of 'Chairman. Planning Commission then voted
between these three nominees. Since a majority
.vote was not cast, Planning Commission voted
between William C. Hazewinkel and Jacqueline
Heather. William C. Hazewinkel was elected
as Chairman.
Jacqueline Heather was nominated and elected
for.the office of First Vice Chairman.
Don A. Beckley was nominated and elected for
the office of Second Vice Chairman.
James A. Parker was nominated and elected for
the office of Secretary.
At this time, Chairman Hazewinkel.was excused
from the remainder of the meeting,

Community Development Director,Hogan explained
that this is a fairly complicated item, however,
it is a modification which has been approved
and the appeal is only from one of the
conditions of approval.
Public hearing was then opened in connection
with this item and Gene Crain, Attorney,
appeared on behalf of the applicant to discuss
same. Mr. Crain concurred with the staff
report and emphasized some of the items contained
in the report. Mr. Crain pointed out that
the illegality mentioned in the report
is on the second floor portion of the structure.
Mr. Crain then answered questions of the
Commission.
George Wiseman, Architect, then appeared
before the Commission to answer questions
relative to the structure of the building.

Following discussion, motion was made to deny
the appeal and uphold the decision of the
Modification's Committee.
(Substitute motion to allow the open space option
to remain on the front as it currently exists
for the benefit of the property owner and to
essentially not approve the- addition of the
extra garage space and to - require the Seashore
side to remain as i-s.

and concurred with the staff report.
Mr. Ewing, 1740 E. Oceanfront, Balboa, appeared
before the Planning Commission and stated that
none of the people interested in this project
had had an opportunity to review the plans for

this project. Mr. Ewing expressed his opinion
that the meeting should be continued until
the plans are made available.

MINUTES
Daniel Connelly reappeared before the Planning
Commission and stated that this resubdivision
has been requested by the Planning Commission
and that he would need this irregardless of
what he builds on the property. He further
stated that the meeting is not to consider
what he will be building on the property and
felt that no one has a right to look at his
plans at all.
Harry Kamph appeared before the Planning Commission
and voiced his disappointment that he was
unable to receive a copy of the plans for this
parcel. He felt that the people who live in
the surrounding area should be able to comment
as to the desirability or nondesirability of
this development. He then discussed the
environmental impacts'for this project.
Brion Jeannette, Architect for the project,
appeared before the Planning Commission and
• stated that the project itself will go before
the South Coast Regional Coastal Zone Commission
and felt that the only thing that should be
considered at this point is the combining of
two pieces of land. He further stated that
the project and property do correspond with the
local zoning codes.
Community Development Director Hogan explained
that a Use Permit is not required for a re-
subdivision and that the filing of any plans
of development is also not required in the
case of a resubdivision, although the Planning
Commission has in the past reviewed the plans
that have been.submitted by the developer for
a development of property.
Tom Kamph, Attorney, appeared before the Planning
Commission and referred to Mr. Jeannette's
earlier testimony. Mr. Kamph felt that there
is some question as to whether or not all
ordinances in respect to the property of the
described new structure would comply with all
the ordinances. He also felt that until the
plans are submitted, it cannot be determined
whether or not all ordinances have been complied
•
with
John Blaich, 2601 Bayshore Drive, appeared
before the Planning Commission and stated that

he is presently the legal owner of the property.
He stated that he had a Record of Survey made
which was recorded on May 20, 1965 by the county
He felt that what is to be built on the
property is not the question at this time and
that the question is only whether or not these
two parcels should be combined as one. He
felt that there is no reason for the Planning
Commission to grant a postponement.
Max Dillman, 1322 E. Oceanfront, appeared
before the Planning Commission and voiced his
opinion that the Planning Commission should
not approve this resubdivision without first
seeing the plans. He stated that although it
is not required, it is normal that on a
multiple subdivision the plans be seen.
Harry Kamph reappeared before the Planning
Commission and stated that heretofore some of
the Commissioners have indicated that at the
time of the denial of the Use Permit by the
City Council that this apparently had no
administrative effect on this subdivision. It
was_Mr. Kamph's contention that when the
City Council denied the Use Permit, they
automatically cancelled the subdivision.
Hord Seeley, 1307 East Balboa Boulevard,
appeared before the Planning Commission and
stated that he feels it should be decided what
is going to be built on the property before
a decision on whether or not to combine these
two parcels is made.
Brion Jeannette then reappeared before the
Planning Commission and stated that he has been
working quite closely with the Current Plans
Division of the Community Development Department
to be sure the project is not in violation.
He stated that he showed the plans to the
Planning Commission at their Study Session
about a month ago when he requested an
interpretation of the definition of a connection
between the two buildings.
Shirley Moore, 1309 E. Balboa Boulevard, appeared
before the Planning Commission and questioned
the accuracy of the Subdivision Map.
John Blaich then reappeared before the Planning
Commission and presented a Record of Survey

Benjamin Nolan, City Engineer, then reviewed
the Record of Survey and stated that he could not
see any discrepancy between the Record of Survey
and Resubdivision Map.
There being no others desiring to appear and
be heard, the public hearing was closed.

Commissioner Heather explained that at the
July 1, 1974 Study Session, Marian Parks, a
member of the Citizen's Environmental Quality
Control Advisory Committee, requested that
the archaeological portion of the policy be
continued until August 1, 1974 and the paleontolo
gical portion be continued to July 18, 1974,
Commissioner Heather asked if anyone cared to
appear and be heard in regard to this discussion
item.
There being no one desiring to be heard, motion
was made to continue the paleontological portion
of the policy to July 18, 1974 and the
archaeological policy to August 1, 1974.
ADDITIONAL BUSINESS
Motion to direct staff to prepare a letter to
the City Council for the Chairman's signature
regarding the establishment of a Historical
Zone.
Planning Commission adopted Resolution 892
setting for public hearing an amendment to the
Municipal Code amending the definition of
"family and dwelling units" for August 1, 1972,
