Proposed revisions to the Housing Element of the
Newport Beach General Plan.
INITIATED BY: The City of Newport Beach
Planning Director Hewicker presented background
information for continued public hearing on this
item.
Commissioner Beek stated that on the third page of
the staff report, Page 1, Attachment No. 1 Page
IV -14, Items 2e and 2f), were deleted altogether
by the City Council so there was no need for
further comment. On the following page because of
the retyping of the report the footnote at the
bottom should also now say Item 9a on Page IV -29
the last paragraph on Page IV -12 and the first
paragraph on Page IV -13.

Madame Chairman McLaughlin asked if there was any
discussion on Item IV -2.

Planning Director Hewicker replied to Madame
Chairman McLaughlin in regards to the first
question asked, (Page IV -14, Items 2e and 2f)
those two sections were not actually moved
altogether from the element but had been relocated
into another section.
Staff member Craig Bluell was asked to explain
where those two sections were moved. Mr. Bluell
referred to Attachment No. 2, Page 2, Item b (the
strike -out and underline), and explained that this
section took in all the CDBG Block Grant fund
references, it discusses the possibility of funds
to establish a "housing opportunity fund" with
that money, and goes on to Page 3 of Attachment
No. 2 and talks about the possibility of an
alternative to the CDBG funds for the Planning
Commission explore. The feasibility of assessing
at 3 to 5 percent residential impact fee on
commercial building permits as an alternative to
using CDBG funds for a "housing opportunity fund ".
Page IV -2. 2. Assignment of staff member to
monitor the housing delivery
system.
Commissioner Allen referred to Attachment No. 1,
Page IV -2, because of her concern with the cost
and as she was reading the City Council's
recommendation about the CDBG fund, she stated
that it occurred to her that perhaps some of these
cost items; Item IV -21: 2a and 2b also possibly
IV -16: Development Review Procedural Guide, Are
these things, that because they are parts of the
Housing Element that we're including and are going
to take staff time, that we can apply for those
Community Development Block Grant funds for?
Mr. Bluell stated that under the CDBG program if
you have a project of some kind you can get up to
20% for administration, but you have to have a
project and the project can not be administration
per se. For example, if we had a senior citizen's
project we could get 20% of the fundings for
administration of the project, but to have the

Commissioner Allen questioned the other
alternative which the City Council recommended
that we explore some kind of development fee
system to put into a housing fund but did not seem
to say what should be done with the money, "Might
this be something that some of the money could be
used for ", asked Commissioner Allen.
Planning Director Hewicker stated that, that is a
possibility and another possibility is that some
of these costs that are incurred by Local
Government in carrying out projects which are
mandated by the State of California, i.e., the
Housing Element might be reimbursable under the
SB90 funds. These are funds which are apparently
established and allocated to reimburse local
government for the cost that they incur in
• administering state mandated projects.
Commissioner Allen asked if by the next time the
Commission meets for this item staff could find
out a little more detail of what staff's estimate
is that some of these things will cost and then
what the funding options may be. Commission Allen
stated that she is looking for funding options
other than taking the money out of the general
fund, if we can.
Planning Director Hewicker stated that at one time
staff had indicated that at least as start -up time
is concerned one individuals time per two years in
getting some of these programs going and that does
not necessarily mean that it would have to be a
new employee.
Page IV -3. 2. Support efforts to design and
implement new mortgage
instruments.
Commissioner Beek stated that this section should
not be included in the Housing Element. Planning
Director Hewicker stated that the City does not
. have the expertise to design and implement such a
plan, but the City can certainly support the
efforts of others along these lines.

Mr. Bluell explained to the Commission the wording
that has been changed by the City Council.
Commissioner Balalis stated that a ten unit
development is too small to have any type of price
differential.
Commissioner Thomas expressed his concern for
market intervention and stated that he is opposed
to social engineering.

Planning Director Hewicker explained the tax
exempt mortgage revenue bond program.
In response to a question posed by Commissioner
Beek, Commissioner Thomas stated that this is a
special interest type of subsidy and should not be
included.
Commissioner McLaughlin stated that this is a
necessary portion of the Housing Element and
should not be deleted.

strategy to assist low- and

Planning Director Hewicker stated that these items
were taken out by the City Council.
Page IV -16. 2. Development of a Development
Review Procedural Guide.
Commissioner Allen stated that the level. of a
Procedural Guide is a good idea but would like to
see someone pay for it . Commissioner Allen
requested that the projected cost and fund sources
to be provided by staff. Staff concurred..
Page IV -18. Conversion of rental property at
homeownership.
Commissioner Beek referred to his Motion T in the
attachment which related to this item.
Page IV -19. 2a. Conversion of rental units of four
units or less to ownership tenure.
Commission Beek stated that condominium
conversions do "not increase the supply of housing
and also added that it would.not solve the housing
problem.
Commissioner Allen suggested that the condominium
conversion ordinance should be looked into again.
so as to retain flexibility for the City.
Chairman Haidinger made a motion to retain the
wording in the report as it relates to the subject .
of condominium conversion.

Commissioner Allen made a substitute motion
relating to IV -14 (d), last paragraph, that the
City will not permit the conversion of five (5)
units or more as opposed to saying four (4) units
or less.
Commissioner Allen clarified her intent that units
of five or more by maintained as rental units and
units of four or less be reviewed again in the
ordinance. Commissioner Allen also stated that
fourplexes and smaller should not be addressed in
the Housing Element.
Commissioner Allen's motion was now voted on,
which MOTION CARRIED.
Commissioner Beek requested that the intent of
Commissioner Allen's motion be voted on.
Comnissioner.Thomas referred to 2a and stated that
the word "facilitate" should be taken out and
"release from regulations" should. be utilized.
Chairman Haidinger concurred but stated that he
would be using the word "permit" rather than
"facilitate ".
Chairman Haidinger stated that the intent of the
motion is to change the thrust of the report from
permitting four or fewer to be converted to the
thrust of prohibiting five or more from being
converted, that wherever this report needs to be
changed to implement that intent. The Commission
requests staff look at the section identified in
Commissioner Beek's Motion To which ..MOTION
CARRIED.
Page IV -19. 2b. Use of CDBG funds for housing
rehabilitation.
This was deleted earlier when the reference to the
Block Grant Program was deleted.
Page IV -21. 2a. Meet with community groups which
represent interest of the elderly.

Chairman Haidinger stated that the City's
requirement for higher cost housing is six times
as greater as the City's requirement of low cost
housing. Chairman Haidinger also stated that this

City should not be in the business to encourage

allocating 10% of our units for low and moderate
housing.
Commission Allen suggested the quantified
objectives should be rewritten which are less
specific and more acceptable. She requested that
the Commission be supplied with the definition of
"quantified objectives ".
