. Seager said his suggestion was that it was"
very well-done and that he approved of all provisions,
thereof.
CORRESPONDENCE
Secretary Seager read the letter he had written'
to Mr. E. Chaplin, as instructed at the last meeting',
in regard to his application for rezoning of Lot 2,
Blk 34, Corona del Mar.
He stated that no further communications had
been received from Mr. Chaplin.
Coma Estus presented a tentative map of
Tract 1061, proposed subdivision of American Legion
property on Bay Avenue, for suggestions by the _
commission.
It was discussed informally.
