Thursday, June 21, 19459, at 7:50 p. m., in the Council Chamber, City .
Hall, Newport Beach, California, with Chairman Pro -Tem Howard W.'Sasger,
presiding.
ROLL CALL Commissioners present: Baltz, Johnsoei Nelsou, Patterson, and Seeger.
Commissioners absents. Alleno, Campbell, Hopkins, and Isbell.
MINUTES Commissioner Patterson made the motion, seconded by Commissioner Johnson
that the minutes of the meeting of May 17, 1945, as well as these of the
meeting of June 1, 19459 be approved as read. Notion carried and so or-
dered.
COMMUNICA- Commissioner Johnson, Secretary Pro -Tom, in the absence of Secretary
TIONS Allen, read a letter from the City and County Planning Service, address -
ed to the City Council, and referred,by that body to the Commission re-
questing consideration for appointment as the "authorized agent" to re-
present the City of Newport Beach in its improvement program. Commiss-
ioner Patterson made the motion, seconded by Commissioner Johnson that
the letter be filed for further referrenoe. Motion carried.
Commissioner Johnson also read a letter from the City Clerk, by order of
the City Council of Newport Beach, advising the Commission that the Coun-
cil had disapproved Resolution No. 251, and had directed that same be re-
ferred back to the Commission, with the recommendation that cows and
horses be not included in the prohibition list of live stock. After dis-
cussion, Commissioner Patterson made the motion, seconded by Commissioner
Nelson that the Secretary be instructed to advertise a new Public Hearing
on this matter, for the next regular meeting of the Commission, July 21,
1945. Motion carried, and so ordered.
PUBLIC
The second and final hearing upon the application of A. D. Haigh, fora
HEARINGS
change in zone classification from R-3 to C-1 for Lots 51, 4, 52 and 6,
Block 3, Seashore Colony Tract, Newport Beach, was announced, as was the
second and final hearing upon the application of Alviero Biscini, for a
change of zone classification from R-3 to C-1 for Lots 11, 12, 139 and
the northerly half of 14, Block 2, Seashore Colony Tract, Newport Beach.
The committee composed of Commissioners Johnson, Nelson, and Baltz, app-
ointed at the meeting of June 10 1945, to investigate these properties,
presented a written report recommending that both of these applications
be granted.. No protests were heard or received, and accordingly Com-
missioner Patterson made the motion, seconded by Commissioner Seeger that
the report be accepted. Motion carried. Commissioner Johnson then made
the motion that a resolution (No. 232) be introduced by the Commission
recommending to the City Council that the application of A. D. Haigh be
granted a zone change for the lots specified, as requested, seconded by
Commissioner Nelson.

Noes: None. Motion carried and so ordered, and hearing closed by motion
of Commissioner Johnson, and seconded by Commissioner Patterson. Carried.
On the application of Alviero Bisoini, Commissioner Patterson made the
mention, seconded_:by Commissioner Johnson, that the zone change from R-3
to C-1, for Lots 11, 12, 15, and the northerly half of 14, Seashore Col-
ony Tract, be recommended to the City Council. (Resolution No. 253.)

ion made by Commissioner Patterson, and seconded by Commissioner Johnson,
and carried.
' Second and..final hearing upon the proposed Amendment to ordinance No. 525
to authorize the Commission to grant front and rear yard variances, in
accordance with the statutes, aas declared. No protests were received or
heard, and no citizens were present for the hearing. Therefore, Commission -
er Patterson made the motion, seconded. by Commissioner Boltz, that the pub-
lic hearing be closed. Motion carried, after which Commissioner Boltz made
the motion, see onded.by Commissioner Johnson that the Commission introduce
a resolution (No. 284) recommending to the City Council that Ordinance 525
be so amended.

