The Newport Beach City Planning Commission held a regular meeting
Thursday, July 10, 19459 at 700 p.m., in the Council Chamber, City
Hall, Newport Beach, California, with Chairman- Pro -Tem Howard W.
Seeger presiding.
Commissioners presents Allen, Baltz, lsbell, Johnson, Nelson, ROLL .CALL
Patterson, and Seager.
Commissioners absents -None.
Chairman Pro -Tem Seager administered the oath. of office to two
newly appointed Commissioners, Philmer J. Ellerbroek, and Walter
M. Longmoor; the Mayor and City Council having appointed Mr. Long -
moor to replace C. Harold Hopkins, resigned, and Mr. Ellerbrosk to
replace 0. M. Campbell, also resigned.
Commissioner Johnson me& the motion, seconded by Commissioner MINUTES
Allen, that the reading of the minutes of the meeting of June 21,
19451 be postponed to the next regular meeting, for further consider-
ation. Motion carried and so ordered.
Secretary Allen read a letter of application from R. T. Hubbell re- COMMUNICATIONS
questing a rezoning of six lots adjacent to the Southern Califor-
nia Gas Company installation on Naxport Blvd.(north of the Arches),
which brought the motion by Commissioner Patterson, seconded by Com-
missioner Johnson that the matter be revamped by Mr. Hubbell, with
complete details, and when so done, that the secretary be instructed
to advertise same for public hearing. .Motion carried and so ordered.
Tentative map of Tract 1105, referred by the Orange County Planning
Commission was carefully scnsidered, and Commissioner Patterson made
the motion, seconded by Commissioner Johnson, that the map be approv-
ed as presented, and that the Orange County Planning Commission be so
advised, and be requested to send the Newport Beach City Planning
Commission a copy. Motion carried, and so ordered.
The matter of a proposed lease to Mr. T. Be Kilkenny with extensive
improvements totalling $150,000, for a yearly rental.of $15,000 to
the City, for the City owned property on Coast Highway, was present-
ed after having been presented to the.City Council, and referred by
that body. Councilman Robert Allen was present for the meeting, as
was Mr. Kilkenny, who explained the proposed project, which calls for
the building of 84.slips, for vessels from 40 fast to 120 feet, and
to accomodate 125 vessels of all 'sizes; two dry storage lots for 100
small craft; an overhead Mono -rail system; four comfort stations;
garages for 80 cars; lockers of various sizes in the garage buildings;
one large public pier for visiting yachts(about 10) to take on sup-
plies, guests, etc., and to tie up for 24 hours; one large game fish-
ing pier; a future yacht club; future motels; future fish grotto re-
strauant; and ample parking space. Mr. Kilkenny stated that the con-
templated improvements would be carried out with an idea to make New-
port Harbor the headquarters for yachting in Southern California,
' with distinctive landscaping, architecture, etc., everything on a
high class basis; that the project was already entirely financed,
and that the income to the City, in addition to the yearly rental,
(lease to be for 25 years) would yield taxes on the taxable improve-
ments of $150,0001 as well as on the.psoposed yacht club, stores,ete.,
increasing the value of the property and adjacent properties, with
further increased taxes. Councilman X-11an stated that the Council
had referred.the proposition to the Commission, wanting the Commiss-

ioners to back or reject it first. Commissioner Allen brought up
the objection that the proposition,as presented, left too much for
future plans, and Commissioner Johnson stated that ton the face of
its I am not in accord ", while Commissioner Seeger said that the
Commission's primary concern must be "the best land use of the pro-
party,, water front land, and are we going to commercialize our com-•
munity ? ", that "we owe Orange County a debt, and,the settlement of
this subject involves too much to be decided quickly. ". Commission-
er Patterson pointed out that Newport is a recreational harbor, and
that this water frontage should be used for yacht moorings, since;
the City has only so much space left for such use: Commissioner
Seeger repeated that the Commissions primary concern was the best
land use for the property, and that snap.judgement would be bad.
Commissioner Longmoor made the motion, seconded by Commissioner
Patterson, that the matter be referred for further study by the.
Commission as a whole. Motion carried, and so ordered.
PUBLIC HEARINGS First hearing upon the proposed Amendment to Ordinance No 5251,
having to do with the prohibition of the leaping, etc., of hogs,
etc., and other animals, excluding horses and cows, as advertised
was declared. The Secretary read the original Resolution passed
by the Commission on this,(No. 251); and also a- portion of Ordin-
ance No. 525, having to do with this matter. No protests were
heard or received, and ¢ oomissioner Patterson made the motion, as-
conded by Commissioner "'elson, that the matter be passed to the
second hearing. Motion carried, and so ordered.
