When ascertained that representatives were present
the public hearing was re- opened.
Allen Beek, Chairman of the Citizens Advisory-
Bicycle Trails Committee, appeared before the
Planning Commission and answered questions relativ
to the various proposed routes. He stated there
would be no implementation of the controversial
routes without a public hearing.
Cal Stewart, Director of Parks, Beaches and Recrea
tion, appeared before the Planning Commission to
answer questions and stated that the plan was
presented to the Parks, Beaches and Recreation
Commission and they had unanimously approved of
same.
Larry Moore, General Planning Administrator with
The Irvine Company appeared before the Planning
Commission and advised that The Irvine Company was
concerned in connection with some of the proposed
routes shown on the Master Plan, especially whethe
or not the routes art general or actual alignments
If they are actual alignments, The Irvine Company,
would like to discuss the matter further.
There being no others desiring to appear and be
heard, the public hearing was closed.

Following discussion, motion was made that Resolu-
tion No. 807 be adopted, recommending approval of
the proposed Master Plan of Bicycle Trails with
the following modifications:
1. That the map be re -drawn in such a way as to
clearly define the difference between the
existing and proposed trails and that the
legend reflect same.
2. That the text accompanying the map be printed
on the face of the map.
3. That the Balboa Island, Balboa Island bridge,
and ferry routes be deleted from the map at
the present time, with the understanding that
if implementation of the routes proved feasible
at a future date, the map could be amended and
the routes re- inserted into the Master Plan.

specific. It is necessary that general routes
be adopted in order to obtain matching funds
from other levels of government. Specific
details, however, will depend upon the details
Of future street and highway construction, may
require compliance with the standards established
by other levels of government, and in all cases,
have public hearings prior to implementation."

2. That Section 19.16.030 of the Subdivision
Ordinance regarding map scale be waived pro-
vided that maps drawn accurately to a scale
of 1" = 100' are furnished to the Public Works
Department immediately after approval of the
final map.
3. That Section 19.20.110 of the Subdivision Ord -
inance requiring all lots to abut on a street
be waived, provided satisfactory access arrange-
ments are made.
4. That the boundary of the final tract map be
checked by the County Surveyor before being
submitted to the City for approval.
5. That all grading be done in accordance with
grading plans and reports approved by the
Public Works Director and a qualified soils
engineer. Upon completion of the grading, the
civil engineer and the soils engineer shall
certify that the grading has been completed in
•
accordance with the plans and the requirements
of the grading ordinance. Permanent repro-
ducible copies of the "as- built" grading plans
on standard size sheets shall be furnished to
the Public Works Department.
An interim protection plan shall be prepared
incorporating provisions for preventing erosion
and siltation problems during the grading work
and after the grading work is completed until
all the slope planting is firmly established.
6. That all vehicular access rights to Superior
Avenue be dedicated to the City of Newport
Beach, except for one location to be approved
by the Public Works Department and designated
on the final map.
7. That the interior street system conform to the
City's private street criteria.
8. That the structural pavement section of the
private streets be approved by the Public
Works Department.

11. That water and sewer service be provided by
the City of Newport Beach.
12. That the water system to be constructed
conform to the West Newport Master Plan of
water facilities.
13. That a water capital improvement acreage fee
of $900 per gross acre be paid.
14. That all easements provided for water, sewer,
or storm drain purposes be a minimum of ten
feet wide, with greater widths provided where
required by the Public Works Department. The
surface of such easements shall be improved
to the extent that accessibility for mainten-
ance vehicles is available at all times under
any weather conditions.
15. That the storm drain system along the south-

erly tract boundary be extended westerly to
pick up the runoff accumulating at the
southerly end of widened Superior Avenue.
16. That the existing 24" water main at the south
easterly corner of the tract be relocated as
necessary to insure adequate distance from
proposed buildings and to eliminate excessive
depths. Such relocation work to be accomplis
ed
simultaneously with the relocation required
by construction of Hoag Hospital's parking
structure.
17. That no landscaping greater than six inches
in height be planted within three feet behind
the curbs in street and parking areas.
18. That no building structures encroach on the
utility easements, and that building founda-
tions be designed so as to impose no addition

19. That all development shall be in substantial
conformance with the approved plot plan of

settlement agreement, as amended, between
Donald J. Scholz and Co., et al and the City
of Newport Beach, dated January 22, 1973.

Mrs. Jean Belden, 16961 Bolero Lane, Huntington
Harbour, appeared before the Planning Commission
together with Rich Loomis and Steve Loomis of the
Red Onion Restaurants. They discussed valet park-
ing at length, however the Planning Commission did
not feel that the parking layout as submitted was
a workable plan due to the inconvenience to the
customers by the extra movement to free parked cars
and the congestion of traffic on Newport Boulevard
caused by customers waiting to enter the parking
lot,
Public hearing was closed. However, it appeared

others desired to appear and be heard, therefore
motion was made to re -open the public hearing.
Blackie Gadarian, 2414 Newport Boulevard, appeared
before the Planning Commission in opposition to the
request.
There being no others desiring to appear and be
heard, the public hearing was closed.
Following discussion, Planning Commission inquired
of the applicant whether or not the men who designed
the parking layout could possibly give a demonstra-
tion of its workability at the study session on
June 21, 1973. The applicant indicated that such

a demonstration could be arranged. Therefore,
Planning Commission continued this matter to the
meeting of June 21, 1973, with the request that a
demonstration of the workability of the parking
layout be arranged for the Commissioners at the

Public hearing was opened in connection with this
matter.
John Peterson, applicant, appeared before the Plan-
ning Commission and presented a petition with ten
signatures representing 16 or 18 properties in favor
of the request. He stated the duplex will remain
as a rental unit and the bicycle rental business
will be for a period of about three months at the
end of which time the bicycles will be sold. He
had no objections to the conditions as stated in
the staff report if the request was approved.
Kenneth Elgin appeared before the Planning Commis-
sion in opposition to the request.
Bill Hardesty, 503 Park Avenue, appeared before
the Planning Commission in favor of the request.

indicating.which zones allowed the various types
of restaurants. Planning Commission discussed what
percentage should be considered as incidental
dining out -of -doors in connection with the term
"restaurant ".
Public hearing was opened in connection with this
matter and there being no one desiring to appear
and be heard, the public hearing was closed.

Following discussion, Planning Commission recommended
to the City Council that Amendment No. 375 be approved
with the term "restaurant" to include the words
"and where incidental dining to the extent of not
more.than 25% may be permitted out -of -doors on a
patio, deck or terrace that is integrated into the
building design."

5. An enclosed garage space shall not extend into
a required side yard closer than six feet,
measured in a perpendicular line, to a legally,
habitable room on the ground floor in an
existing dwelling on the adjacent property.
This provision shall not be interpreted as
restricting the adjacent owner in any way in
the legal development of his property.

6. Where there is a habitable room closer than
six feet to the property line on the ground
floor in an existing dwelling on the adjacent
property, a parking space may be approved in
the required side yard, provided it is not
enclosed and that it is not detrimental to the
adjacent property.
7. The encroachment shall be permitted only in
the area that lies within twenty -five feet of
the required alley setback line.
8. That the space be maintained for vehicular
parking.
9. Applicant shall obtain written approval from
adjacent affected property owners.
10. The additional off- street space shall, not be
counted in calculating the F.A.R. for the
dwelling.