The committee of'Commissioners tatterson and Nelson, appointed by the REPORTS OF
chairman to check;:on the rear yard setback line on 88th Street between COMMITTEES
Marcus and Channel Place, reported, after checking conditions, and re-
commended that the change be made from.the 101 to 51. The matter had been
brought up by Ralph Maskey, who requested a change from the present re-
quirement of 101, claiming that 11 to 180 would be suffieient. Commiss-
ioner Patterson made the motion, seconded by Commissioner "elson that Or-
dinance Not 525, Section 8, be amended in accordance with the committee's
recommendation, i. e., change from 101 to 81, on the east side of 88th
Street between Marcus and Channel Place,(as shown on the Districting Map
' of Newport Beach). Motion carried, and Commissioner Boltz made the motion
seconded by Commissioner Nelson, that the secretary be instructed to ad-
vertise the matter ofr Public Nearing for the neat meeting of the Commiss-
ion. Motion carried, and so ordered.
Commissioner Johnson, chairman of the committee to investigate the matter
of the request of 16r. M. A. Davis, for a street and alley improvement,
read the following written report; signed by him, and the two other mem-
bers of .the committee, Commissioners Patterson and Boltz:
"At a regular meeting on May 17th, a committee consisting of Commissioners
Johnson, Boltz, and Patterson, was appointed to investigate the written,
request of Mr. Mansell A. Davis for a street and alley improvement on
Buena Vista Boulevard.
"With a few minor changes, the Committee endorses the project in its en-
tirety.
"We believe that the widening of the alley is of first importance and
would not recommend a general street change that does not include that
item as a component part thereof.
"We further recommend that-the alley be widened to 20 feat and not as re-
quested in Mr. Davis? letter.
"We further recommend that only 20 feet of Buena Vista.Blvd..be vacated
and that the balance of the street be covered with a cement sidewalk of
' standard construction, provided with a substantial pipe railing on the Bay
side. A.suitable number of cement light standards to be supplied.
"The northeasterly side of this walk to be protected from erosion by a
substantial sea wall to be designed by the City Engineer.'
"The northerly and southwesterly end of this walk to be curved into pres-
ent sidewalks about as shown on plan submitted by Mr. Davis.
"A 15 foot front yard setback line to be established.
"A11 costs of this project to be borne by the property owners."
Mr. Davis and Mr. Robertson, another property owner on Buena Vista St. '
were present, stating that over fifty per cent of the property owners
were in favor to the improvement, but uot'6nd hundred per cent. Mr.
Davis read three teplies to letters which he had sent out from Mr. F..
H. Miller, who was definitely opposed, and Mr. A. F. Baxter and Mr. L.
H. �bbertson, who were both very much in favor of the project. Con-
siderable discussion ensued, the matter being.up for clarification and
discussion, and not for action at this time.
NEW BUSINESS Tentative Map of Tract 1102, Bayshores, referred.by the Orange County
Planning Commission, was carefully considered, and Commissioner Pat-
terson made the motion, seconded by Commissioner Batts, that the Com-
mission approve the may, and that the secretary be instructed to re-
commend that the Orange. County Planning Commission concur in this action.
Motion carried and so ordered.
Commissioner Seeger read a letters written by him as chairman pro -tem
to Commissioner Balta, advising the latter of his appointment as chair-
man of the Architectural Advisory Committee of the Commission, in aec-
ordance with the statutes, with'arehitects George J..Lind, Richard H.
Pleger, and Armand Monaco, as the members of the committee, further stat-
ing that each of the architects had signified their willingness to serve.
Commissioner Patterson made the motion, seoonled by Commissioner Johnson
that the Commission approve the appointment of this committee. Carried. '
A plan for a store building on Coast °ighway for Ads.. Grace Wyckoff, by
architect F. Lansdown, Santa Ana, was presented, and Commissioner John-
son made the motion, seconded by Commissioner Patterson, that same be
referred to the Architectural Committee. Carried.
A plan for 0. L. Allison for a restrauant on Coast Boulevard, Corona
Del Mar, as also referred to the Architectural Committee by motion made
by Commissioner Patterson, and second d by Commissioner Nelson, and
carried.
Commissioner Seager then requested that Commissioner ohnson take the
chair, temporarily] and brought up the matter of levying a.two mill tax
on each $1.00 of assessed valuation, as provided by the statutes, for
the purpose of defraying the expenses of the Commission. Discussion re-
vealed that such a tax would levy and collect a sum somewhere between
532,000 and X38,000, depending upon the present assessed valuation.
Commissioner Seeger made the motion, seconded by Commissioner Nelson
that the Commission recommend to the City Council that a tax be .levied
for two cents on each $100 of .assessed valuation.

Noes: •None. Motion carried and so ordered.
ADJOURNMENT Commissioner Seeger made the motion for adjournment to the next reg-
ular mesting,.July 19, 1945, Motion seconded by Commissioner Balta,
and so ordered, by unanimous vote.
