HomeMy WebLinkAbout06/01/1938JUNE 1. 1938 THE NEWPORT BEACH CITY PLAHHIAG COMMISSION met in regular session Wednesday, June 1, 1938 at 7:30 p.m. in the Council Chambers, City Hall. Because of the absence of Chairman Hopkins, it was necessary to elect a temporary chairman. Coma Patterson moved that Com. Schnitker act as temporary Chairman. Seconded by Com. Briggs. Motion carried. ROLL CALL Commissioners present: Seager, Briggs, Schnitker, Whitson, Patterson. Commissioners absent: Hopkins, Williams, Findlay. Attny. Thompson and Bldg.Inep. Nelson attended. MINUTES Chairman asked the pleasure of the commission regarding the minutes of the meeting held May 25, 1939• Com. Patterson said that the word "exceed" should be added to the estimate given on the cost of the Balboa Ocean Front development. With this correction made, Com. Briggs moved that the minutes of May 25th be approved as written. Seconded by Com. Patterson. Motion carried and so ordered. • HEARINGS APPLICATION FOR VARIANCE of Tom D. Atkins, owner of Lot 12, Blk 6, Sec 5, Balboa Island for a 50 %, 5 ft. front yard variance was read by the Secretary. He stated that the hearing had been advertised, . plans and maps posted, notices sent to 11 surrounding property owners and all other requirements of the ordinance complied with. The plans were examined by the commission. B1dg.Inap..Nelson explained the set back average of the other houses now in existence in the block. He stated that - there are no new houses in the block; all of the houses now built are old and most of them are on the back of the lot, although the lot adjoining Dr. Atkins' has a garage within 3 ft, of the front lot line. It was the opinion of the commission that the variance could . be granted since there had been no written protests and since there was no one present to object to the granting of the variance. Com. Briggs moved the adoption of Resolution No. 132, re- commending that a 50 %, 5 ft. front yard variance be granted •to Tom D. Atkins on Lot 12, Blk 6, Sec 5, Balboa Island, and that the same be transmitted to the City Council by the Secretary and a copy filed as a part of the minutes of this meeting. Seconded by Com. Seeger. Passed by the following Roll Call vote: Ayes: Seager, Briggs, Schnitker, Patterson, Whitson. Hoes: Hone. So 'ordered by the Chairman. • SECOH➢ HEARIRG ( OH AMENDMENT TO PERMIT SHOOTING GALUMIES) Attny. Thompson explained the regulating ordinance. He said that it is patterned after the ordinance in force In Los Angeles and he considers it a very good one. It is general in nature and may be changed from time to time as conditions change in the city. As to making the regulations more specific as to the required construction, sound- proofing etc., that is never included in the ordinance, but the City Council is given the power to regulate the construction of galleries by having specifications prepared by the City Engineer which all galleries must use. The City Council may refuse a permit if they do not meet these specifications. In this way the Council controls the type of construction used. Com. Briggs asked if a statement could not be included in the ordinance requiring them to be Constructed so as to be sound- proof. Mr. Thompson said that could be included in the specificat- ions, but should not be included in the regulating ordinance, it is never done that way, The requirements in different locations would be different. The ordinance requires that several notices must be posted in any block where a permit for a gallery is applied for. This gives the surrounding property owners a chance to protest if they do not want it. Com. Patterson said that unless there is definite aeaur ante that they will not make noise, he will not be in favor of it. The type of construction in the Fan Zone at the present time is far from sound -proof and that is where the shooting galleries will be most apt to be put in, also there should be some limit to the number of galleries allowed. Com. Whitson moved that Ordinance 440 be amended by strik- ing therefrom the words "shooting Galleries" and that a new ordinance governing the same be adopted in the form submitted to the City Council. Seconded by Com. Briggs. Com, Briggs said that, although he had seconded the motion for the sake of discussion, in his opinion there should be some mention in the regulating ordinance of requiring sound - proof construction. Com. Seeger asked if striking the words "shooting galleries' from the ordinance would be sufficient. Is it the desire of the commission to permit such a use in all districts? You are opening the doors in all districts except the res- idential. Attny.Thompeon: The Council has aright to deny a permit in any district. It would be permitted in C-1, C -2, M -1 and M-2. cam' Seager :`Generally speaking and particularly under the provisions of this ordinance, I would favor allowing shooting galleries in certain districts, but, as this amend- ment will open all 'districts to this use, until it can be more definitely regulated, I vote "No ". Com. Briggs concurred with Com. Seeger's statement, and voted "No" for the same reason. Roll call vote: Ayes: Schnitker, Whitson. Noes: Seeger, Briggs, Patterson. Motion lost, The Secretary was instructed to transmit a report of the ` action taken on this matter to the City Council. COMMUNICATIONS Secretary read a letter from Mr. Tilton stating that he may not be able to attend the meeting to be held June 15th due to the Planning Convention in Minneapolis which he is to attend. His bill for services as consultant was included in the letter. Com. Seeger moved that the bill for services rendered by Mr. Tilton as consultant, be recognised and that the com- mission attest this to the City Council. Seconded by Com. Whitson. Motion carried and so ordered. Com. $eager stated that he had received a telegram from Mr. Tilton saying that he would be present at the meeting to be held June 15th, BAIT STAND Bldg. Insp. Nelson asked the advice of the commission on allowing Mr. Fowler to move the Real Estate office across the Highway onto his property and remodeling it for a bait, stand. Mr. Fowler was present and stated that it will be an im- provement, as he will paint the roof and repair the building to make it attractive and much superior to the present bait stand now in use on his property. It is to be a temporary stand until he erects a permanent building. Mr. Thompson doubted if this could be allowed as the office was constructed as a temporary building and was built under a special permit only issued for Real Estate offices. After discussion, Com. Patterson moved that this matter be referred to the Architectural committee and a report from them given at the next meeting. Seconded by Com. ,'Whitson. Motion carried and so ordered. ADJOURNMENT On motion of Com. Patterson, seconded by Com. Schnitker and,; duly carried, the meeting adjourned.
