MINUTES Minutes of the meeting of June 21, 1956 APPROVED on

AMENDMENT NO. 23
1. SEAQUIST ANNEXATION Properties between Irvine, Tustin,
15th & 16th Streets excepting the
Tract known as Aldean Place #1583.
2� Third hearing on Planning Commission Resolution of Intention #601 to
amend zoning on the recently annexed Seaquest Annexation from, "U"
District to Zoning Districts available in Zoning Ordinance # 635 that
would be appropriate for land uses existing or proposed.
3. Read to the Commission were recommendations of HAHN, WISE, AND ASSOCIATES
dated July 2, 1956.
4. Commissioner Hayton moved the Commission recommend to the City Council
that the entire area be zoned R -1 except all of Lot 47 and a portion of
Lot 37; all of Lot 47 and a portion of Lot 37 to remain in an "Unclassified"
District; front yard setbacks be established as a minimum of 301 and a
maximum of 401; that all houses now existing with front yard setbacks
in excess of 401 be regarded as conforming to front yard requirements
of Code, seconded by Comm. Briggs, and carried by the following roll call
vote, to wit: ALL AYES

4. An encroachment of 10" into three (3) foot required side yard setback
to allow for extension of fireplace. Under Section 9105.4 (b) fireplaces
and chimneys may encroach to a distance of two feet from one of the
side lines. The applicant desires to encroach an additional 10" permitting
a total of 22".
5. The chimney on the lot was inadvertently built 10" too far into the side
yard setback.
6, DISCUSSION Note findings,
7. FINDING As for encroachment, Section 9105.4 (b) is specific and the
Commission feels that same should be strictly followed.
No hardship has been shown as required under Section 9106.3.
8. Commissioner Reed moved the Commission recommend the DENIAL of this
Variance, seconded by Comm. Hayton, and carried by the following roll call
vote, to wit: ALL AYES.

4. Awnings to be attached to houses in Tract # 1011 but not to extend further
than to six inches back of the line of waterway. Awning supports shall not
be greater than two and one -half inches in diameter and the fascia shall not
be lower than six and one -half feet from the floor level. The structure
shall be of overhead type and shall not be enclosed on the sides or front
other than by an open guard rail which shall not exceed two and one -half feet
in height.
5. The sides of the houses facing the water are largely constructed of glass.
The sun shining in and on the glass renders this portion of the houses almost
unusable during certain period of the day and also causes rapid deterioration

7. Findings The Commission feels there is a definite hardship
involved in this application as required under
Section 9106.3 for granting variances and recommendation
of approval is made subject to a copy of the Balboa
Coves Community Association Specifications being made
a part of the variance application.
8. Commissioner Lind moved the Commission recommend the APPROVAL of this
VARIANCE subject to the above condition, seconded by Comm.'Hayton and
carried by the following roll call vote., to wit: ALL AYES.

7. Findings Because the lot in question is in a "U" District a Use
Permit is required for any construction under Section
9103.81 of Ordinance # 635. Recommendation of approval
is made subject to the condition that the applicant con-
form to R -1 requirements and restrictions.

Use Permit, seconded by Comm. Lind and carried by the following roll call

5. The lot in question is within 2001 of an R -3 Zone and under Section
9105.1 (b) a Use Permit must be secured before the sale of liquor may
be permitted.
6. Discussion . Note findings.
7. Findings The residential zone is comprised of Apartments which are
seasonal and attracts teen -age groups. Applicant has shown
intent of enlarging establishment by providing 40 or more
seats. The Commission feels this increased capacity would
not be desirable for teen -age groups who are using near by
residential property.
8. Commissioner Reed moved the Commission recommend the DENIAL of this Use
Permit, seconded by Commissioner Lind. Said motion resulted in a tie
roll call vote as follows:

petitioner.

2. Commissioner Briggs moved the Commission recommend the DENIAL of this
Resolution of Intention due to a procedural error, seconded by Comm.
Lind, and carried by the following roll call vote, to wits ALL AYES.

TENTATIVE MAP
#2813
Presented to the Planning Commission were six copies of Tentative
Map # 2813, being a portion of Block 94 of Irvine's Subdivision as
shown on Book 1, Page 88, M.M. Orange County California.
The City Engineer submitted a letter to the Commission dated July 5,
1956 stating that he had found the Tentative Map to conform in all
respects to the applicable provisions of the Subdivision Ordinance.
Commissioner Briggs moved the Commission recommend the APPROVAL of
this Tentative lisp, and that the Subdividers be informed of the re-
quirements of Section 9255.27 of Ordinance # 650, seconded by Comm.
Lind and carried by the following vote, ALL AYES.
FINAL MAP
#3082
Presented to the Commission were six copies of the Final Map for
Tract No. 3082, being a parcel of land lying in Lot 159, Block 53
and Lot 157, Block 52 of Irvine's Subdivision.
On motion of Commissioner Lind, seconded by Comm. Briggs and carried,
Final Map of Tract # 3082 was approved subject to the following conditions:
1. That the Subdivider be instructed to
pay the City of Newport Beach ?"15.00
per lot for park purposes in accordance
with the Minute Resolution adopted by
the City Council on April 17, 1956.
2. That the Subdivider comply with the
requirements of Section 9255.27 of
Ordinance # 650.
ELECTION OF OFFICERS
Commissioner Briggs nominated Comm, Longmoor to succeed himself as
Chairman. Comm. Briggs nominated Comm. Copelin to succeed himself as
Seretary. Comm. Keene nominated Comm. Lind for the office of Vice
Chairman. The Commission acting as a whole, unanimously endorsed all
nominations, and the offices of Chairman, Vice Chairman and Secretary
were declared filled.

• Business at hand being declared completed, the Commission meeting
was adjourned on motion of Comm. Briggs, secondde P �• Hayton
