X * * * * * * * * Item #1 Request to amend a portion of Districting Map No. 5 from the R -3 District to the R -1 District. AMENDMEN' NO. 433 Location: A strip of land approximately 100 APPROVED feet in depth lying parallel to and north of Avon Street, easterly of Santa Ana Avenue, adjacent to Newport Heights. Initiated by: The City of Newport Beach Community Development Director Hogan briefly reviewed the staff report with the Commission and advised that the zone change was initiated by the City of Newport Beach in order to bring the zoning into conformance with the General Plan. He also pointed out which properties were affected by this request. Public hearing was opened in connection with this matter. Curt Herberts, 2949 Cliff Drive, appeared before the Planning Commission in favor of keeping the density as low as possible. Page 1. Street with high density condominiums. j ;Don Williams, 2936 Cliff Drive, member of the 'Executive Council of the Newport Heights Improve - Iment Association, appeared before the Commission land presented a petition requesting denial of j (Variance 1041 (Item #2 on the Agenda). He also commented in favor of R -1 zoning and the need to i I estop over - development in the area. In discussing ;the petition with Mr..Williams, some of the !Commissioners felt the issue may have been mis- represented to those signing the petition, there- ;fore, the matter under consideration was clarified, i.e., to change the zone to R -1 in order to conform With the General Plan, or to initiate proceedings l Ito change the General Plan to conform to the l {present R -3 zoning. John Weller, President of the homeowner's associa- tion appeared before the Planning Commission and . advised that the petition previously presented by - Mr. Williams was secured in conjunction with Variance No. 1041 and concurred with the proposal to change the zoning to R -1. The following persons also appeared in favor of changing the zone to R -1: Alka Muller, 2828 Cliff Drive; l Jeff Jones, 3012 Cliff Drive; Virginia Herberts, 2949 Cliff Drive; Nancy Robinson, 2948 Cliff Drive; John Zweers, 2944 Cliff Drive; Avery Simons, 3004 Cliff Drive; and H. R. Snyder, 221 Santa Ana Avenue. Robert J. Brandt, 2953 Cliff Drive, owner of one of the lots proposed to be changed, appeared befor the Planning Commission in opposition to the R -1 zoning. I There being no others desiring to appear and be heard, the public hearing was closed. I Planning Commission discussed subdividing that • portion of the lots adjacent to Avon and the number of dwellings which could be constructed. Page 2. I When questioned as to the status of improvements on Avon, City Engineer Nolan advised that there was a dedicated right -of -way only partially improved at the easterly end near Riverside and there are no plans in the immediate future for further improve- ments through to Santa Ana.Avenue. Motion X ]Following discussion, motion was made to recommend to the City Council that Amendment No. 433 be approved and that 10 foot front yard setbacks be established on Avon Street and 5 foot front yard setbacks be established on Santa Ana.Avenue. Motion ! X Substitute motion was made to continue Amendment • No. 433 for a period of 30 days in order that the staff may explore the possibility of Commercial or R -2 zoning with controls as an alternate to R -1. The motions were discussed, including the suggestion that zoning be made to conform with the General Plan at the present time and then the General Plan be . reviewed for the purpose of considering alternative zoning which may be more feasible. George Wiseman, Architect, appeared before the Planning Commission and commented on the economics of developing the property and requested that the matter be continued pending studies for alternative zoning. Staff pointed out that further amendments to the General Plan would not be considered until November, 1974, and therefore recommended that the filing fee be refunded inasmuch as Amendment No. 433 had been approved changing the zone to R -1 thereby reducing the allowable density. There being no others desiring to appear and be heard, the public hearing was closed. Zone: R -1 Applicant: Gordon Harvin Glass AIA, Newport Beach Owner: Fred S. Thomson and Ina J. Thomson, Corona del Mar Public hearing was opened in connection with this matter. Gordon Glass, Architect, appeared before the Planning Commission to answer questions regarding the request and stated that the staff report covered the matter thoroughly with one correction and that was that the height of the structure would be 31z feet rather than 33 feet. Community Development Director Hogan read a letter dated June 6, 1974, received from Edker and Blanch Pope, requesting that the height be limited so as not to exceed the present overall height of the existing structure. Dede Masters, resident of China Cove, appeared before the Planning Commission in favor of the request. Gordon Glass, Architect, appeared before the Plan- ning Commission and presented photographs for revie indicating the height of the Thomson house, the Pope house and the Chinese house. He commented on the Pope's letter, clarified the reason for the variance, advised that the roof line of the Thomson house would be 5 feet lower than that of the houses on either side and that the only loss of view by the Pope's would be the bottom 3 feet from the rear high wing across the Thomson property. There being no others desiring to appear and be heard, the public hearing was closed. X It was the finding of the Planning Commission that special circumstances applied to the property as stated on Page 2 of the staff report and therefore Variance No. 1042 was approved subject to the following conditions: 1. That development shall be in substantial conformance with the approved plot plan and sections. 2. That all conditions of Resubdivision No. 452 be fulfilled. Zone:: P -C Applicant: Mariner's Church, Newport Beach Owner: The Irvine Company, Newport Beach Bison Avenue was discussed as to its relationship between this request and the proposed reclassifica tion.which has been set for hearing on June 20, 1974: Staff advised, however, that none of the proposed changes to Bison Avenue would affect the proposed church development. The project was discussed as to height of the buildings; access from Bison which will be taken from the existing road to the easterly end of the property and elimination of the second access shown on the plot plan; and interim landscaping of the area. Staff also recommended that design of the parking area be included in Condition No. 7. Public Hearing was opened in connection with this matter. Hudson B. Saffel1, 1118 Somerset Lane, Director on the Board of Mariner's Church, appeared before the Planning Commission. He advised of their intent to work with the Toyota people regarding the .future use of the access road and the parking lots and requested assurance that the width of the access would be adequate. He also commented on exterior lighting which may be requested in the future, the height of the buildings as restricted by the C.C.& R.s imposed under the planned community development standards, estimated time of completion for the various phases of construc- tion, and concurred with the staff report and the recommended comditions of approval. Fred Ilge, Architect for the project, appeared before the Commission to answer questions in connection with the request. Page 10. They also discussed elimination of the second access from Bison Avenue which was shown on the plot plan. City Engineer Nolan commented on other easements in the planned community in order to clarify access to several other lots within the area. Parking requirements for churches and related facilities were discussed. There being no others desiring to appear and be heard, the public hearing was closed. Motion X I Motion was made to approve Use Permit No. 1726, All Ayes subject to the following conditions: 1. That development shall be in substantial con - formance with the approved plot plan and . elevations (noting the elimination of the future driveway), except for minor modifica- tions which may be approved by the Department of Community Development and changes required below. The required number of parking spaces shall be provided at all times as each phase of development is completed. 2. All signs shall be approved by the Director of Community Development. 3. That landscape and irrigation plans shall be submitted to and approved by the Director of Parks, Beaches and Recreation. All landscaped areas shall be continuously maintained. 4. All exterior illumination shall be subject to review and approval of the Director of Community Development. 5. That the proposed classroom buildings shall be adequately insulated from noise generated from Jamboree Road and Bison Avenue. Said noise mitigating measures shall be approved by the Department of Community Development. . 6. Item #12 Proposed Grading Plan - John Wayne Tennis Club APPROVED Commissioner Seely advised that he had performed legal services for the contractor involved in this project, however, did not feel this should dis- qualify him from deliberation. X Planning Commission discussed the grading plan, following which motion was made to approve the grading plan and to allow the height to be measured from the approved grading plan.
