Development of a phasing plan to coordinate new development with planned improvements in the circulation system. 4. Revision to the existing density classification system to use numerical density categories.. 5. Assessment of possible reductions in.allowable development in terms of fiscal impacts and environmental . considerations. Community Development Director Hogan advised that staff is suggesting that this matter be continued to allow for the new Planning Commissioners to be appointed and to allow for completion of the Traffic Model. Inasmuch as the Traffic Model will not be completed until September, Commissioner Balalis suggested that the Planning Commission continue the portions of General Plan Amendment 78 -1 that are not dependent on Traffic Model data to the first meeting in July and consider the remaining portions at the General Plan Amendment session in October. Advance Planning Administrator Dmohowski advised that the Newport Heights Homeowners Association has informally withdrawn its request for a change in land use designation in the Newport Heights area from Two - Family Residential to Single - Family Residential after becoming apprised of the newly- revised R -2 standards. The Association feels that these new standards would address its concern with respect to the size and bulk of duplex development in this.area. -3- INOIX COMMISSIONERS City of Newport Beach MOLL CALL June 15, 1978 MINUTES Advance Planning Administrator Dmohowski advised that four portions of General Plan Amendment 78 -1 do not require data from the Traffic Model, i.e., 1. Proposed land use designation change from Two - Family Residential to Single - Family Residential in the Newport Heights R -2 District. (General Plan Amendment No. 78 -1 -C 2 -h) 2. Proposed amendment Zoning Regulations in the Cliff Haven which would result typical lots in th Plan Amendment No. to the General Plan and to prohibit resubdivisions Residential District in lots smaller than at neighborhood. (General 78 -1 -C 2 -k) 0 INOWX Proposed amendment to the Land Use and Residential Growth Elements to designate a 2.3 acre parcel, adjacent to the Newport Terrace development (former City dump site) and currently in the City of Costa Mesa, for • "Medium- Density Residential" use, in connection with prezoning and annexation of the subject property to the City of Newport Beach. (General Plan Amendment No. 78 -1 -B) Proposed "housekeeping" revisions to the Circulation Element, as follows: a. Amend Master Plan of Streets and Highways to indicate proposed realignment of Superior Avenue at intersection with Coast Highway. b. Amend Master Plan to show extension of Balboa Boulevard north of Coast Highway shifted to a more - westerly alignment. c. Amend Circulation Element to reflect on -going widening of Coast Highway between the Santa Ana River and Newport Boulevard. Public hearing was opened in connection with this item and David Shores, 12 Tribute Court, appeared before the Planning Commission on behalf of the Newport Crest Homeowners Association. He requested that the Planning Commission confirm at this time its straw vote of February 16, 1978 -4- I COMMISSIONERS City of Newport Beach June 15, 1978 /TOLL CALL to establish a maximum of ,5 DU's per bui.ldable acre with a maximum of 64 DU's on the Caltrans property. David Simms, representing the State of Californ appeared before the Planning Commission and requested that the Planning Commission not take action on General Plan Amendment 78 -1 -A until the results of the Traffic Model tests are know He stated that the Caltrans West. and Caltrans E properties were put up for auction within the last month; however, no bids were received because the prospective bidders were told by th City of Newport Beach that no development would be permitted on those two pieces of property. With respect to Mr. Simms' statement concerning allegations that the City of Newport Beach woul not permit development on the Caltrans property City.Attorney O'Neil stated for the record that this is not the position of the City of Newport ' Beach. Advance Planning Administrator Dmohowski advise that inquirers about the Caltrans property were informed of the General Plan designation a zoning on the property. They were also apprise of recent developments with regard to the Traff Phasing Policy and possible adoption of a City Ordinance relating to this matter; however, Mr. Dmohowski stated that at no time did the City staff tell anyone that development would n be considered on either of these sites. Carmen Hubbard, owner of property in the Newpor Heights area, appeared before the Planning Commission and requested that the Newport Heigh R -2 District item be set for a date certain. Staff reiterated the fact that the Newport Heights Homeowners Associated has indicated tha it wishes to withdraw the Newport Heights R -2 District item from consideration as it feels th the revised R -2 standards would address its concerns. C -1 and R -3 Bank of Newport, Newport Beach Same as Applicant -11- INOLX Y COMMISSIONERS \�$\\OL City of Newport Beach June 15. 