HomeMy WebLinkAbout07/17/1940JULY 17, 1940 THE NEWPORT BEACH CITY PLANNING COMMISSION met in regular session Wednesday, July 17, 1940, 7:30 P. M. in the Council Chambers, City Hall; Chairman Hopkins presiding. Meeting called to order by the Chairman. ROLL CALL - Commissioners present: Commissioners absent: Hopkins, Seager, Briggs, Estus, Patterson, Allen. Findlay, Hodgkinson, Williams. MINUTES - Com. Estus moved that the minutes of the regular meeting held June 19, 1940 be approved as written. Seconded by Com. Allen. Motion carried, so ordered by the Chairman. DISCUSSION OF TRACT 1011 - Secretary Seager introduced as guests Chairman Bingham and Mr. St.John of the Orange County Plan- ning Commission who were present for the purpose of discussing with the Newport Beach Planning Com- mission the tentative map of Tract 1011. Mr. Bingham reported that at the last regular meeting of the Orange County Planning Commission the tentative map of Tract 1011 was approved with some reservations as to drainage and it is now on Its way to the Board of Supervisors. This matter was held over at the request of this commission but due to some misunderstanding of the date of their meeting, no one was present. Chairman Hopkins explained that the City of Newport Beach is anxious to do away with all septic tanks in the city, from a health standpoint it is a very serious matter. Mr. Bingham stated that Mr. Strobridge had presented data showing that the city not only has septic tanks within the city limits, but is allow - ing new ones to go in. The Orange County Planning Commission passed the tentative map on that ground. Com. Estus pointed out that the new septic tank s are in West Newport some distance from the than- nel. Com. Allen city is trying away with all to the bay and go on record as development usi said that at the present time the to work out this situation doing deptic tanks immediately adjacent he would like to have the commission strenuously opposed to any new ng septic tanks. C, Com. Patterson stated that when the city was forced to move the sewer plant, Mr. Strobridge was one of the leading lights in that movement. The main purpose at that time was to eliminate any possible contamination of the bay. Since that time he has come on with his subdivision. There has been some discussion of his connecting up with the city sewer. Mr. Bingham said that their commission was advised by counsel that if Mr. Strobridge provided sewer disposal comparable with the surrounding territory they had no grounds on which to disapprove his tentative map. As far as the planning commis- sion is concerned their problem is with design, size of lots, etc. Mr. St.John stated that the condition of the contamination of the bay is not present yet. Until the actual condition exists, he did not see how legally anyone could insist on sewers. This com- mission might protest to the board of Supervisors, the Real Estate Commission or the Board of Health. Com. Estes moved that the Secretary be instruct- ed to write letters to the Board of Supervisors and the State Real Estate Commission requesting a hear- ing on this matter when it comes before them, also requesting notification of the time at which it will come before these boards, since this commission wishes to protest this matter. Seconded by Com. Allen. Motion carried and so ordered by the Chairman. Com. Seager expressed the opinion that the Orange County Planning Commission gave this com- mission all the assistance and cooperation possible in an effort to bring about what we desired. It is not within their jurisdiction or our jurisdiction except as pertains to the lot areas, width of streets, sufficient drainage, etc. Mr. Bingham said that they had enjoyed the opportunity of coming to the Newport Beach meeting and hoped that a better understanding between the two commissions would result. He invited the Newport Beach Commission to attend any of their meetings. Their regular meeting is held the 4th Wednesday of each month. APPROVAL OF TENTATIVE MAP OF TRACT 1061. The tentative map of Tract 1061 tabled for 30 days at the last meeting was brought up for con- sideration by order of the Chairman. Com. Estus explained that the American Legion Corporation now had clear title to this land and wishes to subdivide it. The lots are about 33 1/3 larger than any lots surrounding the property. The commission was of the opinion that they compared favorably with contiguous property as to size. After further discussion, Com. Seager moved that the tentative map of Tract 1061 be approved. Seconded by Com. Briggs. Motion carried and so ordered by the Chairman. COMMUNICATIONS - Petition of John A. Harvey for Rezoning. Secretary read s. petition addressed to the City Council of the City of Newport Beach for the re- classification of Lots 17 and 18, Blk 1, Sec'4, Balboa Island from R -2 to C -1 and signed by the legal owners, John A. Harvey and Edith G. Harvey. This petition was referred to the Planning Com- mission for hearings and recommendation. C om. Patterson moved that this matter be set for hearing at the next regular meeting of the Commission August 21, 1940 and that postcard notices of said hearing be.sent to property owners in the immediate neighborhood of this property. Seconded by Com. Estus. Motion carried and so ordered by the Chairman. Letter from Grainger Hyer. Secretary read a letter from Grainger Hyer addressed to the Planning Commission in which he requested immediate action on changing setbacks on the Little Island in order to relieve what he termed "intolerable conditions" existing there. The district maps being prepared by the City Engineer were discussed. It was Com. Patterson's opinion that it would not take long for the new zoning ordinance to be prepared after the setbacks and zoning were decided upon. He stated that he could have his maps com- pleted within two weeks and would try to complete the work on them in cooperation with the committees appointed by the Chairman. If alley setbacks are also to be considered it may take longer. He said he would take charge or re- vamping the ordinance and try to speed it up. DISTRICT MAP COMMITTEES - Chairman Hopkins announced the following appointments for the District Map Committees: Balboa Island Allen, Chairman - Briggs, Seager. tsriggs, unairman - r.LL,LL�ay Corona del Mar Williams, Chairman - Findlay. Newport Findlay, Chairman - Estus. Balboa and Penninsula s tus, Chairman - Hopkins. Mr. Hyer suggested that the city attorney be consulted to determine whether or not the present zoning ordinance is valid and if not to take steps to correct those portions having defects. If it is going to take six months to redraft the ordinance that will mean the city will be without an ordinance for that period if this ordinance is attacked and found invalid. Com. Estus moved that the Chairman get in touch with the city attorney and find out what is legal so that we will have it down in black and white.. Seconded by Com. Seager. Motion carried. DISCUSSION OF PARKS - Coma Seeger reported attending a meeting of representatives of 47 civic organizations in the city. The subject of the meeting was "parka, parkways and recreational centers ". He stated that he had been requested, as =a member of the Planning Commission to attend a second meeting which will be called and to bring data having to do with the possible available areas within the city of Newport Beach which might be used as recreational centers. He suggested that it might be well for the Planning Commission to spend a little of its money in having plans of this nature prepared. If we are ever to have a master plan we have to take steps of this kind. It is definitely the duty of this commission to supply the public with plans for the future development of the city, not necessarily something they are going to build but something they may build if they want to. General discussion of the park situation folloiWed. • 9' 0 Com. Seager moved that the Planning Com- mission request the city engineer to make plans which will convert some of the areas available for that purpose into parks. Seconded by Com. Briggs. Motion carried and so ordered. ADJOURNMENT Com. Seager moved that the meeting adjourn to Friday, July 19, 1940, 7:30 p.m: to meet with the City Attorney at that time to see if there is any way we can re -adopt Ordinance 440 and at the same time make such changes therein as will allow the district maps tobe incorporated therein.