First hearing upon the proposed Amendment to Ordinance No. 525, '
having to do= -with a change in rear yard setback line of the east
side of 58th Street, between Marcus and 6hannel Place, as advertis-
ed. Commissioners Patterson and Nelson, appointed by the.Chairman
previously, to check on this, recommended that the change be made,
and Commissioner Patterson made the motion, seconded by Commission-
er Nelson, that the matter be passed to the second hearing at the
next regular meeting of the Commission. Carried, and so ordered.
NEN.BaS_ INES In view of the presence of Mr. Diggs and Dr. Bingham, of the Orange
County Planning Commission, at this meeting, the regular order of
business was changed, and Mr. Diggs stated that they had expected
to be joined by Supervisor Warner, but that he had apparently been
detained in Santa Ana, so requested that the matter which they were
to have discussed, be postponed to a later date, when Supervisor
Warner could be present. The matter for discussion, he explained,
was the zoning of County properties surrounding Newport Harbor,
"should it be zoned at all, or should it be zoned a little? We
want your ideas, and want our differences itoned out before putt-
ing it up to the public". Co>m>cissioner.Seager stated that the com-
mittee which met with the group earlier had given it some thought,
but had not formulated definite ideas.
V_ZCTION OF Commissioner Seeger announced the annual election of Officers, stat-
OFF ICERS ing that the statutes require the election of a chairman and a sec- '
retary each year/ Commissioner Patterson made the motion, seconded
by Commissioner Baltz, that Commissioner Allen be nominated for chair-
man, and this was followed by Commissioner Allen making the motion
seconded by Commissioner Johnson, for the nomination of Commissioner
Seeger for cbai man. Both motions carried. In view of this, Com-
missioner Johnson took the chair temporarily, and Commissioner Pat-
terson made the motion that the nominations be closed. Motion sec-

onded by Commissioner Longmoor, and carried. The Chairman requested a writ-
ten vote, with Comaissionsr Longmoor to make the official count, which gave
Commissioner Allen six votes, and the election as ohairmmn for the year
1945 to 1946 ;.and Commissioner Seager two votes (one ballot "not voting ").
' The Ohairman then declared the nomination- for secretary as open, and Com-
missioner Allen nominated Commissioner Eilerbroek for the office of secretary.
Commissioner Patterson made the motion, seconded. by Commissioner Lougmoor,
that the nominations be closed. Motion carried, and Commissioner Patterson
then made the motion, again seconded by Commissioner jongmoor that Commiss-
ioner Ellerbroek be unanimously elected secretary. Motion carried.'
Commissioner Nelson presented plans of F. G. Morgan for a proposed trail- NEW BUSINESS
er court on Coa:t Highway, West Newport, east of the Santa Ana River,which
brought the motion by Commissioner Isbell, ana seconded by Commissioner
Patterson that the matter be referred to the Architectural Committee. Car -
tied, and so ordered.
The matter of the proposed Ame.ndmant to Ordinance No. 525 for variance of
rear yard setback requirements from 100 to 51 for Block 14, Balboa Tract,
which was laid upon the table at the April meeting, pending the passing
of Ordinance No. 555(granting the Commission jurisdiction to grant 50% re-
ductions in regulations "of lot area requirements, and front, side, and
tear yard regulations, where in the judgement of the Planning Commission,
the shape of the building site, topography, the location of existing build -
ings, or other conditions make a. strict compliance with said regulations
impossible without practical difficulty or hardship ". The matter was
brought before the Commission by John A. Elliott, with a petition signed
' by adjacent property owners; public hearings were held, but no action taken.
Commissioner Johnson made the motioni seconded by Commissioner Allen that
the matter be now taken from the table. Carried. Discussion of the.new
Ordinance No. 555 developed that said Ordinance would not be in effect un-
til thirty days from the date of its approval and passing, i.e. July 2,
1945, whereupon, Commissioner Seeger made the motion, seconded by Com-
missioner 4obnaon that the matter be deferred to a special meeting, at the
call of the chairman. Motion carried and so ordered.
Commissioner Seager made the motion for adjournment, seconded by Com- ADJOURD[ENT
missioner Nelson. Motion carried and so ordered.
