On motion of Commissioner Glass, seconded by Commissioner Heather, and carried, the Minutes of July 1, 1971 were approved as written. * * * * * * * * * * Chairman Dosh, together with Senior Planner Nuzum, made a special presentation to former Planning Commissioners. George W. Brown, John S. Watson and John J. Jakosky by presenting each of them with a Certificate of Appreciation in the form of a plaqu . Request to construct an interim "Plant Operating Item 1. He also stated that a time limit of 5 years would be agree- able as a condition. X Following discussion, Use Permit No. 1540 was X approved subject to the following conditions: 1. The development shall comply with the plans as submitted, except that minor variations may be approved by the Director of Community Develop- ment. 2. No structure shall exceed a height of 15 feet. 3. Complete landscaping plans, including a water- ing facilities plan, shall be submitted to the Director of Community Development for his approval and subject to review by the Director of Parks, Beaches and Recreation. A determin- ation as to the necessity for parkway trees shall be made by the P.B.& R. Director at the time of review of the landscape plans. 4. This approval shall be for a period of five (5) years from the effective date of this action. Any request for extension shall be subject to review by the Modifications Committee. Request to permit the location of a museum in an Item 2. existing building in a C -1 District. COMMI551PNERS L CALL Motion Second All Ayes 0 u CITY OF NEWPORT BEACH MINUTES July 15, 1971 INDEX Mr. Wilson, Architect and representative of the Board of Trustees of the Newport Harbor Art Museum appeared before the Planning Commission to answer questions pertaining to this request and to explai the situation relative to parking. Thomas Garver, Director, Newport Harbor Art Museum appeared before the Planning Commission to answer questions in connection with special events and activities. The parking situation in this area was discussed at some length as well as dates and hours of operation. X Following the discussion, Use Permit No. 1541 was X approved subject to the following conditions: 1. The site shall be developed in accordance with the submitted plot plan, except that minor modifications may be approved by the Director of Community Development. 2. All landscaped areas shall be separated from paved areas by a concrete curb 6 inches higher than the adjoining paving, and shall be provided with permanent watering facilities. 3. An off -site parking agreement, in letter form bearing the other parties' countersignature, providing for the use of 6 spaces in the Forgit. parking lot, for staff parking only, shall be filed with the City. Museum personnel shall not utilize the 12 on -site spaces. 4. Hours of operation and yearly schedule shall be as shown on the applicant's submittal as modi- fied by the July 13, 1971 memo from the Staff to the Planning Commission. 5. This approval to be for a period of five years only. Request to permit a subdivision of 9.135 acres into 55 lots and two lettered lots (Unit T -III Item 3. of North Bluff). Costa Mesa Engineer: Raub, Bein, Frost.& Associates, Costa Mesa Owner: The Irvine Company, Newport Beach Senior Planner Nuzum presented the final map to the Commission and the problem of whether or not to name an access drive between Lots 7 to 10 and 11 to 13 in order that addresses may be given and answered questions of the Commission. William Holstein, representing the Developer appeared before the Commission and stated that the could name the access drive and would do whatever the Commission requested; however, they have found from past experience that it was better to address the lots from the circular street than to name the alley way as it is less confusing to the public. • Bill Frost of Raub, Bein, Frost appeared before the Planning Commission and agreed to do whatever the Commission requested in connection with the naming of the alley. Motion X Following a general discussion, during which it wa Second X decided not to name the alley, the final map of All Ayes Tract 6885 was recommended to the City Council for approval subject to the following conditions: 1. That all improvements be constructed as required by ordinance and the Public Works Department. 2. That Section 19.20.110 of the Subdivision Ordinance requiring that lots abut on a street be waived in accordance with the provisions of Section 19.32.030, provided adequate access is furnished. 3. That Section 19.20.110 of the Subdivision Ordinance regarding size and shape of lots be waived in accordance with the provisions of Section 19.32.030. • 4. That all grading be in accordance with grading plans and reports approved by the Public Works Director and.a qualified Soils Engineer. Upon completion of the grading, the Civil Engineer and the Soils Engineer shall certify that the Page 4. Permanent reproducible copies of the grading plans on 24" X 36" linen or mylar sheets shall be furnished to the Public Works Department. 5. That the design and layout of the proposed private streets be in accordance with the City Private Street Policy and be subject to approv 1 by the Public Works Department. 6. That construction of the proposed private streets be inspected by the Public Works Department, and that a standard inspection fee be paid. 7. That the requirement for a perimeter of public streets be waived in accordance with the provisions of Section 20.50.080. 8. That the boundary of the final tract map be checked by the County Surveyor before being . submitted to the City for approval. 9. That Section 19.16.030 of the Subdivision Ordinance regarding map scale be waived provided maps drawn accurately to a scale of 1" = 100' are furnished the Public Works Department immediately after approval of the final map. 10. A document satisfactory to the City Attorney guaranteeing vehicular access to Lots 56 and 57 from the adjoining shopping center drive shall be recorded. 11. Parkway trees will be installed in accordance with P.B.& R. specifications. 12. Species and location of parkway trees will be determined at a later date by the City in conjunction with the developer's landscape planner. 13. The $3.00 tree inspection fee will be appli- cable to all trees on both public and private streets. • 14. That the developer shall be responsible for all precautionary actions necessary to pro- tect the quality of the waters of Newport Harbor during grading operations, and shall Page 5. Request to amend a portion of Districting Map No.l Item 4. from a C -1 -H District to an R -2 District. AMEND - Location: Lots 7 and 8, Block 4 of Seashore M NT Colony Tract located at 209 and 211 96 Cedar Street, at the southwest corner of Cedar Street and Newport Shores APPROVE Drive. Zone: C -1 -H Applicant: Patrick O'Connor, Newport Beach Owner: J. C. Agajanian, Newport Beach Senior Planner Nuzum presented this application to the Commission and advised that the staff had discussed with the applicant the matter of a corner cut -off similar to the agreement obtained under Amendment No. 291. Patrick O'Connor, applicant, appeared before the Planning Commission and stated that he is agree- able to a corner cut -off agreement. Planning Commission discussed the matters of sidewalk, curb and gutter and general zoning in the area. X Following discussion, Amendment No. 296 was X recommended to the City Council for approval. ADDITIONAL BUSINESS City Attorney O'Neil answered an inquiry which was made by Commissioner Martin several weeks ago in connection with the financial disclosure laws: He stated that the Jesse Unruh bill was declared unconstitutional and therefore no further legisla- tion of this type could be enacted. However, there are several bills pending before the legislature in connection with Section 3750 of the Government Code dealing with elections and contributions which should not effect any of the Planning Commissioners. Page 6. COMMISSIONERS wy N z CALL m CITY OF NEWPORT BEACH July 15, 1971 MINUTES INDEX The matter of amending the Rules of Procedure was presented to the Planning Commission by City Attorney O'Neil. He stated that the last Rules of Procedure were adopted in January, 1963 and since that time circumstances warrant certain amendments should be made to these Rules. In accordance with the Rules of Procedure adopted January, 1963, a Notice of Intent to present certain amendments to the Planning Commission has been served on Mr. Nuzum, acting as representative of the Community Development Department. Draft copies of the amended Rules of Procedure were presented to the Planning Commission for dis- cussion. Following discussion, the matter was requested to be placed on the Study Session agenda of August 5, 1971 with formal action to be taken at the regular Planning Commission meeting. * * * * * * * * * * Following a general discussion by the Planning Commission, motion was made by Commissioner Heather, seconded by Commissioner Hazewinkel, and carried, to adjourn.
