BEACH- CMt HALL ROU Commissioners Present: Briggs, Copelin, 811erbroek, Longmoor, Pleger, Rudd, Smith, ' CALL: and Wightman. Commissioners Absent: Daniell MINUTES: Commissioner Rudd moved that the minutes of the meeting of June 151 1950, be approved as submitted to the Commission, seconded by Commissioner Wightman and carried. PUBLIC HEARINGS: Chairman Longmoor opened the public hearing on the proposal to change all front yard setbacks to twenty (20) feet on lots facing the Channel in the Canal Section and gave a brief background of it to the pepple present. He then asked for remarks from the floor. -- Joseph T. Tatum, 211 38th Street, 19 /138/River Section. Doesn't own property there. The change wouldn't force people to change their house or set it out further, but most of the places were built for summer beach homes and now are being used as all year round homes; therefore, people find it desirable to add on another room. �-- Marion Graves, 3808 River Avenue. Why shouldn't we get within fifteen feet of the sea wall if the people in Balboa Coves have a fifteen foot setback? - -Lars Iavagnino, 4006 River Avenue. Handed in paper with humorous signatures repre- senting considerable number of properties in area, all opposed to the proposed change for various reasons outlined in the accompanying letter. Most of the property is al- ready improved and it would give an unfair advantage to the people who have not im- proved their property at all or to those who could rebuild. Brought up the matter of maximum percent coverage on the lots and said that if the setbacks were granted, it- would only mean that they.would have to have larger back yards and smaller front yards. (Mr. Siple disproved this statement) Balboa Coves has nothing to do with this area under discussion. If some sections want a change in setbacks, then they should be granted it, but he claimed their section was different and did not want it changed. -- Gordon G Siple, 406 40th Street, 4/439 and 9 /340 /Canal Section. Thought as long as the people who signed the original petitions were satisfied, they shouldn't have to pay any attention to the others. - -Fred J. Cornick, 3400 Marcus Street, 1 /334/Canal Section. Voiced his protest. -- Alfred De Gaetano, 601 36th Street, 1 & 2/635 and 1 & 2 /636 /Canal Section. Would be nice to have one setback from now on. -- Melville G. McIntyre, 3507 Finley Avenue, In favor of the change. - -Henry H. Johnson, 36th and Marcus, 1/336 /Canal Section. If you have R-2, you must have a. twenty foot setback.. - -Mr. Peters, 3910 Channel. Also representing Mr. Jennen (6/539) and Mr. Cofflin of 3908 Channel. If petition is granted, there is nothing that would keep them from asking for a ten foot setback in a few years. All three men against the change. --Mr. Edwards, 3914 Channel Place. Opposed to any change. Newport Island is built , up about 85-90 per cent and looks pretty good and wants,it to stay the same. --Carl H. Beahm, 4,024 Channel Place, 13 /441/Canal Section. Against the change. Thinks it is just the wishes of a few people. 123 --Mrs. Ray A. Johnson, 3510 Marcus, 6 /335 /Canal Seetion... Wanted.to.make all setbacks thirty feet. - - Herbert F. Mayhew, 3403.Finley, 2/434/Canal.Section. Infavor.of..ths. setback change. —Mrs. Packard, 4028 Channel Place, thought.20.foot.setback might prove hazardous. Commissioner Wightman made a motion that the.bearing.be closed, seconded by Commis- sioner Smith and carried. I Commissioner.Pleger made a motion that a recommendation that the Planning Commission is opposed to the changing of all front yard setbacks in the area be sent to the City Council. Motion seconded by Commissioner Rudd and carried by the following roll call vote; to-wit: AYES: Commissioners Briggs, Copelin, Ellerbrosk, Longmoor, Pleger, Rudd, Smith, and Wightman. NCESs None i ABSENT: - Commissioner Daniell. Before Commission voted to act upon the petitions of Blocks 238, 239, 338, 339, & 340, there were a few additional comments. j- -Lars Lavagnino, opposed to people across the Channel from him having a twenty j foot setback. -- Albert Redden, 4001 Marcus, 1 & 2/340 /8ana1 Section. Can't see what difference it would make if man across the Channel put his house right out on the sea wall. Wouldn't oppose setback if somebody else wanted it and would help them, - -Ralph Maskey, 2/538 & 8 /637 /Canal Section. All blocks should be acted upon at one time. It would be better if we could have a twenty foot setback on all the Channel property. Commissioner Copelin made a motion that Blocks 238, 239, 3389 339, and 340 be granted a change from their present various setbacks to that of twenty (20) feet. ; Motion was seconded by Commissioner Smith and carried by the following roll call vote, to-wit:' j AYES: Commissioners: Copelin, Ellerbrosk, Longmoor, Rudd, Smith, and Wightman. NCESs Commissioners: Briggs, and Pleger. i ABSENT: Commissioner Daniell. i j Resolution carried and above recommendation will be sent to the City Council. j. Chairman Longmoor asked if there was any old business or if anybody had anything to present to the Commission. Commodore Dullmor of the Newport Harbor Yacht Club spoke in behalf of the yacht club and asked that the coning be changed on the property that the Club occupied. Will fall within R-1 zone under new ordinance and they feel that it represented a hardship on the club in case of a complete fire loss. The Chairman explained that a Use permit,secured from the Planning Commission would allow a club to go back in in any of the R zones. However, Commodore Fullmor said they wanted the property zoned for clubs rather than relying on getting a Use Permit from some future Planning Commission, and that.they would feel safer to have it zoned permitting it. The Yacht Club does not own the entire blbok though and so the Soiland property had to be taken into consideration also. 124 Discussed the possibility of creating a new zone expressly for yacht clubs, possibly to be known as a "Y" zons. Chairman.Longmaor suggested that the Coexodore discuss the various angles suggested by the Commission_with.the members of the board of the yacht club. ' NEW BUSINESS: Election of Officers. Commissioner.Copelin nominated Commissioner Longmoor for re- election as Chairman,. seconded-by Commissioner Ellerbroek; nominations closed, and Chairman Longmoor was. unamincusly.re - elected Chairman for the year 1950 -51. Commissioner Pleger nominated Commissioner Copelin for re- election as Secretary, seconded by Commissioner Smith; nominations closed, and Commissioner Copelin was unam- inously re- elected Secretary of the Planning Commission for the year 1950 -51. COMMUNICATIONS: Balboa Coves papers were forwarded from the City Council regarding the zoning of Lots 69 to 75 inclusive of the Balboa Coves Tract for study and recbm- mendation. Secretary Copelin read the letter from the Secretary of the Balboa Coves Community Association which had been sent to the City Council stating that they had taken a mail poll as to the desires of the property owners for the zoning of these lots. The results of the poll were twenty -three (23) ballots fbr the R-1 as against kifteen (15) for the C-1. The planning consultants had recommended that they be left R-1 as they came into the city. The big consideration as to zoning it C -1 was the traffic problem there on the boulevard. Chairman Longmoor suggested writing a letter to Hahn, Campbell and Associates, the Planning-Consultants, asking that they send their recommendations.