1978 AOLI CALL Community Development Director Hogan advised th the approval of Final Map Tract No. 10274 is a ministerial action inasmuch as the Tentative Tract Map has been approved and the Final Tract Map complies with the approved Tentative Map. Discussion was opened to the public and Mr. Karr Foy Yee, owner of Kam's Restaurant in Corona de Mar and also property owner within 300' of the Bank of Newport project, appeared before the Planning Commission. Mr. Kam Foy Yee voiced concern that he was never notified of the Planning Commission public hearings relative to the Use Permit and Tentative Tract Map of this.project. He added that perhaps other property owners were not notified of these publ hearings. In view of the foregoing, Mr. Kam Fc Yee requested that the Planning Commission rehear the entire Bank of Newport proposal so that everyone may be given an opportunity to speak and be heard thereon. In answer to a question by the Planning Commis sion, Mr. Kam Foy Yee advised that he opposes this project in view of the additional traffic which would be generated as well as the air pollution which would result from the exhaust fumes of this additional traffic. He spoke in opposition to the 8' wall which is proposed to surround his restaurant as this would ezclu the landscaping and also to the removal of tre which would result. Community Development Director Hogan advised that the public hearing notices were sent out as required by law to the property owners in accordance with the information furnished to the City by the Title Company. He added that this matter was also advertised in the newspap, and that subject property was posted. City Attorney O'Neil felt that the City has satisfied the requirements of the Ordinance in giving notice to the appropriate property owne He added that although there may have been som mistake or inadvertence on the part of the Tit Company, that is.not the City's responsibility Mr. O'Neil expressed that if the Final Map complies with all of the conditions of the Tentative Map, the Planning Commission has no -12- MINUTES • INOIX 1 1 is y • as ar ^s. le 9 COMMISSIONERS Q City of Newport Beach June 15, 1978 POLL GALL alternative but to approve the Final Map. However, if the Planning Commission feels there was some infringement of due process, the Planni Commission could reconsider the entire Bank of Newport application. However, Mr. O'Neil added that staff would recommend against this latter action. Barry Allen, 1021 White Sails Way, Corona del Ma appeared before the Planning Commission. He stated that he purchased the newspaper that the City Clerk indicated should contain the notice of the Planning Commission public hearing regarding project; however, he found no .this mention of this matter contained in said newspa Therefore, Mr. Allen felt that perhaps sufficie notice was not given with respect to this application. With regard to the 50' flag pole which is proposed for this project, Mr. Allen felt that this flag pole should be lowered to a height not to exceed the top of the building anc voiced concern that this could start a precedent He then questioned the amount of funding being provided by the Bank of Newport for the.signal at the intersection of Avocado and Coast Highwa3 as he felt there was some discrepancy between tt percentage considered by the City Council and that percentage considered by the Planning Commission. Community Development Director .Hogan advised Mr. Allen that a 50' flag pole would be auto- matically permitted in this area without Plannil Commission review, as provided for under Sectiol 20.02.062 of the Zoning Code, to wit: "20.02.062 FLAG POLES. ..Flag poles, shall be permitted in the 26/35 and 32/50 Foot Height Limitation Zones not to exceed a.height of 50 feet. All other flag poles in excess of the height limits noted above may be permitted subject to the approval of the Planning Commission." Dennis Harwood, Attorney at Law, appeared befor, the Planning Commission on behalf of the Bank o' Newport and reiterated that the matter before tl Planning Commission is to approve a Final Map Tract which contains no deviation from the appri Tentative Tract Map. -13- MINUTES ng r per nt e I F ie )ved INOIx COMMISSIONERS City of Newport Beach June 15, 1978 MINUTES DOLL CALL Paul Ruffing, Ficker & Ruffing Architects, appeared before the Planning Commission and advised that after working out al.l the formulas in the design of the building, the maximum height of the building will be 36'. Following discussion by the Planning Commission as to the methodology used in arriving at the one -. sixth percentage of the signal to be paid by the Bank of Newport, Paul Ruffing reappeared before the Planning Commission and advised that the State will be responsible for two - thirds of the cost of this signal and that the City will be responsible for the remaining third of the cost. Therefore, the portion to be paid by the Bank of Newport has been defined as one -sixth of the total cost of the signal, or one -half of the City's apportionate share.
