IN THE COUNCIL CHAMBER OF THE NEWPCRT BEACH CITY HALL ' ROLL Commissioners Present: Briggs, Copelin, Ellerbroek, Longmoor, and Rudd. CALL: Commissioners Absent: Daniell, Pleger, Smith, and Wightman. MINUTES: Commissioner Briggs moved thgt the minutes of the meeting of May 18, 1950, be approved as submitted to the Commission, seconded by Commissioner Rudd and carried. PUBLIC . HEARINGS: Chairman Longmoor declared the hearing open on the first application of Nellie Whall and Margaret Gibson for a subdivision and Conditional Permit on Lot 1, and the NEly 4S' of Lot 2, Block 34, Corona del Mar, in order to create a single family building site and asked if anyone wished to speak for or against the appli- cation. Mr. 0. Z. Robertson was present to go over the application with the Commission and an informal discussion followed. Commissioner Copelin moved that the hearing be closed, seconded by Commissioner Rudd and carried. The.Chairman asked what action they wished to take. Commis- sioner Ellerbroek made a motion that application for a Conditional Permit and subdivision to create a separate building site for single residences be' granted, and added that the Commission recognizes the hardship which exists due to the length of the lots. Motion seconded by Commissioner Copelin and carried by the following roll call vote, to -wit; AYES: Briggs, Copelin, Ellerbroek,.Longmoor, and Rudd. NOES: None ABSENT: Daniell, Pleger, Smith, and Wightman Second hearing declared open by the Chairman on the variance application of George M. Whitford for Lot 9, Block 51 Section,5, Balboa Island, and asle d if anyone wished to speak for or against. Mr. Whitford, the applicant, said that the existing residence is on the old set- back line and approximately half of the footage is vacant on the "6" shaped lot, and that he would like to add a room to the present structure to make use of the lot. Mr. Leroy Rickard, 121 North Bay Front, Balboa Island, a former neighbor of Mr. , Whitford's, was present and also spoke in Mr. Whitfordts behalf. Commissioner Copelin moved that the hearing be closed, seconded by Commissioner Rudd and carried. Commissioner Copelin then moved that application for the variance be granted and that the new construction be lined up with the present construction, but in no case shall it be more than a 50% variance. Motion seconded by Commissioner Eller- broek and carried by the following roll call vote, to -wit:' ' AYES: Briggs, Copelin, Ellerbroek, Longmoor, and Rudd. NOES: None ABSENT: Daniell, Pleger, Smith, and Wightman The Chairman asked if anyone had anything they wished to present to the Commission: 120 -- Lucille Bailey, 2296 East Channel Road, Balboa. Owns a large house in an R -1 . zone and has leased a portion to three adirlts; however, she wants to come down this Bummer with her family and also live in the house and wanted to know if this would be allowed. The Commission informed her that it would be illegal since she would have two separate family units in an R.-1 district. - -F. J. Nannestad, 23 /A- 35 /CDM. Presented a letter to the Commission asking per- mission to amend Mr. Penny's original petition on Tract 1026, Changing the zoning from R -1 to an -R -2 zone,, to include his lot in the request. Mr. Penney was present and said that the matter had been in the Commission's hands for over a year now and had ridden along with the access road, although they were separate units. He said that they had all purchased the property in. that tract with an idea of building, and that had been five years ago. "We, now, have directly opposite a State Park and before that we had an R-3 zone. Taxes have gone up 300% and we can't use the property unless we are allowed to build above the road which would be in objection to the people across the street. Property will never be sold as R -1 if we have to build below." Mr. Webb stated that he had filed a report with the City Council on the Bluff Road which was accepted and approved, but they didn't take any definite action to go ahead with it until certain deed restrictions were in. Mr. Wise suggested that they wait until lower access road is settled before going ahead. The Commission concurred. Think it would be best to wait ,a while longer and see how the problem in the eastern end of Tract 1026 goes.. OLD Commissioner Copelin stated that it was necessary to set over the Canal Section BUSINESS:hearing until the July meeting in order to send post cards to each property owner ' for notification. - -Allen Stelle, 212 Dahlia Avenue, CDM. wished to call attention to the fact that the Civic Association of Corona del Mar had passed a resolution to the affect that they opposed any further extension of R -2 in Corona del Mar. Again.they wish to.go on record that the people in that district (Blocks 1312132 -133) that opposed the R -2 zoning before are still opposed to it on the basis that R -2 on the thirty foot lots would only conjest the area. -- Stuart Cundiff, 710 Surf Ave. owner of Ely J 23, 24, 25, & 26, Block 8, East Newport said the people didn't want any R -4 or business zone along the water front as proposed in the new zoning map. Chairman Longmoor read the section covering R-4 in the new zoning ordinance, and an explanation followed. Mr. Cundiff said,' however, that the older buildings were going out gradually and newer ones were taking their place, and they didn't want any businesses to go in there. —Mrs. Robert E. Ross, owner of Lots 8 and 14, Block 10, Tract 234, also voiced her protest of having any businesses established along the ocean front. --Mrs. R. B. Powell, 916 W. Ocean Front, Newport Beach, owner of Lot 5, Block 9, Tract 234. Feels the same way Mrs. Ross does. Built house 22 years ago and doesn't want motels, hotels, etc., anywhere near the district. —Mrs. M. F. Hinkly, 1012 W. Ocean Front, Newport Beach, owner. o£ Lots 4 and 19, Block 10, Tract 234. Feels the same way the rest of the people do. Satisfied I with the way it is now. Chairman Longmoor again explained the R -4 and that just because the area was zoned R -4 didn't necessarily mean that businesses would go in there. They.would have to apply for a Use Permit from the Planning Commission first. 121. .,Mr. Wise explained that Newport Beach is going to be a permanent residence city soon and that adequate highways will do much for this. The days of the summer rentals will go and a demand for all year round apartments will take their place. ' The reason the multiple family was put along the Ocean Front is that it's one of the few places where the light, air, etc. for good apartments and park area is, After further discussion, the Commission agreed to leave the area between Island Avenue to 13th Street R -1 and zone from 13th to 20th as an experimental R -4 which was perfectly agreeable with all people present. Commissioner Copelin made a motion to recommend to the City Council adoption of the new flexible type zoning ordinance and land use plan,�and to appeal the old ordinance. Motion seconded by Commissioner Ellerbroek and carried by the follow- ing roll call vote, to-wit: AYES: Briggs, Copelin, Ellerbroek, Longmoor, and Rudd. NCES: None ABSENT: Daniell, Pleger, Smith, and wightman. The attending commissioners, Briggs, Copelin, Ellerbrosk,.Longmoor, and Rudd would comprise a committee to make final inspection of all data to be presented to the City Council, and Mr. Wise will prepare the resolution, ADJOURN- My : There being no further business, Commissioner Copelin made a motion for adjourn- ment, seconded by Commissioner Rudd and carried.
