MINUTES OF THE MANNING COMMISSION MEETING, THURSDAY, JULY 15, 1954 - $900 PM
CITY HALL COUNCIL CHAMBERS, NEWPORT BEACH, CALIFORNIA
Chairman Lengmoor called the regular meeting of the Planning Commission to order.
ROLL CALL:

#150 Application of the Irvine Go. for frontyard setbacks on Lots 24,
25, and 26 in Tract #1700 known as Irvine Terrace, as follows

FINDINGS: This Variance is in accord with the previously agreed setback/ open.

CONDITIONS: This variance is required by agreement between the Planning
Commission and the Irvine Co. upon approval of the original and tentative
tract maps of Tract #1700 and 01701, and R-1 zoning amendments wherein
staggered setbacks would be allowed upon the condition that a variance
would be needed for each lot and the setbacks would be shown on District
Map #24 and adhered to by the builder under authority of Article c*,
Ordinance #650 of the City Code.
Com. Hayton moved that the hearing be closed, seconded by Com. Rudd, and
carried.

and carried by the following roll call vote, to -wit:

Application of Kelso & Sloan to re- subdivide an R-3 district parcel

FINDINGS: Division of said R-3 district property into two building sites
as proposed, would automatically limit the use of each lot to two dwelling
units under Section 9103.35 (b) of the City dodo. The majority of recorded
lets on Lido Isle are 30 feet wide or lase. The applicant has incorposated
an Rrl district use is his application.
CONDITIONS: Said building sites #1 and #2 as described herein are limited
under this Variance to an R-1 district use and R..1 district requirements of
Zoning Ordinance #635 of the City of Newport Beach Municipal Code.

FINDINGSs The sign has been in its present location for a number
of years. Its use for advertising a section of Newport Beach only

population of the City of Newport Beach and can thus be classed in
a different category from the commercial •ign which the Planning
Commission is desirous of eliminating from the City.

' Application of Gordon Wa. Grundy and Dr. Alvin J. Terry to construct
and operate a two story apartment building containing eight dwelling U.P. #152
units with nine enclosed garages on an R-3 parcel of ground consist-
ing of Lots 1090 and 1091 of Tract #907 and located on the northwest Grundy,Gordon
corner of Via Lido Nord and Via Antibes. &

FINDINGS: Same conditions exist under application for Use Permit
#152 as were encountered in Use Permit Application $143 Lots 1090,1091
Eight dwelling units is in excess of any ratio pre- Tr. #907
cedent which might be considered as having been set by the allowance
of Use Permit #107 to Mr. Harry Kelso. DENIED
However, the Planning Commission does not consider
any of its decisions to set a precedent. Each application must
stand on its own merit. The Commission does not consider the con-
struction of 8 units on said property to be the best development for
the area.

Application of Leo B. Kirchner to allow the construction and operation
of a four dwelling unit apartment building on an R-3 district parcel U.P. #153
containing 4200 square feet on Lots 14, 15, and adjacent 20 feet of
Lot 16, Bloch 17, Section B. Newport Beach Tract.
Application was filed late, but upon motion of Con. Keene, seconded Kirchner, LeoB.
by Com. Smith, and carried, the application was considered without

FINDINGS: A four dwelling unit building on a let area of 4200 square Blk. 17,SEc.B
feet is in keeping with the allowable limit wherein 1000 square feet Npt. Beach
of ground area is required for each dwelling unit under Section 9103.35(b)
of the City Code. The proposed construction should not be detrimental to
surrounding or adjacent property.
The hearing was closed upon motion of Cem. Copelin, seconded by Gem. GRANTED
Rudd, and carried.
Con. Keene moved that the application be granted, seconded by Com. Smith,
and carried by the following roll call vote, to -wit:

First hearing on the application of David I. Nielsen, MD, to amend
Zoning Ord. #635, section 9103.1 from an R-1 district to a C-1 -H Amendment
district on Lot 19, Tr. #1136 located at 406 Westminster Ave. #17
Adjacent lots 17 & 18 are now zoned C-1 -H. Dr. Nielson desires to

Application was set for second hearing on August 19, 1954 upon Notion
of Com. Briggs, seconded by Com. Lind, and carried. (set for 2nd

Stricker Annex.
First hearing on Planning Commission Resolution of Intention
#585 to amend zoning on the recently annexed Stricker Annexation
from a "U" District to zoning districts available in Zoning
Ord. #635 that would be appropriate for land uses existing
or proposed. The first hearing has been advertised and posted as
being for the purpose of generd discussion with owners of
property involved.
The Stricker Annexation is located southerly of 15th St. between
Westminster Ave. on the east and the State Highway on the west
and including a trianidlar shaped parcel of ground between said
Westminster Ave. on the westerly side, Old County Road on the
northerly side, and Broad St. on the southerly side.
The hearing was closed and set for second hearing on August 19,
1954 upon motion of Com. Lind, seconded by Com. Briggs, and
carried.
Letter received from the Orange County Planning Commission asking
Letter from for the Newport Beach Planning Commission's recommendation on an
Orange County application for excavation. There was insufficient time between
Planning Comm. the City and County meetings to transmit a recommendation;
therefore, the letter was ordered filed upon motion of.Com.
Briggs, seconded by S m. Smith, and carried.
Annual report Upon motion of Com. Lind, seconded by Com. Hayton, and carbied,
1953 -54 the annual report of the Planning Commission was approved and
submitted to the City Council. ,
As there was na further business, the meeting was adjourned
upon motion of Com. Copelin, seconded by Com. Keene, and carried.
