Regular Meeting of May 7, 1981 - 7:30 p.m. Commissioner Allen referred to the first para- graph of Page.7 in the May 7, 1981 Regular Planning Commission Meeting Minutes and requested that the word, "reduce" be deleted and be re- placed with the word, "increase ". In referring to the May 7, 1981 Minutes, Commis- sioner Allen noted that.the Block 600 issue was clarified at the subsequent Planning Commission Meeting of May 21, 1981, Page 29. Commissioner Thomas raised a question regarding the requirements for drainage facilities. The requirements for evaluating the potential for urban storm water run -off facilities such as a holding lake; are contained in the Planning Commission Minutes of May 7, 1981, Pages 17 and 18. Commissioner Allen referred to the first para- graph of Page 33 and stated that the 300,000 sq. ft. should be deleted and replaced with 225,000 sq. ft. Commissioner Allen referred to the third para- graph of Page 32 and stated that more dialogue • should be added to reflect the concern of the traffic peak period. He stated that the City Attorney's office has proposed additional findings, as listed in the staff report, in the event this item is approved. The public hearing opened in connection with this item and Mr. Bud Quist, the applicant, stated that there is overwhelming community support for this development, and referred to the petition and various letters that were sub- mitted at the last meeting. Ms:. In response to a question posed by Commissioner Beek, Ms. Sullivan stated that the buildings currently on the property are obsolete. She also stated that the need for larger lots today, is no longer feasible when considering the high costs of property and construction. In response to a question posed by Commissioner Allen, Punning Director.Hewicker explained that only two of the parcels in question contain the correct amounts of areas, and one parcel does not contain the required width., Mr. Bill Laycock, Current Planning Administrator, stated that approval of this.resu.bdivision will create one conforming lot and two nonconforming lots. . Commissioner Allen asked if this resubdivision can be designed so as to not create nonconforming lots. Mr. Quist responded no,.that an exception for the width would still be required. He stated that this subdivision has been designed to take all access off of Irvine Avenue which will there- by eliminate a traffic problem for these parcels. Commissioner Beek requested the following state- ment to be included in the minutes, "The original subdivider could have made this a whole subdivision of 5,000 square foot lots. He would have-sold more lots and made more profit. Fortunately, he placed as much importance on" the quality of his work as on his money profit. He created a higher- quality tract with 8,000 square foot lots. The two lots in question particularly need the extra size to provide a buffer of trees and land- scaping against the noise of Irvine Avenue. We are asked to eliminate the space required for noise buffering and reduce two 8,000 square foot lots to three 5,000 ± square foot lots. If lot splitting is justified here, it is justified anywhere. There has been continuing pressure for lot splitting in recent years. After extensive discussion in connection with a lot much larger than these, the City Council decided to defend the concept of the original subdivider, and deny Jot splitting. That.is a sound policy. It has been endorsed in this case by both of the concerned homeowners' associations. I urge my colleagues to respect it." That the granting of this exception is com- patible with the objectives of the regula- tions governing light, air and the public. health, safety, convenience, and general welfare. 5. That the proposed resubdivision is in confor- mance with the General Plan, and that the proposed development is compatible with the objectives, policies, general land uses and programs specified in said plan. 6. That there are special circumstances or con - ditions affecting the property in that the proposed Parcel No. 2 isdeficient only 675 sq.ft, for a corner lot, and the proposed Parcel No. 3 is only 4 feet short of the min - imum width of 60' required for a corner lot. 7. Tom Moore, representing the applicant, Wood- ward Dike, stated that the proposed.tennis.court light fixtures will be designed and located in such a manner so as to cause n.o view impairment • for surrounding properties. He referred to a letter from Dorian Johnson, Project Manager for Harbor Ridge, which.approved the architectural design of the proposed improvements, but did not rul.e on the compati.bil.ity of.the use in a residential development: He also referred to a letter from a property owner on 1 Yorkshire in support of the proposed development. Mr. Moore then circulated a section drawing of the proposed development which depicted the height of the light standards in conjunction with the sur- rounding properties. Dr. Michael Drucker, resident of 7 Coventry, stated that he has a petition with 13 signatures from residents of the immediate area who are opposed to this proposal. He stated that he would be opposed to the brightness of the light - ing and the noise that would be created by this proposal. Mr. Jack Robinson, resident of 25 Coventry, stated that the proposed lighted tennis court facility would be detrimental to the residents of the surrounding area. He stated that the tennis court lighting would be installed in such a manner so as to control and shield the direct light with reflectors and shades. He also stated that he would be agreeable in specifying that the lights be tu.rned off by 10:30 p.m or 11:00 o.m. MINUTES Mr. Jose Bertagni, resident of 1 Coventry, stated that he is opposed to this proposal because of the added light and noise pollution it will be creating. In response to a question posed by Commissioner Beek, Mr. Burnham, Assistant City Attorney, stated that the applicant can not install the lights without first obtaining the City's appro- val. Motion was made to deny Use Permit No. 1993, subject to the findings of the staff report. Commissioner Balalis stated that no matter how well controlled the tennis court facility may be, the noise and lights will still present a detriment to the adjacent residential neighbor- hood. Commissioner McLaughlin asked Commissioner Balalis if he would consider approving this proposal with the condition that the lights be turned off by 10:00 p.m. daily. Planning Director Hewicker stated that a liberal-interpretation of. the closing time is that the doors.wouTd have to be closed at 11:00 p.m., but that-the persons inside would be permitted to remain. She stated that they do not really know what will be built in this area, and therefore can not approve a specific traffic study. She suggested that the traffic numbers be run either at an 8.3 trip generation as was used for the North Ford development, or at the very least, a 7.26 trip generation for an in- dustrial park. Mr. Bill Darnell, Traffic Consultant for the applicant, discussed the trip generation rates utilized for the project. He stated that the I.C.U.'s are very conservative and that the re- quirements of the Traffic Phasing Ordinance have been satisfied. Commissioner Allen stated that she is also concerned with the level of detail on this traffic study, as opposed to other pro- jects with traffic studies. • Commissioner Allen asked staff to explain how adequate fire protection is achieved with a master plan. Planning Director Hewicker stated that development could be phased to occur at such time as adequate fire protection becomes available. Commissioner.Allen expressed her concern that adequate funding may not be a:vailabl to construct such a facility. Planning Director Hewicker explained the process in which fire stations, parks and libraries are funded. Commissioner Allen asked for clarification on the noise wall for Coast Highway. Mr. Talarico state that all projects that would contribute to the traffic, would be required to contribute to the fund. Commissioner Allen referred to Item No. 16 of the mitigation measures which relates to the views in.Newport Crest. Mr. Talarico stated that the Planning Commission will have the opportunity to establish grades at the time of the tentative tract map and to determine what is feasible.
