Planning Director Hewicker explain d the nature of
the applicants' request and indicated that the
Staff was recommending that the .Planning Commis-
sion find the proposed changes in substantial con-
formance with the approved Tentative Map, particu-
larly as it pertains to the provision which would
allow the construction of the wall and the reduc-
tion of sound in the outdoor living areas adjacent
to the intersection of Jamboree and Bison Roads.
In response to a question posed by Commissioner
Thomas, Mr. Hewicker stated that tin separate
final maps will be presented at th August 7th
meeting.
The discussion was opened regar.din� this item, and
Dennis O'Neil, representing the Daon Corporation
and Eagle Development Company, app scants, appear-
ed before the Commission. In response to a ques-
tion by Chairman Haidinger regarding Condition
No. 38, which addresses itself to he noise impact
on the park, Mr. O'Neil stated that the applicants
were in total agreement, and the park would be
delivered as the condition requires. Responding
to Commissioner Beek's question concerning the wall,
Mr. O'Neil replied that because of Mr. Beek's sug-
gestion and those of other Commissioners, they had,
come up with a wall treatment withiangles and dif-
ferent types of masonry that are b�th aesthetically
pleasing and will satisfy the requirements regard-
ing noise attenuation. In a reply to Chairman
Haidinger's question concerning hove the sound
level was calculated, Mr. O'Neil alswered that not
only was the topography of the ian taken into con
ideration, but the field engineer Ialso calculated
here the end of the grade would.be�.; in order to ,
lace his monitor so that :the most accurate reading
possible could be obtained. He fuher stated, in
responding to Commissioner Beek's concern-
ing future noise level, their traffic people and
noise engineers did take into consideration a
"worse case" situation in projectirhg future traffic
flows in that area, as well as the, stringent fed-

Planning Director Hewicker explained that the pur
pose of the public hearing was to aillow the Plan-
• ning.Commission to take testimony and to give the
Staff direction as to which of the lternatives
should be evaluated in the preparation of the en-
vironmental document. Mr. Hewicker further ex-
plained that the hearing should then be continued
following this fact finding and information gathe
ing session. Mr. Hewicker then explained the
actions which had been taken by the City Council
and the Local Agency Formation. Commission leading
up to this hearing, and.the information which had
been assembled to this point. I.
In response to a question by Commissioner Beek,
Senior Planner Bluell explained that the County
Triangle is an area that is redeveloping and. that
the few single- family lots which are interdispers
are being replaced with multi-family units. F.oll

Bluell indicated that this data was taken from
the best information available.'
The public hearing was opened regarding this item
Mr. Earl Lane, representing the Got en State Mo-
bilehome Owners' League, 760 - 725 est Lomita
Boulevard, Harbor City, appeared be ore the Comm.
mission to urge the protection of t e mobilehome
parks in the area, perhaps with an rdinance
similar to the Mobilehome Park Zoni�ig established
by the City of Lakewood.
Mr. Dick Hogan, Plannin,g.Consultant, 1300 Dove
Street, Newport Beach, then appearel before the
Commission. In response to a conce n of Commis-
sioner Allen regarding an.increase rom fifteen
dwelling units to twenty units per, cre and.a
possible precedent being set by app�oving this
increase, Mr. Hogan stated that at I;he time the
current General Plan's provisions wire adopted,
the language therein stated, in eff ct, fifteen
dwelling.units per acre unless the lanning Com-
mission or the City Council determined that in
specific areas densities could be higher, and an
exception was made for a. tower apartment project
in Newport Center. Mr. Hogan then tated he rep-
resents two clients owning property in the County
Triangle, both of whom are in the process of
developing condominiums. He indica ed that two
of the properties have been approved by County
Planning Commission for condominiums with densi-
ties of twenty -two and twenty dwelling units,
respectively, and the other two projects have
densities of eighteen and twenty. H{e stated they
have no objection to the City's adoption of Alter
natives 2 or 8, with the exception that they woul
like to see the intensity of develo ment on Alter
native 8 be twenty -two units, in order to elimin-
ate the possibility of a nonconforming developmen

Concerning a question by Commissionler Thomas re-
garding the mobilehome preservation, Mr. Bluell
explained there are 213 mobilehome� spaces total
divided among three parks currentl existing in
the affected area.
Mr. Don Bendetti, #5 Inverness Lane, Newport Beach,
appeared before the Commission as repres.entativc
of the ownership of Newport Terrace, one of the
mobilehome parks in the affected area. Mr. Ben
detti recommended that Alternative No. 2 be
adopted; he wished to keep the present County
zoning essentially in force with the issuance of
a. use permit to operate the mobile ome parks if
the area was annexed to the City. He explained
that Newport Terrace was built more than twenty -
two years ago, and the owners have no plans to
redevelop it at the time. 'It is an old park that
is obsolete in many ways, and the future of the
park is very definitely in doubt from his point
of view. He stated that there is constant
deterioration of utilities and and rground systems .

