THE NEWPORT BEACH CITY PLANNING CCMMISSION met in regular session
- Wednesday evening, July 16th, 1941 at 7.30 P.M. in the Council Chambers,
'City Hall, Newport Beach, Calif, Chairman Johnson presiding. Meeting
called to order by the Chairman.

MINUTES:
Minutes of May 21st and June 18th were considered. Cam. Patterson Hin tes
moved that the minutes of these meetings be accepted as written. Second-
ed by Cum.- Estus. Motion carried and so ordered.
Secretary -read the application of Joseph Rossi requesting that Lots

ceived and the Chairman asked for verbal protests. No one present de-
sired to protest the matter. Cam. Patterson moved that the application
of Joseph Rossi, for rezoning Lots 2 and 4, Block 731, Corona Del Mar
from R -2 to C -2 be-passed to second hearing.. Seconded by Cam. Allen.
Motion carried and so ordered by the Chairmai. The second hearing on
this matter will be held on Wednesday, August 20th, 1941 at 7.30 P.M.
The Secretary read the request of Clark R. Thomas for 50% (1811)

one, with"the intention of building a one story instead of two story
building. The Secretary advised that 14 surrounding property owners
in the immediate vicinity had been advised and that the matter had been
properly advertised. Com. Seager read two letters of protest, one from
Satheryn Holman of 142- No. Small Drive, Los Angeles eho owns Lot 35,
Tract 792, Balboa Island and the other signed by the following people;
E. M. and Blanche W. Harvey, 305 E. Bay Front, Balboa Island, -
Robert B. and Elizabeth H. Powell, 305 Crystal Ave., Balboa Island
G. F. and Theodore G. Collins, 1609 Balboa Ave., Balboa Island.
The Chairman threw the meeting open for discussion, inquiring if anyone..
present wished to speak either for or against the granting of this re-'
quest. Mr. E. M. Harvey of 305 E. Bay Front, Balboa Island was present
and stated that while he disliked protesting the application of a good
neighbor, the granting of the request would result in a loss of fresh
air and sunshine In the kitchen of their house and it further would be
a fire hazard. He: stated that his tenants, Mr. and Mrs. Robert Powell
had advised that they would move if the structure were erected, which
would result in a considerable loss of income on this rental property.,
Mrs. Harvey stated that she also protested and on the same grounds as •.
her husband. Mr. Robert Powell stated that he is a tenant in Mr. He*-:
veyle property and is located next door to where Mr. Thomas proposed
to build and therefore, is more interested than anyone else. -His kitchen
view would be entirely shalt off and with it, fresh air and light. Mr.
Clark Thomas stated that when the shape of the lot is examined, exteaa -.

Seconded by Can. Patterson. Chr. Johnson called for a Roll Call vote. Cam.
Allen was not present to vote as he had to leave during the discussion.

discussion between the Commissioners and Mr. Thomas, Mr. Estue made a
motion that the Planning Commission adoptResolution No. 190 granting Mr.
Hayes' request for 100% rear yard setback variance having.to do with
Lots 16 and 17, Block 15 of the Resubdivision of Sec. 1, Balboa Island
and conditional building permit, and that the same be transmitted to the
City Council by the Secretary as the recommendation of the Planning
Commission, and a copy filed as part. of the record. .Con. Patterson sec-
onded. Chairman Johnson called for a Roll Call vote.

-Chairman Johnson requested the information be sent to the City Council
advising them that this matter was voted on and resulted in a tie.

The Secretary read a letter, referred to the Planning. Commission
by the City Council signed by Mrs. Manuel Cordiero requesting permiss-
ion to smoke fish at 202 -20th Street, Newport Beach, Calif. Chr. Jobn-

son advised that the same application had been presented to the City

Council and Planning Commission two years ago, . at which, time he was not

a member of this body. At that time, he advised, he presented to the

Planning Commission, a petition against the.granting of.this request,
which petition was signed by 85% to 90% of the property owners on that
block. He added that such a petition can hardly. be overlooked and, that
in granting such a request the ordinance would have to be changed. The
City Attorney ruled that it would make it possible to smoke fish in any
C-1 or C-2 zone in the entire city. The matter was discussed by the Cam -
missioners during which discussion Cam. Patterson made the suggestion
that the Secretary write to the City_Attorney and find out if there is
any legal way the ordinance can be amended to safeguard the interests
of the city in this regard. Commissioner Estue moved that the request
be denied since our Ordinance does not allow us to grant the request.
Cam. rindlay seconded the motion which carried and was so ordered.
The Secretary read a letter from H. L. Gianetti of 403 E. Green

St., Pasadena requesting advice regarding the present zoning covering

Lots 42 and 43, Tract 518. Com. Patterison moved that the Secretary an-
swer the letter advising that no change has been made. Seconded by
Cam. Estus. Motion carried and so ordered.
Sec. Saager advised that be bad been requested by the Orange Co.
Orange County
Coast Association to acquaint the Planning Commission with the steps
Coast Associationwhich had been taken with regard to Shoreline Planning. He advised
that a bill was before the legislature for the appropriation of
Snore Line

