Nuzum, Senior Planner Helen Herrmann Shirley Morgan Chairman Jakosky stated that prior to consideration of the agenda items for the evening, there was one additional item that needed clarification under a previous Use Permit Application No..1521 filed by Unger Pacific, Inc., on property located at 3010 Lafayette Street, Newport Beach and that since . he owns property on the waterfront area of the bay and did not participate in the original discussion, he was turning the meeting over to Vice Chairman Watson, Commissioner Adkinson disqualified himself on the same ground and the additional ground that the law firm of which he is a partner represents the mortgage holder of the property involved. Vice Chairman Watson asked Zoning.Administrator. Hewicker to explain to the Commission the suggested amendments to the Use Permit. Mr. Hewicker noted that this application covered the proposed Cannery Restaurant on the existing Cannery site on Lafayett Avenue and Lido Park Drive and that the staff has suggesting additional conditions of approval which were felt necessary to clarify some of the findings of the Commission discussed at the previous public hearings. The following conditions and general statement were read into the record: 1. That tandem parking shall be permitted on site provided that parking attendants are present during the hours of operation of the restaurant. . 2. That this approval shall not constitute endorsement of the landscape features located within the paved area of 30th Street. Page 1. That the parking space illustrated within the service yard shall not be counted as a required space. 4. That the required building setback on Lafayette Avenue shall be waived and build- ing permits shall be issued pursuant to the findings of the Planning Commission as set forth under Section 20.08.270, para- graph E, sub- paragraph (a) of the Municipal Code. General Statement That the findings of the Commission are based upon the unique circumstances and merit of the applica- tion in question and should not be construed as a precedent; That the Commission has noted and offers no objec- tion to the walkway and elevator structure proposed to replace existing encroachments. Vice Chairman Watson added the following clarifica- tion as to the general statement: "The Commissione s felt that tandem parking has not been allowed in the City of Newport Beach, yet in areas such as some of our better restaurants where they.have valet parking, they do stack cars in a tandem fashion and we have found it to be an acceptable practice. Secondly, the walkway proposed is on top of pilings which are of public domain and we felt there might be similar requests in the future regarding public right -of -way on a bulkhead, x Commissioner Brown moved adoption of the motion as x read by Mr. Hewicker x x x x x x x Chairman Jakosky and Commissioner Adkinson returned to the dais. Items 1 and 2 were considered concurrently inasmuch as they relate to the same property. Item 1, Request to permit construction of four duplexes on four lots, each lot having an area of 2,152 sq.ft.. Request to permit a zero side yard setback for MODIFICA garages only and 8 foot high ornamental gates in _7151r— the side yards. Jacobs, Balboa Owner: Same as applicant Zoning Administrator Hewicker explained that the variance request was originally filed and then sub- sequently the applicant filed a modification reques for zero side yard setbacks on the interior and 3 foot setbacks on the exterior lot lines, as well as a request for 8 foot gates in the side yards. Sint the Commission had not had an opportunity to.look at the variance, the Modifications Committee felt that they should review both applications simultaneously, Hazel Jones represented the applicant and; upon being questioned, replied that the 8 foot gates are merely ornamental and also to keep traffic going through from street to street as it was felt that a 6 foot gate could be more easily scaled. Following a general discussion, Variance No. 1004 x was approved, subject to the condition that approval x of this variance shall not preclude compliance with all applicable ordinances in effect at such time as the variance is exercised. Item 3. Request to permit a walk -up restaurant in a C -1 USE District. Zone: C -1 Applicant: Sailor Boy Associates, Balboa Island Owners:. Philip J. and Eileen.Rapp, Newport Be ch Zoning Administrator Hewicker presented the appli- cation to the Commission and explained that this i strictly a walk -up, walk -away type of operation with no patron seating. There will be 3 employees and yearly parking permits will be purchased from the City. While the staff does not necessarily recommend this concept, it has been approved in several instances in the same general area. Staff would also recommend that in addition to the 3 con- ditions suggested in the staff report; that