In response to a question by Commis ioner Cokas,
Mr. Hewicker explained that there w uld be suf-
ficient distance behind the existing right -of -way
line to accommodate the requested d dication;
however, it might involve the remov l of required
parking spaces. Assistant City Engineer Webb
indicated that there were 158 parkiing spaces.pro-
vided on site, 18 spaces in excess of the 140
• spaces required for the existing development. In
addition, Mr. Webb also indicated that there were
no plans to modify the intersection of Superior
Avenue and Placentia Avenue and that the dedica -.
tion was required in anticipation of future traffi
back up.
Commissioner Allen disclosed a posslible conflict
and was excused from the dial. j
In reply to a question by Commissioner McLaughlin
concerning the 140 parking spaces required for
the two buildings, Planning Director Hewicker ex-
plained that the parking requirement for commer-
cial use is based upon total square footage rather
than the amount of space per business suite. He
further explained that the parking ould not be
assigned but would be a part of the common im-
provement.

In response to Commissioner Cokas' 6ncern. that
the right -of -way would not be properly landscaped
or maintained, Mr. Hewicker suggest ad that Condi-
tion 7 be modified to include the ;p rase "the
additional dedicated right -of -way b landscaped
until such time as it is required f r road pur-
poses ".
A question was posed by Commissioner Beek concern
ing the amount and source of money. required for
the removal of the parking spaces and the subse-
quent restriping required. Mr. Chunk McBurney,
Dale Price and Associates, representing the appli
cant, replied that during initial investigation,
this problem was discussed and it was proposed
. that the parking be left in its present condition
until such time as the street was widened. How -
ever, he does understand the problems and sugges-
ted that.a provision be put in the CC &R's that
would require the association of owners at such
time as the City uses their widening ability, to
remove the parking stalls.
In response to.a question regarding the timing of at
improvements, Mr. Webb indicated thdepending
upon the development of the County Triangle Area
it would probably be approximately three to five
years. before widening of the street would take
place.

with the findings and subject to the conditions
as set forth under Exhibit A of the Staff Report,
including the additional Conditions No. 7 and No.
8, and the requirement that the dedicated right -
of -way be landscaped until such time as it is re-
quired for road purposes.

In response to a question by Commissioner Beek
concerning the parking .problem, Mr. Naylor indi-
cated the heavy launch ramp operation and associ-
ated traffic would create a physical impossibility
for customers of Spoiler Yachts to have easy
access to. their sales office, thus (further in-
creasing the problem.
In response to statements by Mr. Naylor, Mr. An-
derson stated that he was also an owner at De
Anza Bayside.Village with'a double -wide mobile
home, and he concurred that parking problems did
exist on the highway, especially since the start
• of construction on the new bridge. He further
explained when the launch ramp is full, a sign
indicating that the ramp is closed is posted,
which stops fur.ther traffic. He agreed that on .
weekends, people do park on Bayside Drive, which
is legal parking in the designated area. He said
it was necessary for customers to come to their,
office at the water's edge because the gate on
the driveway to the launch ramp is a locked gate,
not an open access area. During the summer, he
indicated that their average three to four cus-
tomers a day would not create a. traffic jam.

The discussion was opened regarding this item
and Mr. Jay Evarts, the applicant and project
architect; appeared before the Planning Commis-
sion and stated his concurrence wi h the condi-
tions.as, set forth in the Staff Report.
In response to a question by Commissioner Thomas,
Mr. Hewicker explained that this site is differ -.
ent than the recreation and marinelcommercial are
of the Mariners' Mile Specific PlanlI in that it is
designated for retail and service dommercial uses
which permits retail sales by yacht� brokers,
boats, marine supplies, etc., as well as offices
for personal and professional services offered

the opinion of the Planning Commisslion, of a
similar nature.

Commissioner Thomas indicated his .dpposi,tion to
the motion based on his .previously expressed
sentiment that office uses were being developed

At.the request.of Commissioners Balalis and
McLaughlin, the Staff was i.nstructod to investi-
gate the display of the spas locat6d at 600 West
Coast Highway and bring the Use Pe mit for the .
Spa Makers back on the meeting of ugust 21, 1980
if they do not comply with the app oval granted
by the Commission.

Commissioner Haidinger expressed his thanks to
Commissioner Balalis on behalf of the entire
Commission for his excellent work 4s Chairman
during the past year. !
Commissioner Allen asked that a br of comment be
placed in the record to the effect that she was
• disappointed when she excused hers if because of
a conflict on Item #3, that she wa not notified
when the item had been voted on, and did, in fact
miss the next item's presentation Item #4.
Commissioner Balalis noted that th conference
room does have a speaker system.