$2,500.000 to be expended for the preservation of public beaches.
Plannin,
Orange County is to be given $400,000. However, the bill states that
—
no County is to benefit by the bill unless it had prepared and adopted
a Master Shore Line Plan. Orange County had no such plan, so after
many night meetings, a visit to the Board of Supervisors, etc. a pre+ 27
liminary master plan was ditfted so that we could participate in some of
the appropriation. The bill passed the Assembly and Senate. However, the'
Senate cut it. Nevertheless, Orange County will get a small amount of Shore Line
the appropriation. Come Seeger stated that he is Chairman of the ,Orange P1eA4ng Lcontd
Co. Coast Association Planning Commission and that it was his suggestion,;
and the suggestion was adopted, that the committees frcm the various com-
munities be made up of five members and that these members be appointed
in the following manners
2 members from the Chamber of Commerce, in each locality
.2 members from each Planning Commission
1 member at large
Chairman Johnson then advised that he had appointed Come Seeger, Mr.Louis
Briggs and Mr. Donald Beach Kirby. Mr. Seeger then advised Chr. Johnson
that he had been.incorrectly advised by Mr. welch and the original idea
of -five members still stood. Come Seeger said that Los Angeles.County
already had a master plan for their shoreline. It is a very comprehensive
plan and L. A. .County is out for all it can get, exerting the influence
of it's 40 Assemblymen in that direction. Cam. Findlay asked if the ero-
sion plan would cover the badly needed groins where we had a washout from
36th St. down and further asked how the needs of the.beaches would be,de-
termined. Cam. Seeger advised that this would be decided by local and
Army engineers. Cam. Patterson advised that we were interested in getting
State Aid for the construction of groins at. Newport Beach and that we
would get 1/6 of the money, or around,$70,000. He said that Orange Co.
has more beach property than L. A. County and that we are interested in
the protection of the beaches we have. It was Chr. Johnsonls suggestion
that the Secretary write a letter to the members appointed to this Cam -
mittes bringing them down to date on the matter.
After some discussion wherein it was brought out that the Mayor had Annya,l Reorean-

Cou,mission until the next meeting. Motion seconded by Cam. Patterson.
Motion carried and so ordered.
Ccm. $eager made a motion that (1) the Chairman appoint a- Committee
of three with authority to consult sane - Planning Consultant with refer-
ence to a plan for the improvement of the proposed new Central Avenue
and (2)-that they submit a tentative plan for a Marina. He further
stated that as far as he ]mew both of these ideas were original with him
and therefore, necessitated elaboration.
He went on to explain - the city, owns a strip of waterfront property
on the North Bay where they are leasing moorings for large boats. The Central Avenue
boats moored there are among the nicest that float. The rest of the Planning and Pro -
property is idle. Come Seeger said he conceived the idea of putting in ,-posed Marina.
a Marina there with these beautiful boats for a background and further
added that it would not, in any Fay, interfere with the rentals the city
derives from these boats. His idea included a bath house for the public,
tennis courts, various amusement features. This would increase our facil
ities for the enjoyment of the public and fill a long needed demand. Af-
ter considering some of the plans.pat into effect on the Atlantic Coast,
we could construct there, a project which would go a long way toward
popularizing Newport Beach and this, without expense to the city. New
Jersey has set up a plan for the improvement of their shore line which
is not only self sustaining but which maims a little money. This would
put us on the map beside supplying a public demand. However, it would
take sane time to work out. Can. Seeger further stated that he would
have an amortized investment from revenue derived therefrom and the
City would eventually come into possession of these buildings. He added
that he would like to see the plan submitted for public hearing and sub-
mitted for the consideration of this body and City Councils bea0ing MW
recommendations that the Planning Commission members may care to makes

Cam. Seeger advised that he did not want to tread on the toes of our
capable City Engineer, Come Patterson who is now working on plans for . the
improvement of Central Avenue., but that if we are to justify our..eaistence
as a Planning Commission, this is one of the things that we should do. The
Planning Commission should submit a plan for Central Aveau®., also and
all;:, the good features Come Patterson will submit in his plans and any
good features incorporated in ours, may be incorporated together and - ,
-- something agreeable to the whole community will evolve.
Cam. Patterson stated that when negotiations were started with the
Pacific Electric, he realized from the conversations that he 'heard around
town that there would be a lot of ideas as to how Central Avenue should
be improved. At the time, we selected a group of citizens, Com. Patterson
said, who are interested in the proper development of the Peninsula. They
have -some good ideas on the subject and want something worthwhile. Any
Committee will have to consider the property owners in that district whose
wishes in the matter should be considered.
Cam. Seeger stated that the statutes state that the Planning Com-
mission will be for the purpose of holding public hearings on these mat-
ters and the only way we can accomplish amything is to make what we con-
sider a good plan and then hold.public hearings on the matter notifying
citizens and divic bodies interested, to bring their plans to be incorpor-
-ated with ours. Cam. Estus stated that we have not yet acquired that
property and do not ]mow that we will as yet, but Com., Seeger thougght
that this made no difference. He said a good plan is a stimulus for the
acquisition of such property. Cam. Patterson advised that the pries is
agreed on and the city is to go into court and condemn it. An assessment
'district is being formed to pay for the costs but it will tabs 3 or 4
months before the property is acquired. It has been agreed to stipulate
$32,000 in court, as the price, Come Patterson stated that one of the
reasons these men were appointed was that they were interested and it
is his belief that arc. project coming up before the city has a better '
- chance to succeed if those interested and affected by it, can agree
and back it up.
Con. Seager said he believes both ideas laudable and of value to
the community. Cam. Hopkins seconded the motion. notion carried and
so ordered. Chr. Jojmson then appointed Cane Hopkins as Chairman and
Commissioners Seeger and Findlay.
Con. Patterson made a motion to adjourn which was seconded by Come