a four h "time limit" condition be added, primarily to see if this will result in a litter problem. Staff also feels that there should be some kind of a marking on 21st Place separating pedestrian and vehicular traffic until such time as 21st Place is made into a pedestrian mall. Mr. Jerry Miller, one of the owners of Sailor.Boy Associates was present and answered questions of the Commission relative to his operation, stating that he did not intend to have bicycle racks and that Mr. Rapp, the owner, had assured him he would have a suitable location for refuse containers. Mr. Fran Ursini, who owns a restaurant on the Ocean Front.spoke in opposition as he feels there are to many restaurants on the Ocean Front now and would prefer another type of business. That the requirements of Chapter 20.53 are waived as- provided by Section 20.53.130 except as they pertain to employee park- ing and signs. 4. That.the application be.approved for a period of one year, at.which time it is to be reviewed by the Modifications Committee based upon the creation of a nuisance. 5. Wolfe (Chuck's Steak House) Newport Beach Owner: Sadie Stegman, Costa Mesa Zoning Administrator Hewicker presented the appli- cation to the Commission and Mr. Dennis Wolfe, the applicant was present to answer questions of the Commission. He explained that the 25 outside seats will not be a bar, but seating area with service of liquor available from the bar in the restaurant. He also answered questions regarding parkings? Item 5. Request to permit a Kentucky Fried Chicken Take- USE out restaurant in a C -1 District. PERMIT Location: Lots 10, 11 & 12, Block 120, Section . A. Newport Beach Tract, located at DENIED_ 2007 West Balboa Boulevard, on the south side of West Balboa Boulevard between 20th Street and 21st Street. Zone: C -1 Applicant: Donald W. Steinke, Fullerton Owner: Marian Craig, Newport Beach Zoning Administrator Hewicker reviewed the applica- tion with the Commission and stated that the plot plan, as submitted, complies generally with the requirements of Chapter 20.53 of the Newport Beach Municipal Code with two exceptions: 1. Section 20.53.060 requires at least 28 on -site parking spaces, four for employees and 24 for customers, while the applicant only shows 10; and 2. Section 20.53.100 limits the total sign area to 2 sq.ft. o lineal foot of property on a street. This would. permit a total of 154 sq.ft. of sign area, while the plans indicate a great deal more than that. I addition, the proposed revolving free standing sig is not permitted without a variance. It was also pointed out that while the operation, as proposed, is intended to be of a "take home" nature, due to the close proximity to the ocean, it is anticipate that some trade will come from people using the beach and may cause a litter problem in the imme- diate vicinity. Since the previous meeting when this application was continued, the applicant has submitted reports and letters to justify the reduc- tion in on -site parking spaces as shown on his plan. While the numbers and figures seem compelling, staff still feels that the proposed location is., unique in that it is not "near the beach ",.or "within a 10 or 15 minute drive of the beach ", it is at the beach. Woolsey represented the applicant and stated that Mr. Steinke, the applicant, feels that this would be an upgrading of the area. He stated that they feel a use permit should not be necessar . as they refer to this as a "store" rather than a "restaurant" because they have an inventory of foo on hand and can serve their customers very quickly, The maximum number of employees would be three and Mr. Steinke would toms by occasionally, making a total of four, leaving six parking spaces which they feel is ample for customers; however, if the Commission feels it would not be adequate, Mr. Steinke would be happy to take out annual permits. Mr. Woolsey noted further that regarding litter on the beach, perhaps the City Council should prohibi picknicking on the beach as the Kentucky Fried Chicken would not cause as much litter as the "brown bag" picnickers. The Commission commented that the signs as pro- posed are considerably in excess of the sign ordi- nance in the City of Newport Beach and Mr. Woolsey replied that they feel that the signing, as proposed, is attractive and should be permitted, however, they will accept the use permit even if they have to reduce the size of the signs. Mr. Donald Steinke, the applicant was present and answered questions of the Commission; also Mr. Jim Kenoyer, a representative of the Kentucky Fried Chicken. The City of Newport Beach UNTIL JURY-17 Zoning Administrator Hewicker reviewed this amend- ment with the Commission noting that it had been the subject of many Planning Commission hearings over the past several months and more recently the subject of a study session and was being brought back this evening as amended. Mr. James E. Taylor, Director of General Planning Administration for the Irvine Company addressed the Commission, introducing into the record the, following documents: 1. A copy of the 1963 Master Plan for the Promontory Point area which designates this area for a combination of high density, multi- family and commercial . development. 