This issue was discussed further at the end of the meeting and it was decided that it should be given further consideration at a future study session. Frank Hopkins, 4615 Surrey Drive, appeared befor the Commission and questioned the development of the property to the north. Staff advised that the property to the north was a part of the Oran County Master Plan which calls for low- density residential in the entire down -coast area and that any development adjacent to the City of Newport Beach would be compatible with the area. Robert Shelton appeared before the Commission ar pointed out that the subject property was unique in that it was isolated from the property to the north both in terms of access and grading. Daniel J. Wallace, 709 Cameo Highlands Drive, appeared before the Commission and requested a reasonable continuance of this matter to enable him the opportunity to study the matter, examine the statutes, and if necessary to confer with legal counsel to determine what alternative use <_ exist for the property, because of the impact on the immediately adjacent properties. There being no others desiring to appear and be heard, the public hearing was closed. Planning Commission discussed the time limit within which the Commission.must take action an( the City's moral responsibility to give due consideration to the views of the community association. The public hearings were re- opened for the purpose of obtaining further testimony. Robert Shelton appeared before the Commission and advised of his desire to move ahead on this project and commented that the community associi tion was briefed on the project which began ove a year ago and should be aware of the proposed development. He answered questions of the Commission relative to tenancy of the building and the uses which presently exist. Planning Commission discussed the terms of the use permit as they pertained to allowing the remodeling to take place over a five - year period as well as the fact that any revisions to the original plans would require an amendment to the use permit. Planning Commission also discussed whether or not any terms of the use permit had been violated and requested a report from the City Attorney in connection therewith. There being no others desiring to appear and be heard, the matter was referred back to the Plan- ning Commission for action. Motion X Motion was made that the Planning Commission receive and file the oral report given by Richar Lawrence and that the City Attorney prepare a report with respect to the terms and conditions of the use permit.