2. A copy of the Precise Land Use Plan for Use Permit Application 1466 which was considered and approved in part relative to the Promontory Bay Project: 3. A map indicating the land use that existed as of February 1971 in the general vicinity of Promontory Point. 4. A revised site plan and architectural renderings, 5. The staff report written by the Planning Department for the January 5, 1971 meeting recommending approval. 6. A copy of the traffic access and circu- lation study that was conducted by J.D. Drachmen, Associates, Transportation Consultants hired by The Irvine Company. 7. Transcript of the meeting of January 5, 1971 containing the complete comments of the traffic consultant Mr. Robert Crommelin, who was hired by the Balboa Island Association as well as the comments of Mr. Robert Jaffe, City Traffic Engineer. A copy of a letter from Mr. Crommelin . to the Planning Director for the City of Newport Beach clarifying a state- ment made at the public hearing of January 5, 1971. 9. Minutes of the Planning Commission meet- ings of November 5, 1970 and January 5, . 1971 relative to this item. Mr. Taylor explained the changes that had been made in the proposed development and Mr. William Watt, Director of the Multi- Family Development Section of the Irvine Company indicated these changes on a large display rendering. There was a lengthy discussion regarding the variot s phases of this development including the vista corridor, vista points, the streets within the development and a park which the Irvine Company would dedicate to the City in exchange for the excise taxes which would accrue to the City for an apartment complex of this size. Mrs. Lois Chambers of Balboa Island inquired whether the streets would be available for public use. That a resubdivision and parcel map be filed, prior to issuance of building ' permits. 3o That utility and street improvements be constructed as required in conjunction with the resubdivision and appropriate surety and agreements provided guarantee- ing completion of the improvements. 4. That private streets conform to the City . Private Street Policy, with the geometric design and structural section to be approved by the Public Works Department. 5. That public vehicular access to those private streets serving the vista points be irrevocable. 6. That precise design and location of all, entrances and exits to public streets shall be subject to approval by the Director of Public Works. 7. That a traffic signal and related channelization be installed at the developer's expense at the connection with Coast Highway, with the design to be approved by the Traffic Engineer. 8. If the City.Engineer and the City Traffic Engineer feel that the Coast Highway entrance, as signalized, is hindering the flow of traffic in that area of the City, a grade separation shall be commenced (prior to January 1, 1974) . and that on or near that date, and prior to the commencement of construction of said grade separation., that those two parties report to the Planning Commission their analysis of the situation as they have studied it. That . easements providing public pedestrian and bicycle access to the development shall be provided in locations.meeting the approval of the Director of Community Development, and in a manner meeting the approval of the City Attorney. 10. That detailed landscaping plans, includ- ing a watering system and schedule for installation, shall be prepared by a. landscape architect and shall be subject to approval by the Director of Community Development. Said landscaping may consist of lawn, trees, shrubbery and other plant materials and shall provide for immediate erosion control and perimeter planting of- the entire site. The landscaping and watering system shall be installed in accordance with the approved plan and shall be properly maintained. In the event installation of landscaping is not completed on schedule, the City of Newport . Beach may require a reasonable guarantee for.completion of said landscaping.. 11. That landscaping adjacent to Bayside Drive be designed so.that.sight distance prob- lems will not be created. 12.. That all swimming pools shall be enclosed with fencing as required by the Building Code, 13. That all trash shall be stored in closed containers located within walled enclosures. 14. That all development shall comply with the requirements of the Fire Marshal. 15, That identification signs not to exceed forty square feet per face (double faced) shall be allowed at one entrance on East Coast Highway and two entrances on Bayside Drive. Final design, including copy and lighting, shall be subject to approval by the Director of Community Development; . 16. That the developer shall be responsible for all precautionary actions necessary to protect the quality of•the waters of Newport Harbor.during grading operations, and shall prepare and submit erosion control plans and specifications designed. That the question of acquisition and dev- elopment of the one and one -half acre park site adjoining Bayside Drive for public use shall be determined by the City Council. If the City Council decides not to acquire the park site said area shall be developed for private recreation use exclusive of a public vista and vehicu- lar parking area. In either event, ease- ments providing public vehicular access to the park or vista shall be provided in locations meeting the approval of the Director of Community Development and in a manner meeting the approval of the City Attorney. 18. There shall be no obstructions projecting above the south curb elevation of East Coast Highway a triangle bounded _within by Jamboree Road, the easterly end of the • south property line, and line projecting southwest from the intersection of East Coast Highway and Jamboree Road, at an angle to be determined by.the Director of Community Development that will encompass the view of the Pavilion. 18(a) The main entrance shall be maintained as as a view corridor with a width of between 250 and 282 feet, and no grade within that strip of land shall be above the elevation of the highway as it passes that opening. 19. That a building setback of not less than sixty feet, measured from the curb faces, be established from Jamboree Road. 20. That a beach area, available to residents of the Promontory Point apartments shall be provided at Promontory Bay (south of Bayside Drive). A legal description defin- ing said area shall be submitted to the Director of Community Development and made a part of this application. 21. That the design and improvement of all recreation and view areas, both public and private, shall be subject to the review and approval of the Director of Parks,. Beaches and Recreation. Page 14. That either a pedestrian overcrossing or a fully pedestrian signal be .actuated provided by the developer on Bayside Drive at the beach - marina location, with the design of such a signal to be as approved by the City Traffic Engineer. 23. That a plan showing the location and dis- tribution of all off - street parking spaces shall be submitted to and approved by the Director of Community Development. 24. That all parking spaces shall conform to City standards, and perpendicular parking spaces abutting a property line or struc- ture shall be provided with wheel stops.. All driveways and off - street parking areas shall be paved, and parking spaces shall be properly delineated. 25. That all open and carport parking spaces adjacent to Coast Highway shall be screened with plant materials. 26. That all lights shall be shielded or dir -, ected so as to confine direct rays to the subject property. 27. That consideration be given to providing vehicular access to the shopping center parking area from the easterly entrance to the development on Bayside Drive. 28. That the developer shall submit an amended Site Plan for presentation to the City Council, incorporating the foregoing condi- tions of approval. The Director of Commun- ity Development shall be responsible for determining that all construction and development is in substantial conformance to the amended Site Plan and other condi- tions of approval. Item 10. Linton of 519 Vista Flora, represented the Bluffs Homeowner's Association and stated they_ could live with the 4 conditions recommended by. the staff. Mr..William Holstein was also present. Mr. Bernard Pegg who lives..in the Eas.tbluff sectio and overlooks this area questioned the need for two maintenance areas.to service the Bluffs. x Following a general.discussion, the application x was,approved subject to the following conditions: 1. A revised tentative map for Tract 6905, showing the lot.designated for mainten- ance facilities, shall be submitted prior to approval of the final map. 2. I.D.H., a Joint Venture (Holstein Co.), Newport Beach Owner: The Irvine Company, Newport Beach Zoning Administrator Hewicker reviewed the changes in this previously .approved tentative map with the Commission and noted that the map, as revised, constitutes an improvement over the previous approval. Mr. Robert Bein, of Raub, Bein, Frost and Associates, represented the developer and answered questions o of the Commission. After a general discussion, the Revised Tentative Motion x Map of Tract 6885 was recommended to the City Second N Council for approval, subject to the following All Ayes conditions: 1.
